HomeMy WebLinkAbout3092 Ordinanceelice M or Attest: Catherine D Seaman Deputy City Clerk / •41 Gr Rubstello City orney oved As To Form: • rq ORDINANCE NO. 5 (Yip AN ORDINANCE concerning the disposal of forfeited firearms WHEREAS, RCW 9 41 098 provides that firearms which are (1) judicially forfeited and no longer needed for evidence, or (2) forfeited due to a failure to make a claim under RCW 63 32 010 or 63 40 010, may be disposed of in any manner determined by the local legislative authority and, WHEREAS, the Pasco City Council has determined that such forfeited firearms should either be destroyed or auctioned to firearm dealers, now, therefore, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO ORDAIN AS FOLLOWS: §1. New Section 9 24 100 is hereby added to the Pasco Municipal Code, which section, shall read as follows 9 24 100 DISPOSAL OF FORFEITED FIREARMS (a) Firearms that are (1) judicially forfeited and no longer needed for evidence, or (2) forfeited due to a failure to make a claim under RCW 63 32 010 or 63 40 010, may be disposed of by the Chief of Police either by their destruction or by auction to firearm dealers at the discretion of the Chief of Police subject to subsection (b) below All proceeds of an auction shall be placed m the General Fund (b) The Chief of Police may not destroy such firearms without permission of the City Council unless the firearms meet one of the following categories (i) "Saturday Night Special" types of short firearms with an apparent value under $50 00, or (11) firearms which have been modified in such a way as to make them illegal to possess, or (m) firearms which citizens deliver or turn over to the Police Department requesting destruction §2.
