ORDINANCE NO L3a5C\
AN ORDINANCE relating to the waterworks utility of the City, including
the sanitary sewerage system and the system of storm or surface water sewers as
a part thereof, specifying and adopting a system or plan for the Waterworks
Utility, converting Local Improvement District No 130 and Local Improvement
District No 131 of the City to utility local improvement districts and authorizing
water and sewer revenue bonds and interim financing to pay the cost of carrying
out the improvements in those districts
WHEREAS, the City of Pasco, Washington (the "City"), by Ordinance No 531, passed
March 7, 1944, provided that the system of sewerage of the City, including all additions,
extensions and betterments thereto, should be operated as a part of and as belonging to the
waterworks utility of the City pursuant to the provisions of Chapter 193 of the Laws of 1941 of
the State of Washington (RCW 35 67 320 et seq ) (the "Waterworks Utility"), and
WHEREAS, by Ordinance No 3104, passed on August 21, 1995, the City Council
adopted the City of Pasco Comprehensive Plan 1995-2015, including as a part thereof the City
of Pasco Comprehensive Sewer Plan, November 1992 (the "Comprehensive Sewer Plan"), and
WHEREAS, the Comprehensive Sewer Plan provides for the extension of the City's
sewer collection system to provide sewer services to the area outside of the City's corporate
boundaries known as the Riverview Area, and
WHEREAS, by Ordinance No 3175 passed by the City Council and approved by the
Mayor on October 7, 1996, the City ordered the extension and improvement of a portion of the
sewer collection system of the City to the portion of the Riverview Area legally described in
Exhibit A-1 hereto by the construction of sewer lines, sewer stubs, a street overlay and all other
work necessary for or incidental to the provision of sewer service to that area, as such

improvements are more particularly described in Exhibit B-1 hereto, all pursuant to Resolution
No 2266 adopted September 3, 1996, and, after a public hearing thereon, established Local
Improvement District No 130, provided that payment for the improvement be made by special
assessments upon the property in the District, and
WHEREAS, by Ordinance No 3216 passed by the City Council and approved by the
Mayor on February 3, 1997, as amended, the City ordered the extension and improvement of
a portion of the sewer collection system of the City to the portion of the Riverview Area legally
described in Exhibit A-2 hereto by the construction of sewer lines, sewer stubs, a street overlay
and all other work necessary for or incidental to the provision of sewer service to that area, as
such improvements are more particularly described on Exhibit B-2 hereto, all pursuant to
Resolution No 2289 adopted January 6, 1997, and, after a public hearing thereon, established
Local Improvement District No 131, provided that payment for the improvement be made by
special assessments upon the property in the District, and
WHEREAS, to facilitate the financing of the extension of sewer service to the Riverview
Area through the issuance of water and sewer revenue bonds as contemplated by the Sewer
Comprehensive Plan, the City Council has determined it to be in the best interests of the City
that the improvements ordered to be carried out by Ordinance No 3175 and Ordinance No
3216, as amended, (the "Improvements") constitute part of the improvements described in the
Comprehensive Sewer Plan and that Local Improvement District No 130 and Local
Improvement District No 131 be converted to utility local improvement districts, NOW,
THEREFORE,

THE CITY COUNCIL OF PASCO, WASHINGTON, DO ORDAIN as follows
Section 1 Definitions As used in this ordinance the following words shall have the
following meanings
"City" means the City of Pasco, Washington
"Storm Drainage System" means the storm drainage and surface water sewer system of
the City described as a storm drainage utility in Ordinances Nos 1374, 1375 and 1574 of the
City, which is a part of and belonging to the Waterworks Utility
"Waterworks Utility" of the City means the combined waterworks system of the City and
the system of sewerage of the City, including the Storm Drainage System, and all additions
thereto and betterments and extensions thereof at any time made, including any other utility that
may in the future be combined with the Waterworks Utility
Section 2 The Comprehensive Sewer Plan is specified and adopted as the system
or plan relating to sewers for the Waterworks Utility The estimated cost, as near as may be,
of that system or plan is $79,125,000
Section 3 Conversion to Utility Local Improvement Districts To carry out the
Improvements the City Council converts Local Improvement District No 130 to Utility Local
Improvement District No 130 ("ULID No 130") as described in Exhibit A-1 hereto and
converts Local Improvement District No 131 to Utility Local Improvement District No 131
("ULID No 131") as described in Exhibit A-2 hereto The City Council further specifies and
adopts the Improvements ordered to be carried out within Local Improvement District No 130
and Local Improvement District No 131, as more particularly described on Exhibits B-1 and
B-2 hereto, respectively

