RESOLUTION NO. 1463
A RESOLUTION accepting a utility easement from Four R Development Company
WHEREAS, a field adjustment in location of the Southeast Pasco
Industrial Area Waterline Project L I.D. 114, will install waterlines across
private land, along East "B" Street, and
WHEREAS, the ultimate ownership of the utilities will be with the
City of Pasco, and
WHEREAS, it is necessary that the City of Pasco obtain and maintain
legal easements for the installation, operation and maintenance of the water
utilities across private lands, NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO
The City hereby accepts the attached utility easement from Four R
Development Company.
BE IT FURTHER RESOLVED that the City Clerk is directed to file the
easement in the legally prescribed manner

EASEMENT
For valuable consideration, including benefit to the grantors' appur-
tenant land and the benefit of the public interest, the grantor, FOUR R
DEVELOPMENT COMPANY does hereby grant, convey, and give to the grantee,
City of Pasco, a municipal corporation of the State of Washington, its
successors and assigns an exclusive public utility easement across, over,
andupon the following land, located in Franklin County, State of Washington,
to wit
A parcel of land 10 0 feet in width having a northerly boundary which
is the southerly right-of-way line of East "B" Street and extending from
the easterly right-of-way line of Road 40 East on the west to the westerly
right-of-way line of the existing Bonneville Power Administration (B P.A )
easement on the east, said parcel being more particularly described as
follows
Beginning at a point lying SO0 °30'15"W a distance of 395.0 feet
and S89 40'35"E a distance of 30.0 feet from the north quarter
corner of Section 34, Township 9 North, Range 30 East of the
Willamette Meridian, said point being the intersection of the
easterly right-of-way of Road 40 East and the southerly right-
of-way of East "B" Street and the True Point of Beginning
of the northerly boundary of the above described parcel of
land, thence, S89 40'35"E along the southerly right-of-way line
of East "B" Street a distance of 1147.7 feet to a point on the
easterly right-of-way of the above described B.P.A easement,
thence S19 25'40"E along said B.P A right-of-way a distance
of 10.63 feet, thence N89 40'35"W a distance of 1151 3 feet
to a point on the easterly right-of-way of Road 40 East; thence
NO0 o 30'15"E along said road right-of-way a distance of 10.0
feet to the point of beginning
Said parcel containing 0.26 acres.
The grantee shall have the right, privilege, and authority to construct,
improve, repair and maintain public utilities on said land This easement
is exclusive in that no other entity may be granted the use of the above
described land for any public utility without the grantee's expressed
written consent.

The grantors shall make no use of the land occupied by said public
utility easement that is inconsistent with or conflicts with the grantee's
use of the land for public utilities.
In exercising the rights herein granted, the grantee, its successors
and assigns, may pass and repass over said land to cut and remove brush,
trees, and other obstructions which in the opinion of the grantee interfere
with the use of the land as a public utility easement and to otherwise use
and occupy the land consistent with its construction, maintenance, and uses
as a public utility easement
The covenants herein contained shall run with the land and are binding
upon all subsequent owners thereof
IN WITNESS WHEREOF, the said grantors have executed this instrument
