Dennis De Felic , Acting City Attorney - RESOLUTION NO 1443 A RESOLUTION accepting utility easements from Columbia East Partnership WHEREAS, the Southeast Pasco Industrial Area Waterline Project, L.I D. No 114, will install waterlines across 'Private land, and WHEREAS, the ultimate ownership of the utilities will be with the City of Pasco, and WHEREAS, it is necessary that the City of Pasco obtain and maintain legal easements for the installation, operation and maintenance of the water utilities across private lands, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO The city hereby accepts the attached utility easements from Columbia East Partnership BE IT FURTHER RESOLVED that the City Clerk is directed to file the easement in the legally prescribed manner SSED by the City Council of the City of Pasco this //2' 1981. ATT T day o APPROVED AS TO FORM 1 -3), (" EASEMENT For valuable consideration, including benefit to the grantor's appurtenant land and the benefit of the public interest, the grantor COLUMBIA EAST PARTNERSHIP do hereby grant, convey, and give to the grantee, City of Pasco, a municipal corporation of the State of Washington, its successors and assigns an exclusive public utility easement across, over, and upon the following land, located in Franklin County, State of Washington, to-wit. A parcel of land 20 feet in width lying 10 feet on either side of the following described centerline: Beginning at a point on the southerly boundary of the North Half of the North Half of the North Half of the Northeast Quarter of Section 33, Township 9 North, Range 30 East of the Willamette Meridian, said point being S 00 °25 1 47"W a distance of 329.46 feet and S89 28'25"E a distance of 10.0 feet from theNorth Quarter Corner of said Section 33, Thence SOO 25'47"W parallel to the North-South mid- section line of said Section 33 a distance of 1725.18 feet, Thence S89 °15'57"E a distance of 2606.21 feet to a point on tIole easterly line of said Section 33, said point being N00 10'51"W a distance of 580.19 feet from the o common Quarter Corner to Sections 33 and 34, Thence S89 22'03"E across said Section 34 a distance of 2639.80 feet to a point on the wes tterly right-of-way of Road 40 East, said p8int being N00 29'22"E a distance of 580 26 feet and N89 22'03"W a distance of 30.0 feet from the cwnter of said Section 34, said point being the Terminus of the above described centerline. Said parcel containing 3.34 acres. TOGETHER WITH A parcel of land 30 feet in width lying 15 feet on either side of the following described centerline Beginning at a point on the easterly right-of-way of Road 40 East, saig point being N00 29'22"E a distance of 580.26 feet and S89 42'56"E a distance of 30.0 feet from the center of Section 34, Township 9 North o Range 30 East of the Willamette Meridian; Thence S89 42'56"E 8 distance of 1981.02 feet to a point which 18 located S89 21'17"E a distance of 2225.75 feet and N19 25'40W a distance of 630 34 feet from the center of said Section 34 and the Terminus of the above described centerline. Said parcel containing 1.37 acres. The grantee shall have the right, privilege, and authority to con- struct, improve, repair and maintain public utilities on said land. This easement is exclusive in that no other entity may be granted the use of the above described land for any public utility without the grantee's expressed written consent. The grantor shall nake no use of the land occupied by said public utility easement that is inconsistent with or conflicts with the grantee's use of the land for public utilities. In exercising the rights heiein granted, the grantee, its (successors and assigns, may pass and repass over said land to cut and remove brush, trees, and other obstructions which in the opinion of the grantee interfere with the use of the land as a public utility easement and to otherwise use and occupy the land consistent with its construction, maintenance, and uses as a public utility easement. The covenants herein contained shall run with the land and are binding upon all subsequent owners thereof.
