RESOLUTION NO. 1372
A RESOLUTION establishing a City policy for the acquisition and/or
dedication of rights-of-way for City streets
WHEREAS, adequate public rights-of-way are necessary to serve the public
interest in terms of health, safety, and convenience; and
WHEREAS, it is the intention of the City of Pasco to have a consistent policy
relating to the acquisition and/or dedication of rights-of-way, NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO as follows
Section 1. It shall be the policy of the City of Pasco to apply the following
standards for rights-of-way in developed areas.
(1) Local Access Streets. Since the primary purpose of this classification of
street is to specifically benefit the abutting property owners, and the property owners in
the general area of the neighborhood being served by the local access street, the policy
of the City shall be that these rights-of-way, where required by the City, shall be
dedicated by the affected property owners at no cost to the City.
(2) Arterial Streets. The primary purpose of this arterialclassification of street
is to serve the basic convenience of the general motoring public at large, however, in
many cases, there is a clearly identifiable concommitant benefit to the abutting property.
In recognition of these cases, where compensation by the City is contemplated for rights-
of-way for an arterial street improvement, this compensation by the City shall represent
the net difference between the appraised or negotiated value of the rights-of-way being
acquired and the estimated special benefit to the abutting property which will benefit
from the proposed arterial improvement.
Section 2. The following City policy shall apply with respect to rights-of-way in
new developments
(1) City approval of sub-division plats, short plats, or building permit
applications, will not be given until sufficient and appropriate rights-of-way consistent
with current City standards, are dedicated for the required local access streets and the
required essential arterial streets which are deemed necessary by the City for the
proper circulation of traffic, not only for that traffic in the vicinity of the development,
but also for traffic originating from the City at large.
