HomeMy WebLinkAbout3242 OrdinanceORDINANCE NO.3 AL\ AN ORDINANCE relating to land use and zoning amending Titles 17 and 22 dealing with placement of off-premise signs on public property WHEREAS, cities have the responsibility to regulate and control the physical development within their borders and insure the public health, safety and welfare are maintained, and, WHEREAS, the City of Pasco has zoning regulations that encourage orderly growth and development of the city, and, WHEREAS, publicly owned properties are unique in that development of such most often requires a special permit hearing, and, WHEREAS, publicly owned properties are unique in that they may be located in a variety of zoning district including residential, and, WHEREAS, the City Council has reviewed the Planning Commission's recommendations, and has determined that to further the purposes of comprehensive planning and to maintain and protect the welfare of the community, it is necessary to amend PMC Title 17 and Title 22, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DOES ORDAIN AS FOLLOWS: Section 1. That section 17 46 020 of the Pasco Municipal Code is hereby amended to read as follows 17 46 020 OFF-PREMISE SIGN CORRIDOR All off-premise signs, except as provided in 17 46 030 shall be within a corridor located along State Highways 12 and 395 and Interstate Highway 182 The corridor shall include only the land area within 2,000 feet of the rights-of-way lines of said highways Section 2. That section 17 46 030 of the Pasco Municipal Code is hereby amended to read as follows 17 46 030 ZONING Off-premise signs shall only be allowed within the off-premise sign corridor on lands zoned C-3 (General Business), I-1 (Light Industnal)i an-El 1-2 (Heavy Medium Industrial) and I- 3 (Heavy Industrialj except that off-premise signs may be permitted by A , Special Permit on properties owned or controlled by the City of Pasco, Pasco School District, Franklin County or the Port of Pasco where it can be demonstrated there is clear public benefit Section 3. That section 17 56 045 of the Pasco Municipal Code is hereby amended to read as follows 17 56 045 ZONE RT RESIDENTIAL TRANSISTION DISTRICT No sign shall be permitted in the RT Zone except (a) Temporary signs for the sale of real property on which the sign is posted, which signs shall contain no more than six square feet in area and which shall be limited to one sign per parcel of property (b) Signs permitted by Special Permit as identified in P M C 22 80 020 (16) except Off Premise signs as defined in P M C 17 08 125 shall be prohibited Section 4. That section 22 22 040 of the Pasco Municipal Code is hereby amended to read as follows 22 22 040 PERMITTED CONDITIONAL USES The following uses are permitted upon issuance of a special permit (1) Outdoor recreational activities (2) Signs, as identified in P M C 22 80 020 (16) excluding off premise signs as defined in P M C 17 08 125 Section 5. That section 22 80 020 of the Pasco Municipal Code is hereby amended to read as follows 22 80 020 UNCLASSIFIED USES The following uses shall be considered unclassified (1) High schools, colleges, universities, vocational schools, business colleges and other similar academic or skills training facilities or institutions not heretofore permitted within any district, (2) Cemeteries, crematories, mausoleums, and other places of burial or internment of remains, (3) Community service facilities, as defined in Section 22 12 215, (4) Correctional institutions, juvenile delinquency homes and facilities, and other similar facilities for incarceration or detainment, (5) Airports, heliports or any other landing or maneuvering space for aircraft, together with terminals and other customary facilities accessory to the unclassified use, (6) Group homes, as defined in Section 22 12 387, (7) Group care facilities, as defined in Section 22 12 385, (8) Golf courses, pitch and putt courses, miniature golf courses, and similar facilities for public, private or membership use, (9) Monasteries, convents or other functionally similar facilities, 2 C arles D Kilbury Mayor (10) Mines, quarries and gravel pits, (11) Landfills, garbage dumps, and resource recovery facilities, (12) Off-site parking lots, except those required for a residential use, provided such parking area is not more than five hundred feet from the building, (13) Electrical substations and load transfer stations, (14) Park and ride lots, off-street transfer stations or other similar facility involving storage, start-up, idling and movement of public or private operated carrier, charter or transit buses, vans, and similar vehicles, (15) Agricultural uses (commercial) except in areas 1,000 feet from a residential subdivision or dwelling unit, L16) Off-Premise signs on properties owned or controlled by the City of Pasco, Pasco School District, Franklin County or the Port of Pasco where it can be demonstrated there is clear public benefit Section 6.
