ORDINANCE NO 3a9
AN ORDINANCE amending Ordinance No 3216 ordering the
construction of sanitary sewerlines, sewer stubs, street overlay and other work in
the Riverview area all in accordance with Resolution No 2289, reducing the size
of Local Improvement District No 131
WHEREAS, on February 3, 1997, the City Council conducted a hearing on a proposed
improvement and the formation of Local Improvement District No 131 located in the Riverview
area, heard objections to the inclusion of certain property within - the proposed Local
Improvement District, and passed Ordinance No 3216 ordering the construction of sanitary
sewerlmes, sewer stubs, street overlay and other work in the Riverview area and establishing
Local Improvement District No 131 having three non-contiguous units, and
WHEREAS, following the 30-day period after the passage of Ordinance No 3216, the
City has determmed that it has received written objections to the improvement and the formation
of Local Improvement District No 131 from owners of property representing at least 60% of
all the estimated assessments in a non-contiguous portion of the Local Improvement District, and
therefore, under RCW 35 43 180, that area is automatically excluded from the Local
Improvement District, and
WHEREAS, it is necessary to amend Ordinance No 3216 to reduce the improvement,
the estimated cost thereof, and the territorial extent of the improvement, NOW, THEREFORE,

THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN as
follows
Section 1 Section 1 of Ordinance 3216 is amended to read as follows
Section 1 The City Council of the City of Pasco, Washington (the
"City"), orders the improvement of the Riverview area, both within and outside
the City, by the construction of sanitary sewerlmes, sewer stubs, street overlay
and other related work located as described on revised Exhibit A attached hereto
and by this reference made a part hereof
All of the foregoing shall be in accordance with the plans and
specifications therefor prepared by the City Engineer, and may be modified by
the City Council as long as such modification does not affect the purpose of the
improvement
Section 2 Section 2 of Ordinance 3216 is amended to read as follows
Section 2 There is created and established a local improvement district
to be called Local Improvement District No 131 of the City of Pasco,
Washington (the "District"), the boundaries or territorial extent of the District
being the perimeter of this property more particularly described in revised Exhibit
B attached hereto and by this reference made a part hereof
Section 3 Section 3 of Ordinance 3216 is amended to read as follows
Section 3 The total estimated cost and expense of the improvement is
declared to be $1,548,200 The entire cost and expense shall be borne by and
assessed against the property specially benefited by such improvement included

in the District which embraces as nearly as practicable all property specially
benefited by such improvement
Section 4 Section 6 of Ordinance 3216 is amended to read as follows
Section 6 Local improvement district warrants may be issued in payment
of the cost and expense of the improvement herein ordered to be assessed, such
warrants to be paid out of the Local Improvement Fund, District No 131,
hereinafter created and referred to as the Local Improvement Fund, and, until the
bonds referred to in this section are issued and delivered to the purchaser thereof,
to bear interest from the date thereof at a rate to be established hereafter by the
City Finance and Budget Director, as issuing officer, and to be redeemed in cash
and/or by local improvement district bonds herein authorized to be issued, such
interest-bearing warrants to be hereafter referred to as "revenue warrants " In the
alternative, the City hereafter may provide by ordinance for the issuance of other
short-term obligations pursuant to chapter 39 50 RCW
If the City shall authorize expenditures to be made for such improvement
(other than for any cost or expense expected to be borne by the City) prior to the
date that any short-term obligations or local improvement district bonds are issued
to finance the improvement, from proceeds of interfund loans or other funds that
are not, and are not reasonably expected to be, reserved, allocated on a long-term
basis or otherwise set aside to pay the cost of the improvement herein ordered to
be assessed against the property specially benefited thereby, the City declares its
official intent that those expenditures, to the extent not reimbursed with prepaid

special benefit assessments, are to be reimbursed from proceeds of short-term
obligations or local improvement district bonds that are expected to be issued for
the improvement in a principal amount not exceeding $1,548,200
The City is authorized to issue local improvement district bonds for the
District which shall bear interest at a rate and be payable on or before a date to
be hereafter fixed by ordinance The bonds shall be issued in exchange for
and/or in redemption of any and all revenue warrants issued hereunder or other
short-term obligations hereafter authorized and not redeemed in cash within
twenty days after the expiration of the thirty-day period for the cash payment
without interest of assessments on the assessment roll for the District The bonds
shall be paid and redeemed by the collection of special assessments to be levied
and assessed against the property within the District, payable in annual
installments, with interest at a rate to be hereafter fixed by ordinance under the
mode of "payment by bonds," as defined by law and the ordinances of the City
The exact form, amount, date, interest rate and denominations of such bonds
hereafter shall be fixed by ordinance of the City Council Such bonds shall be
sold in such manner as the City Council hereafter shall determine

