HomeMy WebLinkAbout3189 OrdinanceORDINANCE NO. 3j,7 AN ORDINANCE relating to the creation of an Appeals Board to be known as the Pasco Code Enforcement Board (CEB), the mission and purpose of which shall be to hear appeals and render decisions regarding civil violations of certain sections of the Pasco Municipal Code WHEREAS, for purposes of necessity and efficiency certain penalty sections of the Pasco Municipal Code, which had required criminal penalties, are now to be civil infractions with monetary penalties It is therefore necessary to create a Code Enforcement Board to hear appeals, render decisions and issue monetary penalties regardmg civil violations of certain sections of the Pasco Municipal Code, NOW, THEREFORE, THE CITY OF COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS: Section 1. There is added to the Pasco Mumcipal Code a new title, Title 11 Civil Infractions Chapter 11 04 Code Enforcement Board, of the Pasco Municipal Code shall read as follows 11 04 010 Creation of Pasco Code Enforcement Board There is created a Code Enforcement Board (CEB) for the city of Pasco, Franklin County, Washington The Board shall hear appeals and render decisions regardmg civil violations of the Pasco Municipal Code Its express mission and purpose shall include the followmg (1) Conduct hearings on civil violations of the Pasco Municipal Code, (2) Determine whether the City has established by a preponderance of the evidence that a civil violation of the Pasco Municipal Code has occurred, (3) Assess monetary penalties m instances where it has been determined that civil violations of the Pasco Municipal Code have occurred, (4) To adopt rules of procedure for hearings concermng civil violations of the Pasco Municipal Code, (5) To act in an advisory capacity to the City Council, City Manager, and staff in matters relating to code enforcement and civil violations 11 0 020 Operation of Code Enforcement it oard The membership of the Pasco Code Enforcement Board shall be as follows (1) The Board shall consist of five (5) voting members, (2) All positions on the Board shall be filled by persons appointed by the City Council, CHARLES D KILBURY, MAYOR (3) All members of the Board shall be residents of the City of Pasco, both at the time of their appomlinent and for the full term of their appointment, (4) The CEB members who are first appointed shall serve terms as designated m 11 04 020(a), but thereafter board members shall appointed for a term of two (2) years and shall commence on the first day of January of the year of the appointment (a) The term for the first appointed board members shall commence and terminate as Follows Position 1 - January 1, 1997 to January 1, 1999 Position 2 - January 1, 1997 to January 1, 1999 Position 3 - January 1, 1997 to January 1, 2000 Position 4 - January 1, 1997 to January 1, 2000 Position 5 - January 1, 1997 to January 1, 2000 (5) The appomtmg authority may remove by mai only vote any person it appointed for lack of due diligence or for other good cause Any vacancy created by removal form office, resignation, change m residency to outside the City limits of Pasco, or for any other reason, shall be filled by the appointing authonty for that position for the remainder of that term Section 2.
