HomeMy WebLinkAbout3325 OrdinanceORDINANCE NO AN ORDINANCE amending PMC 5 04 160 in regards to Rental Dwelling Unit Business License Fees WHEREAS, Washington legislature has by RCW 59 18 115 found that some residential tenants live in residences that are sub- standard and dangerous to their health and safety for which the remedies under the Landlord Tenant Act may not provide a n adequate remedy and has authorized local governments to provide a means of inspection of residential rental units to assist in alleviating sub-standard and dangerous conditions WHEREAS, the City of Pasco has by the issuance of business license the capacity to regulate business activities to encourage safe operation of all residential rental properties, and WHEREAS, the license fees now charged for this business license are insufficient to pay for the cost of issuance of the license and the administration of Chapter 5 78 of this title, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON 130 ORDAIN AS FOLLOWS Section 1 That Sub-Section (a) entitled "Rentals Dwelling Units" of PMC Section 5 04 160 "Fees" is hereby amended and shall read as follows 5 04 160 FEES (a) RENTALS - DWELLING UNITS Any person renting or making available for rent to the public any dwelling unit shall secure a license registering each dwelling unit including a certification warranting that each such dwelling unit complies with the Uniform Housing Code as adopted by the City and does not present conditions that endanger or impair the health or safety of the tenants For the purpose of this section "dwelling unit" shall mean any structure or part of a structure which is used as a home, residence or sleeping place by one, two or more persons maintaining a common household, including but not limited to single family residences and units of multiplexes, apartment buildings and mobile homes The annual business license fee shall be $15 00 $30 00 for each independent business location and the first unit and $3 00 for each additional rental dwelling unit available for rental to the public by the applicant All revenues received from this business license fee shall be utilized exclusively for the cost of issuance of the license provided herein and the administration of Chapter 5 78 of this title Issuance of the business license shall be contingent upon submission of the certification, inspection, as required by this title, payment of the fee provided above and compliance with Chapter 5 78 of this title Section 2 If any provision of this ordinance is declared unconstitutional, or the applicability thereof to any person or circumstances is held invalid, the constitutionality of the remainder of this ordinance and the applicability thereof to persons and circumstances shall not be affected thereby Section 3 This ordinance shall take full force and effect on January 1, 1999 PASSED by the City Council of Pasco, Washington this 7 4. day of December, 1998 () Charles D Kilbury Mayor ATTEST Catherine D Seaman Deputy City Clerk APPROVED AS TO FORM Leland B Kerr City Attorney SUBSCRIBED ND SWORN BEFORE ME THIS DAY OF Notary public in and for the State of Wash- ington, residing at F, ch land COMMISSION EXPIRES (-)8 ' 'A P 0 BOX 2608 -------- PASCO, WASHINGTON 99302-2608 PHONE (509) 582 1500 ADVE271101102 INVOICE DATE 2 / 1 -0 / 1 742 LEGAL NO 41. 7 7 ACCOUNT NO 1 =ii3 (2 DESCRIPTION #1 ?.:7 OFD. 7:2.5 RENTAL DW TIMES LINES 1 - 75 SOLD TO PASCO CIIY OF LEGAL5 P.O.
