HomeMy WebLinkAbout3281 Ordinance1--(3,14 ORDINANCE NO. (-- / AN ORDINANCE of the City of Pasco, Washington regulating the possession of wild animals. THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1, A new Section shall be added to Section 8 04 "Animals" entitled 8 04 010(v) and shall read as follows. 8.04.010(v) "Wild Animal" means: (1) Non-human primate; (2) Wild cat mcluchng any lion, tiger, cougar, mountain lion, lynx or bobcat, (3) Bear; (4) Wolf; coyote, fox or its hybrid, except for the domestic dog, (5) Venomous reptile or amphibian, (6) Reticulated python, Burmese python or any other snake which may reach ten feet or more in length, (7) Alligator, Crocodile or Callum, or (8) Any other animal which is capable of killing or seriously injuring a human bemg Section 2. That Section 8.04 360 entitled "Penalty Provisions" shall be and hereby is amended to include a violation of PMC 8 04 021 for enhanced penalties and shall read as follows 8.04.360 Penalty Provisions. (A) Any person found to be in violation of any provision of this chapter, except as provided below (and in 8.04 060) shall be deemed to have committed a civil infraction and for each violation shall be subject to a civil penalty in the amount listed, plus court costs and statutory assessments (1) First violation within five-year period $30 00 (2) Second violation within five-year period $50.00; (3) Third violation within five-year period $75 00; (4) Violations in excess of third within five-year period $100.00; (B) A violation of Sections 8.04 020, 8 04.130, 8 04 170 and 8 04.320 shall constitute an offense pumshable by a fine of not less than one hundred fifty dollars, no amount of which is to be suspended or deferred, and not more than one thousand dollars and/or a jail term not to exceed one year. Wild/Exotic Animal Ordinance - Page 1 of 2 e I .41, ;.- (C) Each day that a violation continues shall be deemed a separate violation subject to the maximum civil or criminal penalty, as the case may be, as set forth m subsections (a) and (b) of this section. (D) Court costs of ten dollars shall be assessed in addition to any other fine, penalty, cost or statutory assessment imposed.
