A RESOLUTION providing for the method of payment of the assessments
made in Ordinance No. 2225 for sidewalk, curb, and
gutter construction on both sides of Sylvester Street
west from 20th Avenue to Road 28 and setting the number
of installments, the interest on unpaid installments,
and the interest on delinquent payments.
WHEREAS, the City Council approved and confirmed the assessment,
and the assessment roll for the construction of sidewalk, curb, and
gutter on Sylvester Street west from 20th Avenue to Road 28 by
Ordinance No. 2225 ; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO AS
FOLLOWS:
Section 1. The assessment roll as approved and confirmed shall
be filed with the City Treasurer for collection and the City
Treasurer is hereby authorized and directed to publish notice once
each week for two consecutive weeks and as further required by law
by stating that the roll is in her hands for collection and that
payments of any assessment thereon or any portion of such assessment
can be made at any time within thirty (30) days from date of first
publication of such notice without penalty, Interest or cost, and
thereafter the sum remaining unpaid may be paid in ten (10) equal
annual installments with interest thereon fixed at the rate of eight
(8%) percent per annum. The first installment of assessments on the
assessment roll shall become due and payable during the thirty (30)
day period succeeding the date one year after the date of first
publication by the City Treasurer of notice that the assessment roll
is in her hands for collection and annually thereafter each succeeding
installment shall become due and payable in a like manner. If the
whole or any portion of the assessment remains unpaid after the first
thirty (30) day period, interest upon the whole unpaid sum shall be
charged at the rate of eight (8%) percent per annum, and each year
thereafter one of the Installments, together with Interest due on the
unpaid balance, shall be collected. Any installment not paid prior to
expiration of the thirty (30) day period during which such installment
is due and payable shall thereon become delinquent. All delinquent
installments shall be subject to a charge for interest at the rate of
eight (8%) percent as determined above and for an additional charge of
twelve (12%) percent penalty levied upon both principal and Interest
due upon such installment or installments. The collection of such
delinquent installments with interest and penalties shall be enforced
in the manner provided by law.
Within fifteen (15) days of the first newspaper publication, the
City Treasurer shall notify each owner or reputed owner whose name
appears on the assessment roll, at the address shown on the tax rolls
of the County Treasurer for each item of property described on the
list, of the nature of the assessment, of the amount of his real
property subject to such assessment, of the time during which such
assessment may be paid without penalty, interest, or cost, and the
amount of the Interest and penalty as set forth herein.

Section 2. The City Treasurer shall deposit all payments
received to "Sidewalk Construction Fund, Number 1, 1979," which
fund was established for this purpose by Ordinance No. 2103.
