HomeMy WebLinkAbout1444 Resolutionider, Mayor ATTEST En 0 Wells, City Clerk RESOLUTION NO 1444 A RESOLUTION accepting utility easements from Tommy's Steel and Salvage, Inc and Four R Development Company WHEREAS, the Southeast Pasco Industrial Area Waterline Pro3ect, L I D No 114, will install waterlines across private land, and WHEREAS, the ultimate ownership of the utilities will be with the City of Pasco, and WHEREAS, it is necessary that the City of Pasco obtain and maintain legal easements for the installation, operation and maintenance of the water utilities across private lands, NOW, THEREFORE, BE IT RESOLVED FY THE CITY COUNCIL OF THE CITY OF PASCO The City hereby accepts the attached utility easements from Tommy's Steel and Salvage, Inc and Fair R Development Company BE IT FURTHER RESOLVED that the City Clerk is directed to file the easement in the legally prescribed manner SSED by the City Council of the City of Pasco this /7 day of , 1981 APPROVED AS TO FORM e.L. Den s De Felice, Acting ity Attorney EASEMENT For valuable consideration, including benefit to the grantors' appurtenant land and the benefit of the public interest, the grantors TOMMY'S STEEL AND SALVAGE, INC. AND FOUR R DEVELOPMENT COMPANY do hereby grant, convey, and give to the grantee, City of Pasco, a municipal corporation of the State of Washington, its successors and assigns an exclusive public utility easement across, over, and upon the following land, located in Franklin County, State of Washington, to-wit: A parcel of land 20 feet in width being 10 feet on either side of the following described centerline: Beginning at a point lying S89 °21'17"E a distance of 2225.75 feet and N19 °25'40"W a distance of 630.34 feet from the center of Section 34, Township 9 North, Range 30 East of the Willamette Meridian; Thence N80 °32'47"E a distance of 242.50 feet to a point on the westerly right-of-way of East 'B' Circle and the Terminus of the above described centerline. Said parcel containing 0.11 acres. The grantee shall have the right, privilege, and authority to con- struct, improve, repair and maintain public utilities on said land. This easement is exclusive in that no other entity may be granted the use of the above described land for any public utility without the grantee's expressed written consent. The grantors shall make no use of the land occupied by said public utility easement that is inconsistent with or conflicts with the grantee's use of the land for public utilities. In exercising the rights herein granted, the grantee, its successors and assigns, may pass and repass over said land to cut and remove brush, trees, and other obstructions which in the opinion of the grantee interfere with the use of the land as a public utility easement and to otherwise use and occupy the land consistent with its construction, maintenance, and uses as a public utility easement. The covenants herein contained shall run with the land and are binding upon all subsequent owners thereof. IN WITNESS WHEREOF, the saidirantors have executed this instrument this f day of , 1981.
