RESOLUTION NO 1422
WHEREAS, the Pasco School District is desirous to build a temporary
portable building on school ground property, and
WHEREAS, City of Pasco has an existing water line burled underground
in the location that the portable building is proposed to be built, and
WHEREAS, both the City of Pasco and Pasco School District is desirous
to serve the public interest in the most economic fashion, NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO
Section 1 That the City of Pasco does hereby grant permission to the
school district to build their temporary portable building over the easement
and water line that now exist subject to the conditions contained in the attached
agreement which by intent and letter hold the City harmless from any liability
resultant from breakage of the water line under that building whether such breakage
be a consequence of the building or any other cause of failure

HOLD HARMLESS AND INDEMNIFICATION AGREEMENT
PASCO SCHOOL DISTRICT, a municipal corporation of the
State of Washington, hereby agrees to hold harmless and indemnify
the CITY OF PASCO, a municipal corporation of the State of
Washington, from any and all claims arising out of the breakage
or leakage, from whatever cause, of that certain 12" water main
which is buried on School District property which is the site
of the present Administration Building, but only for such
distance as the 12" water main is located under a portable
office annex to the Administration Building and only for such
time as the portable office annex shall remain located in the
area marked on Exhibit A attached hereto and incorporated by
reference.
The School District further agrees to hold harmless
and indemnify the City of Pasco from any and all damages, claims,
or causes of action, arising out of breakage or leakage of that
certain 12" water main above referenced in the event such
breakage or leakage is caused by or the result of the construction,
placement, or removal of the above referenced portable office
annex or any activity associated therewith.
THIS AGREEMENT is made in consideration of the City of crD
