AN ORDINANCE assigning zoning to certain real property within the City
of Pasco
WHEREAS, on February 20, 1997, the Planning Commission of the
City of Pasco conducted a public hearing to develop a recommendation for
the assignment of zoning to certain properties, in the event those
properties were incorporated within the City, and
WHEREAS, on February 3, 1997, Ordinance No 3213, effectively
annexed certain real property to the City of Pasco, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO ORDAIN
AS FOLLOWS
Section 1 That the following described area, situated in Franklin
County, Washington to-wit
Beginning at a point on the South R-O-W line of Sylvester Street, said point
being the NE corner of Lot 1, Klopfenstem Subdivision located in Southwest
Quarter of Section 26, Township 9 North, Range 29 East, Thence westerly
along the South R-O-W line of Sylvester Street to the NW corner of said lot
1, Thence Southerly along the West line of Klopfenstem Subdivision and
the projection of the West line of said Subdivision to the Benton/Franklin
County Boundary Thence Easterly along said County Boundary to the
intersection with the southerly projection of the East line of Lot 11,
Klopfenstein Subdivision, Thence northerly along the projection of the East
line of said Lot 11 to the intersection with the South line of River Haven
Street, Thence Westerly along the South line of River Haven Street to the
West Line of Road 44, Thence Northerly along the West line of Road 44 to
the intersection with the South line of River Haven Street, Thence
westerly along the South line of River Haven Street to the intersection with

the West line of Road 45, Thence Northerly along the West line of Road 4 5
to the point of beginning
as depicted in the map attached hereto and labeled Exhibit 1 be and the
same is hereby assigned the RS-20 (Suburban Residential) district
classification
Section 2 That any and all zoning maps be and the same are hereby
amended to conform to the aforesaid assignment of zoning
Section 3 This ordinance shall be in full force five days after its
passage and publication as required by law

REPORT TO PLANNING COMMISSION
MASTER FILE NO (MF# 97-07-ZD) APPLICANT City of Pasco
HEARING DATE 2/20/97
BACKGROUND
REQUEST Estabhsh a zoning recommendation for an area m West Pasco located south of
Sylvester Street and adjacent the west side of Rd 45 This property will be
annexed on February 28, 1997
1) Area ID Area Size # of Dwellings Area Population
Area #5 10+ Acres 10 SF 30 Persons
2) UTEL1lIES Municipal water currently serves the area This area has been mcluded m a
sewer LED which will cause construction of a sewer line later this year
3) LAND USE AND ZONING The area contains 10 single family residences The
surrounding properties to the east and west and north are developed with single family
residences The Columbia River lies to the south
4) COMPREHENSIVE PLAN The comprehensive plan designates this area as single family
residential The property is located within the City of Pasco's Urban Growth Boundary , _
5) ENVIRONMENTAL DETERMINATION This proposal has been issued a determination
of nonsigruficance m accordance with review under the State Environmental Policy Act
(SEPA), Chapter 43 21(c) RCW
CONCLUSION
With the exception of one lot all properties m the proposed annexation are developed with
single family dwellings The exception is a vacant lot used as a horse pasture The properties
range m size from 23,000 sq ft to 55,600 sq ft The Comprehensive Plan designates all
properties m question for Single Family development The area is currently zoned R-1 by
Franklin County and the County properties to the west and north are zoned R-1 The
mcorporated properties to the east are zoned RS-12 by the City The RS-12 district closely
mirrors the current County zoning, however the RS-20 district would provide the necessary
development standards to preserve the existing neighborhood character
Considering the facts that the annexation area is
• Designated by the Comprehensive Plan as Single Family Residential,
• Developed with single family residences on lots greater than 20,000 square feet
Staff recommends that this area be zoned RS-20 (Residential Suburban) when it is annexed to
the City of Pasco
FINDINGS OF FACT
The Planning Commission must make findings of fact related to (1) Consistency with the
Comprehensive Plan, (2) Effect on surrounding properties, (3) Merits to the community,
(4) Need for conditions to address adverse impacts, and, (5) Whether or not a concomitant
agreement should be required
The following are Findings of Fact as they relate to this rezone hearing,
The Comprehensive Plan designates this area for low density single family
' development
The annexation area is fully developed (except one lot) with single family dwelhngs
The County currently has the area zoned for single family development
The Comprehensive Plan encourages the use of zoning and other codes to protect the
character of existing neighborhoods
Given the location of the property and surrounding development patterns there is not a
" need for a concomitant agreement
RECOMMENDATION
I
MOTION I move the Planning Comnussion recommend the City Council establish
RS-20 (Residential Suburban) zoning for all properties in Annexation
"Area 5" when such properties are annexed to the City of Pasco

PLANNING COMMISSION MINUTES
The Februray 20, 1997 meeting of the Planning Commission was called to
order at 7 05 p m by Acting Chairman Robert Chamberlm

APPROVAL OF MINUTES:
Chairman Hay asked if there were any additions or corrections to
the minutes of January 16, 1997
Commissioner Smurthwaite moved, seconded by Commissioner
Chamberlin that the minutes be approved as mailed
The vote was unanimous
PUBLIC HEARING OATH:
Chairman Hay explained to those present that the state law
requires testimony in quasi judicial hearmgs such as the Planning
Commission heanng to be given under oath or affirmation and asked all
those that wished to speak this evening to stand so he could administer
the oath The oath was administered
PUBLIC HEARINGS:
A ZONING DETERMINATION Develop a Zoning Determination in
the event the property is annexed to
the City of Pasco (Rd 45-Rd 46,
south of Sylvester St)
Staff explained notice of this heanng was published in the paper
an property owners had be notified of this hearing Staff explained the
area contained 23,000-50,000+ square foot lots and recommended the
RS-20 zoning distnct which requires a minimum size of 20,000 square
feet per home Staff explained this would protect the established
character
Chairman Hay opened the pubhc heanng by asking if anyone was
present who wished to speak on this matter'?
Ray Rose 4508 Riverhaven was present to speak about this
proposal Mr rose was concerned about the sewer issues pertaining to
this area
Chairman Hay asked if anyone else was present who wished to
speak on this matter?
None were present
Chairman Hay then closed this portion of the public hearing
Commissioner Selby questioned what the difference between the
RS-12 and RS 20 districts
Commissioner Crawford questioned staff about animals in the RS-
20 district
Staff provided explanations for the Planning Commission
Commissioner Chamberlin reviewed the Findmgs of Fact and then
moved, seconded by Commissioner Selby that the Planning
Commissioner recommend the City Council establish RS-20 zoning as
presented in the staff report
The vote was unanimous
