ORDINANCE NO. 301ff
AN ORDINANCE prohibiting possession of aerosol containers of paint
and jumbo paint markers by minors, and adding new Section 9 64 250 to the
Pasco Municipal Code
WHEREAS, the City Council has heard numerous complaints from
citizens about the defacing of property by aerosol containers of paint and
jumbo paint markers, and
WHEREAS, the members of the City Council have observed evidence
throughout the community, on fences, on residences, on public buildings, on
business buildings and on other structures, of defacing of property by graffiti
applied by aerosol containers of paint and jumbo paint markers, and
WHEREAS, the City Council has heard reports from its Chief of Police
that most of the defacement by graffiti is being done by persons under the age
of eighteen years, and
Whereas, said graffiti is declared by the Council to be a public blight
that is causing substantial damages to property and expenses to the property
owner, now, therefore,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO
ORDAIN AS FOLLOWS:
§1. New Section 9 64 250 of the Pasco Municipal Code is hereby enacted
to read as follows
9 64 250 UNLAWFUL POSSESSION OF GRAFFITI TOOLS It
shall be unlawful for any person under the age of eighteen (18)
years to possess an aerosol container of paint or a jumbo paint
marker while on any public street, alley, sidewalk, or other
public place, regardless of whether that person is or is not in any
motor vehicle
§2 This Ordinance shall take effect five (5) days after passage and
publication
