HomeMy WebLinkAbout3157 OrdinanceORDINANCE NO 5257 AN ORDINANCE relating to land use and zoning amending Title 22 by enacting a new Chapter 22 37A dealing with zoning for factory assembled homes WHEREAS, cities have the responsibility to regulate and control the physical development within their borders and insure the public health, safety and welfare are maintained, and, WHEREAS, the City of Pasco has zoning regulations that encourage orderly growth and development of the City, and, WHEREAS, the City Council has reviewed the Planning Commission's recommendations, and has determined that to further the purpose of the comprehensive planning and to maintain and protect the welfare of the community, it is necessary to amend PMC Title 22, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DOES ORDAIN AS FOLLOWS Section 1 That PMC Title 22 is hereby amended to include a new chapter 22 37A, to read as follows CHAPTER 22 37A RMH-1A RESIDENTIAL FACTORY ASSEMBLED HOME DISTRICT Sections 22 37 010A Description and intent 22 37 020A Permitted uses 22 37 030A Permitted accessory uses 22 37 040A Permitted conditional uses 22 37 050A Building heights 22 37 060A Lot area 22 37 070A Lot coverage 22 37 080A Minimum floor area 22 37 090A Yard requirements 22 37 100A Placement standards Ordinance for Motion "A" ) 22 37 010A DESCRIPTION AND INTENT The RMH-1A Residential Factory Assembled Home Distnct is established to provide for residential areas which would be compatible for factory assembled homes and to prohibit the development of incompatible uses that are detrimental to the desired residential environment It is to provide a zoning district for factory assembled homes on platted lots Certain public facilities and institutions may also be permitted provided their nature and location are not detrimental to the intended residential environment 22 37 020A PERMITTED USES The following uses shall b e permitted in the RMH-1 manufactured home district (1) Factory assembled homes, (2) One family dwellings (site built) (3) Nothing contained in this section shall be deemed to prohibit the use of vacant property for gardening or fruit raising 22 37 030A PERM1T1ED ACCESSORY USES The following uses shall be permitted as accessory to a permitted use in the RMH-1 District (1) Residential garages, as defined in Section 22 12 370, provided they do not exceed fifteen feet in height, (2) Home occupations, as defined in Section 22 12 390, (3) Storage buildings not exceeding two hundred square feet of gross floor area and fifteen feet in height, provided no container storage, as defined in Section 22 23 750, shall be permitted, (4) The renting of rooms for lodging purposes only, provided, however, such accommodations shall not exceed two persons in a single-family dwelling One off-street parking space, per roomer, must be provided in addition to the requirement set forth under Section 22 84 010(1), (5) The keeping of dogs and cats, provided such number of animals does not exceed three dogs and three cats, (6) Family day care homes in conformance with WAC 388-73 as now existing and as amended and PMC Chapter 22 35 22 37 040A CONDITIONAL USES In addition to the unclassified uses listed in Chapter 22 80, the following uses may b e permitted by special permit as provided in Chapter 22 80 (1) Churches and similar places of worship, (2) Public libraries, and municipal office buildings, (3) Public and private elementary schools, public parks and playgrounds, (4) Fire department station houses, (5) Private nursery schools, preschool, child mini' day care and day care centers 22 37 050A BUILDING HEIGHTS The building height restrictions are the same as those set forth under R-1 suburban district 22 37 060A LOT AREA In the RMH-1A factory assembled home district, the minimum lot area shall not be less than seven thousand two hundred square feet for each dwelling unit, except that any existing lot of record in the Office of the County Auditor shall b e deemed to meet the requirements of this section, provided all adjoining or abutting lots are held under separate ownership on the effective date of the ordinance codified in this chapter 22 37 070A LOT COVERAGE All dwelling units, accessory buildings, covered breezeways, covered parking shall not cover more than forty percent of the area 22 37 080A MINIMUM FLOOR AREA The minimum floor area of the primary living unit shall be 864 square feet -3- 22 37 090A YARD REQUIREMENTS (1) Front Yard The front yard for dwelling units shall have a depth of not less than twenty feet which shall b e measured from the right-of-way line Lots that front on local access streets with 50 foot rights-of-way shall have a twenty-five foot front yard (2) Side Yard The minimum side yard for factory assembled homes shall be five feet Side yards shall be measured from the side property line (3) Rear Yard The minimum rear yard shall be the height of the dwelling unit, but in no case shall it be less than ten feet which shall be measured from the rear lot line (4) Minimum Distance Between Structures There shall be an open space between any two buildings on a lot not less than ten feet in width (5) Reduce Side and Rear Yards An accessory building not used for human habitation may be constructed to within five feet of a side or rear lot line, provided said building is not closer than fifty feet to the front property line (6) Improvement Value The value of site built dwellings must not be less than eighty percent of the average assessed value, as determined by the records of the County Assessor, of improvements on other properties in the same or adjoining block fronts 22 37 100A PLACEMENT STANDARDS All factory assembled homes shall comply with the following placement standards (a) Age Restrictions All factory assembled homes shall not be more than ten years old as determined b y the manufacturer date (b) Foundations All factory assembled homes shall be placed on a foundation system following the -4- requirements of Title 19 and the specifications of the manufacturer (c) Skirting All factory assembled homes shall b e skirted with material that will resemble a typical residential foundation The required crawl space shall be vented per manufacturer's specification (d) Wheels All wheels, tongues, and other transportation equipment must be removed from the factory assembled home when placed upon a lot (e) Additions No additions shall be built or attached to any factory assembled home except under the following conditions (1) The exterior siding of additions shall match the exterior siding of the factory assembled home in shape and color and texture (2) All windows, doors, soffits, facia and trim on additions shall match in appearance and same items on the factory assembled homes (3) The roof pitch and covering shall match the roof pitch and covering of the factory assembled home (4) Additions will not be permitted on any manufactured home which contains less than 864 square feet unless said home existed on the same lot prior to June of 1996 Section 2 That PMC Section 22 37 325 (a) is hereby amended to read as follows 22 12 325 FACTORY ASSEMBLED HOME A factory assembled home is defined as either (a) A factory built structure that was constructed in accordance with the US Department of Housing and Urban Development -5- requirements and bearing an appropriate Department of Labor and Industries ensignia indicating such compliance Section 3 That this ordinance shall be in full force and effect after passage and