Section 4 The estimated cost and expense of the Improvements described in Exhibit B-1
are declared to be, as near as may be $742,500, all of which, less applicable grants received by
the City therefor and other money determined by the City Council to be expended thereon, shall
be paid by special assessments levied against the property within ULID No 130
The estimated cost and expense of the Improvements described in Exhibit B-2 are
declared to be, as near as may be $1,548,200, all of which, less applicable grants received by
the City therefor and other money determined by the City Council to be expended thereon, shall
be paid by special assessments levied against the property within ULID No 131
The City may use any method or combination of methods to compute assessments which
may be deemed to reflect more fairly the special benefits to the properties being assessed than
the method set forth in statutes
Section 5 The cost of carrying out the Improvement shall be met and defrayed from the
proceeds received from the issuance and sale of one or more series of water and sewer revenue
bonds in the total approximate amount of $2,290,700, the issuance of which are authorized, from
the receipt or grants and from other money legally made available therefor
The specific form, terms, interest rates, covenants, manner of sale and other details of
the bonds herein authorized to be issued shall be provided hereafter by the City Council Such
bonds may be combined with other authorized bonds for the purpose of issuance
Section 6 The gross revenues of the Waterworks Utility are pledged to the payment of
the principal of and interest on the bonds herein authorized to be issued under such terms and
conditions and having such charge on lien on the revenues of the Waterworks Utility as the City
Council shall by ordinance hereafter prescribe

Section 7 The gross revenues and benefits to be derived from the operation and
maintenance of the Waterworks Utility outstanding utility local improvement district assessments
and the additions thereto and extensions and betterments thereof herein provided at the rates to
be charged for utility services furnished, in the judgement of the City Council, will be more than
sufficient to meet all expenses of operation and maintenance thereof, debt service on outstanding
Waterworks Utility obligations and to permit the setting aside into a special fund, out of the
gross revenues of the Waterworks Utility in addition to the special assessments to be levied and
collected in the utility local improvement districts herein created, of sufficient amounts to
support the payment of the bonds herein authorized to be issued and to pay the interest on the
bonds herein authorized to be issued
Section 8 The proceeds from the sale of the bonds herein authorized to be issued shall
be used for the sole purpose of paying the costs of carrying out the Improvements described in
Section 3 and of paying the cost of issuance of such bonds, and the City, through its proper
officials and agents, shall proceed with the making of those Improvements To the extent that
such officials and agents have heretofore taken any action or let any contracts to proceed with
such improvement or acquisition, such action and contracts are ratified and approved
Section 9 The Director of Finance and Budget is authorized and directed to create and
establish in his office for the District special funds to be known and designated as "Construction
Fund - ULID No 130 and 131" (the "Construction Fund") for the sole purpose of carrying out
the Improvements and of paying the costs and expenses connected therewith There shall be
deposited into the Construction Fund the principal proceeds of the bonds herein authorized to
be issued to pay part of the costs of the Improvements, grants received for such purpose and any
and all other money received by or available to the City to be used for such purposes

Pending the issuance and delivery of such bonds to the purchaser thereof, the deposit of
the principal proceeds thereof, grants or other money into the Construction Fund, warrants may
be issued and drawn upon the Construction Fund for payment of duly authorized and proper
costs and expenses and the repayment of loans chargeable to that fund, which warrants shall be
presented to the City Director of Finance and Budget, marked "not paid for want of funds," and
shall bear interest at such rate as shall hereafter be determined by the City Council from the date
of presentment until the date called for payment Such warrants shall be paid in full from the
first money deposited in the Construction Fund available for such purpose In lieu of such
warrants, the Board may authorize by ordinance the issuance of short-term obligations pursuant
to Chapter 39 50 RCW
Money in the Construction Fund shall be invested until needed in any investments
permitted to the City by law, but in no event shall any investment be made in any obligation
maturing later than one year after the investment therein or later than such money is needed for
the purpose of the Construction Fund, whichever is the lesser time, nor shall any investments
exceed the applicable yield limitations imposed by Section 148 of the Internal Revenue Code of
1986, as amended, and applicable regulations thereunder relating to arbitrage Income from
such investments shall be deposited in the Construction Fund
Section 10 Effective Date of Ordinance This ordinance shall take effect and be in
force from and after its passage and five days following its publication as required by law
