RESOLUTION NO. 1445
A RESOLUTION accepting utility easements from Franklin County
Irrigation District.
WHEREAS, the Southeast Pasco Industrial Area Waterline Project,
L.I D. No 114, will install waterlines across private land, and
WHEREAS, the ultimate ownership of the utilities will be with
the City of Pasco, and
WHEREAS, it is necessary that the City of Pasco obtain and maintain
legal easements for the installation, operation and maintenance of the
water utilities across private lands, NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO
The City hereby accepts the attached utility easements from Franklin
County Irrigation District.
BE IT FURTHER RESOLVED that the City Clerk is directed to file
the easement in the legally prescribed manner

For valuable consideration, including benefit to the grantor's
appurtenant land and the benefit of the public interest, the grantor,
FRANKLIN COUNTY IRRIGATION DISTRICT does hereby grant, convey, and
give to the grantee, City of Pasco, a municipal corporation of the
State of Washington, its successors and assigns an exclusive public
utility easement across, over, and upon the following land, located
in Franklin County, State of Washington, to-wit:
A pa/cel of land 20 feet in width lying 10 feet on either
side of the following described centerline:
Beginning at a point on the southerly right-of-way line
of East 'A' Street, said point being SOO 25'47"W a distance
of 30.0 feet and S89 27'25"E a distance of 10 0 feet from
the North Quarter Corner of Section 33, Townsip 9 North,
Pange 30 East of the Willamette Meridian: Thence S00 °25 1 47"W
a distance of 299.46 feet to a point on the southerly
boundary of the North Half of the North Half of the North
Half of the Northeast Quarter of said Section 33, said
point being the Terminus of the above described centerline.
Said parcel containing 0.14 acres. (See Exhibit "A")
The grantee shall have the right, privilege, and authority to con-
struct, improve, repair and maintain Jablic utilities on sai ,1 land.-
This easement is exclusive in that no ,)ther entity may be granted
the use of the above described land for any public utility without
the grantee's expressed written consent.
The grantor shall make no use of the land occupied by said
public utility easement that is inconsistent with or conflicts with
the grantee's use of the land for public utilities.
In exercising the rights herein granted, the grantee, its
successors and assigns, may pass and repass over said land to cut
and remove brush, trees, and other obstructions which in the opinion
of the grantee Interfere with the use of the land as a public utility
easement and to otherwise use and occupy the land consistent with
its construction, maintenance, and uses as a public utility easement.
The covenants herein contained shall run with the land and are
binding upon all subsequent owners hereof.