ORDINANCE NO 3224
AN ORDINANCE amending Ordinance No 3216 order
ing the construction of sanitary sewerlines sewer stubs
street overlay and other work in the Riverview area all in
accordance with Resol (t on No 2289 reducing the size
of Local Improvement:I/strict No 131
WHEREAS on February 3 1997 the City Council con-
ducted a hearing on a proposed improvement and the
formation of Local Improvement District No 131 located
in the Riverview area heard objections to the inclusion of
certain property within the proposed Local Improvement
District and passed Ordinance No 3216 ordering the
construction of sanitary sewerlines sewer stubs street
overlay and other work in the Riverview area and estab
lishing Local Improvement District No 131 having three
non-contiguous units and
WHEREAS following the 30 day period after the pas
sage of Ordinance No 3216 the City has determined
that it has received written objectiOns to the improvement
and the formation of Local Improv&' rient District No 131
from owners of property representing at least 60% of all
the estimated assessments in a non contiguous portion
of the Local Improvement District an I therefore under
RCW 35 43 180 that area is automatically excluded from
the Local Improvement District and
WHEREAS it is necessary to amend Ordinance No
3216 to reduce the improvement the estimated costs
thereof and the territorial extent of the improvement
NOW THEREFORE THE CITY COUNCIL OF THE
CITY OF PASCO WASHINGTON DO ORDAIN
as follows
Section 1 Section 1 of Ordinance 3216 is amended to
read as follows
Section 1 The City Council of the City of Pasco
Washington (the City) orders the improvement of the
Riverview area both within and outside the City by the
construction of sanitary sewerlines sewer stubs street
overlay and other related work located as described on
revised Exhibit A attached hereto and by this reference
made a part hereof All of the foregoing shall be in accor-
dance with the plans and specifications therefor pre-
pared by the City Engineer and may be modified by the
City Council as long as such modification does not affect
the purpose of the improvement
Section 2 Section 2 of Ordinance 3216 is amended to
read as follows
Section 2 There is created and established a local
improvement district to be call Local Improvement
District No 131 of the City of Pasco Washington (the
District) the boundaries or territorial extent of the
District being the perimeter of this property more particu-
larly described in revised Exhibit B attached hereto and
by this reference made a part hereof
Section 3 Section 3 of Ordinance 3216 is amended to
read as follows
Section 3 The total estimated cost and expense of the
improvement is declared to be $1 548 200 The entire
cost and expense shall be borne by and assessed
against the property specially benefited by such improve-
ment included in the District which embraces as nearly
as practicable all property specially benefited by such
improvement
Section 4 Section 6 of Ordinance 3216 is amended to
read as follows
Section 6 Local improvement district warrants may be
issued in payment of the cost and expense of the
improvement herein ordered to be assessed such war
rants to be paid out of the Local Improvement Fund
District No 131 hereinafter created and referred to as
the Local Improvement Fund and until the bonds
referred to in this section are issued and delivered to the
purchaser thereof to bear interest from the date thereof
at a rate to be established hereafter by the City Finance
and Budget Director as issuing officer and to be
redeemed in cash and/or by local improvement district
bonds herein authorized to be issued such interest-bear-
ing warrants to be hereafter referred to as revenue war-
rants In the alternative the City hereafter may provide
by ordinance for the issuance of other short-term oblige
bons pursuant to Chapter 39 50 RCW If the City shall
authorize expenditures to be made for such improvement
(other than for any cost or expense expected to be borne
by the City) prior to the date that any short term obliga-
tions or local improvement district bonds are issued to
finance the improvement from proceeds of interfund
loans or other funds that are not and are not reasonably
expected to be reserved allocated on a long-term basis
or otherwise set aside to pay the cost of the improve
ment herein ordered to be assessed against the property
specially benefited thereby the City declares its official
intent that those expenditures to the extent not reim-
bursed with prepaid special benefit assessments are to
be reimbursed from proceeds of short term obligations or
local improvement district bonds that are expected to be
issued for the improvement in a principal amount not
exceeding $1 548 200 The City is authorized to issue
local improvement district bonds for the District which
shall bear interest at a rate and be payable on or before
a date to be hereafter fixed by ordinance The bonds
shall be issued in exchange for and/or in redemption of
any and all revenue warrants issued hereunder or other
short term obligations hereafter authorized and not
redeemed in cash within twenty days after the expiration
of the thirty-day period for the cash payment without
interest of assessments on the assessment roll for the
District The bonds shall be paid and redeemed by the
collection of special assessments to be levied and
assessed against the property within the District payable
in annual installments with interest at a rate to be here
after fixed by ordinance under the mode of payment by
bonds as defined by law and the ordinances of the City
The exact form amount date interest rate and denomi
nations of such bonds hereafter shall be fixed by ordi-
nance of the City Council Such bonds shall be sold in
such manner as the City Council hereafter shall
determine
