HomeMy WebLinkAbout3100 OrdinanceORDINANCE N0310 0 AN ORDINANCE concerning firearms, and amending Sections 9 24 010 and 9 24 020 of the Pasco Municipal Code, and repealing Section 9 24 060 of the Pasco Municipal Code WHEREAS, Chapter 7, Section 428 and Section 429, First Special Session, 1994 Laws of the State of Washington has caused certain sections of the Pasco Municipal Code to be in conflict with state law requiring their amendment where possible, or their repeal, now, therefore, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO ORDAIN AS FOLLOWS: §1 Section 9 24 010 of the Pasco Municipal Code is hereby amended to read as follows (deletions shown by interlineation, and additions by underlining) 9 24 010 CARRYING CONCEALED WEAPONS It is unlawful for any person to carry or wear concealed upon his person, or concealed in any vehicle, a weapon, consisting of either a pistol, revolver, or other firearm, or spring blade knife, dirk, dagger, stiletto, bowie knife, sword, cane, any knife the blade of which is automatically released by a spring mechanism or other mechanical device, or any knife having a blade which opens, or falls, or is ejected into position by the force of gravity, or by an outward, downward, or centrifugal thrust of movement, or any slingshot, metal knuckles, or any other dangerous weapon or instrument, excepting firearms, which may be used to inflict injury upon the person of another This section shall not apply to marshals, sheriffs, prison or jail wardens or their deputies, policemen or other law enforcement officers or to members of the Army, Navy, or Marine Corps of the United States or of the National Guard or organized reserves when on duty, or to regularly enrolled C C receive such weapons frem the United States or from this state or to regularly enrolled members of clubs organized for the purpose of target shooting and affiliated with a national officers or employees of the United States duly authorized to carry a concealed pistol or to any person engaged in the Ordinance No. 3 /Co Page 1 of 3 to the agent or representative of any such person having in his possession, using or carrying a pistol in the usual or ordinary course of such business or to any person carrying a pistol unloaded and in a secure wrapper from the place of purchase to his home or place of business or in moving from one pace of abode or business to another (Prior code Sec 10 5 68) §2 Section 9 24 020 of the Pasco Municipal Code is hereby amended to read as follows (deletions shown by interhneation) 9 24 020 WEAPONS CAPABLE OF PRODUCING BODILY HARM - UNLAWFUL ACTS - PENALTIES - EXCEPTIONS (a) It is unlawful for anyone to carry, exhibit, display or draw any fir arm, dagger, sword, knife or other cutting or stabbing instrument, club, or any other weapon or imitation of any weapon apparently capable of producing bodily harm, excepting firearms in a manner, under circumstances, and at a time and place that either manifests an intent to injure another or that warrants alarm for the safety of other persons or for the security of their property (b) Any person violating the provisions of subsection (a) above shall be guilty of a misdemeanor (c) Subsection (a) of this section shall not apply to or affect the following (1) Any act committed by a person while in his place of abode or fixed place of business, (2) Any person who by virtue of his office or public employment is vested by law with the duty to preserve public safety, maintain public order or to make arrests for offenses, while in performance of such duty, (3) Any person acting for the purpose of protecting himself against the use of presently threatened unlawful force by another, or for the purpose of protecting another against the use of such unlawful force by a third person, (4) Any person making or assisting in making a lawful arrest for the commission of a felony, or (5) Any person engaged in military activity sponsored by the federal or state governments (Ord 2489 Sec 1 (part), 1984 prior code Sec 10-5 72) §3 Section 9 24 060 of the Pasco Municipal Code titled SELLING REVOLVERS AND PISTOLS TO MINORS is hereby repealed in its entirety Ordinance No. 3/00 Page 2 of 3 A iiroved As To Fo aitAn Greg City A Rubstello Attorney §4.
