RESOLUTION NO 1382
A RESOLUTION accepting the Conveyance of Public Right-of-Way
WHEREAS, the City of Pasco is desirous of obtaining right-of-way
for a total width of 80-feet along Court Street, and
WHEREAS, it is in the interest of the property owner, Sage Court
Investors, for the development of their property on the southeast corner of
Road 34 and Court Street to dedicate an additional 4-feet to the City
of Pasco, and
WHEREAS, the property owner has developed the southern portion of
Court Street along his frontage to the City of Pasco's standards, NOW,
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO
Hereby accepts the conveyance of public right-of-way providing for an
additional 4-feet of right-of-way on Court Street as described in the accompanying
conveyance of public right-of-way, and wishes to express their appreciation to
Sage Court Investors represented by Mr Bill Richmond for this conveyance of
public right-of-way

CONVEYANCE OF PUBLIC RIGHT-OF-WAY
For valuable consideration consisting of
, receipt of which is hereby acknowledged,
the grantor, Bill Richmond (Sage Court Investors)
hereby grants and conveys to the grantee, City of Pasco, a municipal
corporation of the State of Washington located in Franklin County, its
successors and assigns, the right-of-way, including the privilege to
construct, maintain, repair, and maintain a roadway, utilities, and
appurtenances thereto, and such other rights associated with the public
right-of-way, over and upon the following land, located in Franklin
County, State of Washington, to-wit
Starting at the northeast corner of the west 264 feet of the north 330 feet
of the northeast quarter of the northwest quarter of the northwest quarter
Section 25, T9N, R29, EM, thence southerly a distance of 36' feet to the
north east property corner which is the true point of beginning; thence westerly
along the existing property line a distance of 234' feet; thence southerly along
the west property line a distance of 24' feet; thence northeasterly along a curve
with a radis of 20' a distance of 31.42' feet; thence easterly along a line 4'
feet south of and parallel to the existing north property line a distance of
214' feet; thence northerly a distance of 4' to the true point of beginning.
The grantor shall make no use of the land inconsistent with the
grantee's use of it as a public right-of-way.
In exercising the rights herein granted, the grantee and its
successors and assigns, may pass and repass over said land to cut and
remove brush, trees and other obstructions which in the opinion of the
grantee interfere with the use of the land as a public right-of-way and
to otherwise use and occupy the land consistent with its construction,
maintenance, and uses as a public right-of-way.
The covenants herein contained shall run with the land and are
binding upon all subsequent owners thereof.
