RESOLUTION NO 1442
A RESOLUTION accepting the work performed by L W Vail Company on
Contract No 80-3-06, Court Street Overlay
WHEREAS, the work performed by L W Vail Company under Contract
No 80-3-06, Court Street Overlay, has been examined by the City Engineer,
and the City Engineer has fouhd that all work required by the contract has
been performed and completed in basic conformance with the applicable project
specifications and drawings, with the exception that surface texture is less
than desirable, and
WHEREAS, it is the City Engineer's recommendation that the City of
Pasco formally accept the contractor's work and the project as complete with
a 10% price reduction due to the surface texture, NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO
That the City Council concurs with the City Engineer's recommendation
and hereby accepts the work oerformed by L W. Vail Company, on Contract No
80-3-06, Court Street Overlay, as being completed in basic conformance with
the project specifications and drawings, and
Be it further resolved that the City Clerk is hereby directed to
notify the Washington State Departments of Revenue, and Labor and Industries
of this acceptance, and
Be it further resolved that the retainage amount being withheld
pursuant to applicable laws, regulations and administrative determinations
shall be retained by the City of Pasco as settlement of the deficient surface
texture in the amount of 10% of the contract document, as recommended by the
City Engineer.
