ORDINANCE NO 3 -/ 9
AN ORDINANCE of the City of Pasco, Washington, relating to Utility
Local Improvement District No 131, amending Ordinance No 3216, as amended,
and Ordinance No 3239, by adding additional territory to Utihty Local
Improvement District No 131 of the City and providing additional sewer
improvements to serve the additional terntory, and approvmg and confirming the
fmal assessments and assessment roll of Utility Local Improvement District
No 131
WHEREAS, pursuant to Resolution No 2356, the City Council declared its mtention to
amend Ordinance No 3216, as amended, and Ordmance No 3239, by adding additional terntory to
Utility Local Improvement District (" ULID " ) No 131 and by p rovidmg addit ional improvements to
serve that additional terntory, and the City gave due notice of a heanng on such amendment to be
held on January 20, 1998, at 7 00 p m local time at the Council Chambers at City Hall, and
WHEREAS, the assessment roll levying the special assessments against the property
located m ULID No 131 in the City of Pasco, Washington (the "City"), has been filed with the City
Clerk as provided by law, and
WHEREAS, notice of the time and place of hearing thereon and making objections and
protests to the roll was published at and for the time and in the manner provided by law fixing the
time and p lace of healing thereon for the 20th day of January, 1998, at the hour of
7 00 p m, local time, in the Council Chambers m the Pasco City Hall, 525 N 3rd Avenue, Pasco,
Washington, and further notice thereof was mailed by the City Cleik to each property owner shown
on the roll, and

WHEREAS, at the time and place fixed and designated in the notice the heanngs were held,
all written protests received were considered and all persons appearing at the hearing who wished to
be heard were heard, and the City Council, sitting and acting as a Board of Equalization for the
purpose of considermg the roll and the special benefits to be received by each lot, parcel and tract of
land shown upon such roll, including the increase and enhancement of the fair market value of each
such parcel of land by reason of the improvement, overruled all such protests and increased certain
assessments for work added as requested m writing by certain property owners, as the City
Council, also overruled any protests to such amendments to Ordinance No 3216, as amended, and
Ordinance No 3239, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN as
follows
Section 1 Section 1 of Ordinance 3216, as amended by Ordinance No 3224, is amended to
read as follows
Section 1 The City Council of the City of Pasco, Washington (the "City"), orders the
improvement of the Riverview area, both within and outside the City, by the construction of
sanitary sewerlmes, sewer stubs, street overlay and other related work located as described on
revised Exhibit B-2 attached hereto and by this reference made a part hereof
All of the foregoing shall be in accordance with the plans and specifications therefor
prepared by the City Engineer, and may be modified by the City Council as long as such
modification does not affect the purpose of the improvement
Section 2 Section 2 of Ordinance 3216, as amended by Ordinance No 3224, is amended to

read as follows
Section 2 There is created and established a local improvement district to be called Local
Improvement District No 131 of the City of Pasco, Washington (the "District"), the boundaries or
territorial extent of the District being the perimeter of this property more particularly described in
revised Exhibit A-2 attached hereto and by this reference made a part hereof
Section 3 Section 3 of Ordinance No 3239 is amended to read as follows
Section 3 Conversion to Utihty Local Improvement Districts To carry out the
Improvements the City Council converts Local Improvement District No 130 to Utihty Local
Improvement District No 130 ("ULID No 130") as described in Exhibit A-1 hereto and converts
Local Improvement District No 131 to Utility Local Improvement District No 131 ("ULID No
131") as described m Exhibit A-2 hereto The City Council further specifies and adopts the
Improvements ordered to be caned out within Local Improvement District No 130 and Local
Improvement District No 131, as more particularly described on Exhibits B-1 and B-2 hereto,
respectively
Section 4 Section 4 of Ordinance No 3239 is amended to read as follows
Section 4 The estimated cost and expense of the Improvements described in Exhibit B-1 are
declared to be, as near as may be $742,500, all of which, less applicable grants received by the City
therefor and other money deternuned by the City Council to be expended thereon, shall be paid by
special assessments levied against the property within ULID No 130
The estimated cost and expense of the Improvements described in Exhibit B-2 are declared

to be, as near as may be $1,595,450, all of which, less applicable grants received by the City therefor
and other money determmed by the City Council to be expended thereon, shall be paid by special
assessments levied against the property within ULID No 131
The City may use any method or combination of methods to compute assessments which
may be deemed to reflect more fairly the special benefits to the properties being assessed than the
method set forth in statutes
Section 5 Section 5 of Ordinance No 3239 is amended to read as follows
Section 5 The cost of early mg out the Improvement shall be met and defrayed from the
proceeds received from the issuance and sale of one or more series of water and sewer revenue bonds
in the total approximate amount of $2,337,950, the issuance of which are authorized, from the
receipt or grants and from other money legally made available therefor
The specific form, terms, mterest rates, covenants, manner of sale and other details of the
bonds herein authorized to be issued shall be provided hereafter by the City Council Such bonds
may be combined with other authorized bonds for the purpose of issuance
Section 6 The assessments and assessment roll of Utility Local Improvement District
No 131, which has been created and established for the purpose of amending Ordinance No 3216,
as amended by Ordinance Nos 3224 and this ordinance, converted to a Utihty Local Improvement
District by Ordinance No 3239, as amended by this ordinance, as the same now stand shall be and
the same are approved and confirmed in all things and respects in the total amount of
$ 1,445,817 59
Section 7 Each of the lots, tracts, parcels of land and other property shown upon the

assessment roll is determmed and declared to be specially benefited by this improvement in at least
the amount charged against the same, and the assessment appearing against the same is m proportion
to the several assessments appearing upon the rolL There is levied and assessed against each lot,
tract or parcel of land and other property app earmg up on the roll the amount finally charged against
the same thereon
Section 8 The assessment roll as approved and confirmed shall be filed with the City Clerk
for collection and the City Clerk is authorized and directed to publish notice as required by law
stating that the roll is in his hands for collection and that payment of any assessment thereon or any
portion of such assessment can be made at any time within 30 days from the date of first
publication of such notice without penalty, interest or cost, and that thereafter the sum remaining
unpaid may be paid in 15 equal annual principal installments The estimated mterest rate is stated
to be 6 5% per annum, with the exact mterest rate to be fixed m the ordinance authorizing the
issuance and sale of the local improvement bonds for Utility Local Improvement District No 131
The first installment of assessments on the assessment roll shall become due and pay able during the
30-day period succeeding the date one year after the date of first publication by the City Clerk of
notice that the assessment roll is in his hands for collection and annually thereafter each succeedmg
installment shall become due and payable in like manner If the whole or any portion of the
assessment remains unpaid after the first 30-day period, interest upon the whole unpaid sum shall
be charged at the rate as determmed above, and each year thereafter one of the installments of
principal together with mterest due on the unpaid balance, shall be collected Any installment not
paid prior to expiration of the 30-day period during which such installment is due and pay able shall

thereupon become delinquent Each delinquent installment shall be subject, at the time of
delinquency, to a charge of 6 0% penalty levied on both pnncipal and interest due upon that
installment, and all delinquent installments also shall be charged interest at the rate as determined
above The collection of such delinquent installments shall be enforced m the manner provided by
law
