AN ORDINANCE concerning industrial wastewater discharge,
treatment and monthly rates and charges, and creating new Chapter 13 41 to
the Pasco Municipal Code
WHEREAS, in order to facilitate industrial development and the
development of food processing plants in the City of Pasco, the City at the
direction of the City Council has caused to be designed and permitted
industrial wastewater treatment facilities, and
WHEREAS, it is necessary and appropriate to set connection
requirements, usage limitations and monthly rates and charges, now,
therefore,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO
ORDAIN AS FOLLOWS:
§1. New Chapter 13 41 to the Pasco Municipal Code setting forth
connection requirements, usage limitations and monthly rates and charges
for the City's Industrial Wastewater Treatment Facilities shall be as set forth
in new Chapter 13 41 of the Pasco Municipal Code, which chapter shall read as
follows

13 41 010 CONNECTION REQUIREMENTS Industrial Users
connecting to the City's Industrial Wastewater Treatment
Facilities shall also be required to connect to the City's Municipal
Water System Industrial Users shall further be required to
secure all necessary permits prior to connection to the Industrial
Wastewater Treatment Facilities In addition, Industrial Users
shall install at their sole expense, City approved monitoring
stations on their wastewater discharge lines for purposes of
monitoring the volume, strength and characteristics of their
plant discharges into the Industrial Treatment System The
monitoring stations and acquired data shall be open to City
employees at all times for their inspection and the data obtained

from the monitoring stations shall be used by the City to
determine the actual variable operating costs as set forth in
Section 13 41 020 (b) based upon the actual volume, strength and
characteristics of the plant discharge
13 41 020 MONTHLY CHARGES
(a) Base monthly charges Each month, Industrial Wastewater
Treatment Facility users shall be charged and shall pay the
following charges

(b) Annual adjustment It is the intent of this chapter that the
Industrial Users of the Industrial Wastewater Treatment
Facilities pay the actual variable operating costs incurred by the
City to operate the Industrial Wastewater Treatment Facilities
Therefore, the variable operating costs incurred from the
discharge from each Industrial User will be reviewed on an
annual basis and the actual variable operating costs determined
The difference between the amount paid for variable operating
costs, on a monthly basis, and the actual variable operating costs
incurred shall be determined by the City The difference
determined shall either be rebated to or collected from the
Industrial User(s) of the Industrial Wastewater Treatment
Facilities In order to assist the City and Industrial user(s) the City
Finance Director and the Director of Public Works shall after
each calendar quarter prepare a summary of revenues received
and expenses incurred during the previous quarter, as well as a
forecast (to the extent reasonably possible) of revenues and
expenses for the next quarter
(c) Overage charges /effluent characteristics The Industrial
Wastewater Treatment Facility has a fluctuating and finite
capacity to treat wastewater Therefore, the base monthly charge
has been calculated to include a capacity and limitation
allowance for the following effluent volumes, strengths and
characteristics

The time periods for determination of daily and consecutive 15-
day totals for each characteristic shall be for the twenty-four hour
period starting at a m and ending at a m The
time periods for determination of consecutive 15-day allowance
periods shall be a rolling time period
The overage charges to be assessed to and paid monthly by the
Industrial User when exceeding the 15-day allowance limitation
set forth above shall be as follows

13 41 030 RATE MODIFICATION This rate ordinance
shall be subject to modification and change, including such time
as new users are connected to the Wastewater Treatment
Facilities, at which time a review of the costs incurred and rates
charged for all Industrial Users shall be undertaken
13 41 040 USAGE LIMITATIONS Due to the limited
capacity of the Wastewater Treatment Facilities and the seasonal
nature of the Industrial Users operations, use of the Industrial
Wastewater Treatment Facilities shall be subject to usage
limitations These usage limitations shall be as specified in the
Discharge Permit issued by the City prior to connection to the
facilities and the planned annual production schedule and
assigned loadings of the Industrial User At the beginning of
each calendar year, the Industrial User shall provide in writing
to the Director of Public Works an assumed Monthly Production
Schedule and loadings for the coming year The City reserves the

right to shape, limit or restrict loadings from any Industrial User
to assure that the Industrial User stays within the limitations of
the Discharge Permit and the capacity of the Industrial
Wastewater Treatment Facility
§2. This Ordinance shall take effect five (5) days after passage and
publication

III. HISTORY AND FACTS BRIEF:
A) The industrial wastewater system is a land application disposal system being
constructed by the city for the Pasco Processing Center, it will collect and
dispose of process wastewater generated by food processing plants to be
located at the Processing Center, the first of which will be the Simplot
vegetable plant
B) The City Council must establish, by Ordinance, the rates to be charged users of
the system
IV. DISCUSSION:
A) The draft Ordinance provides for a two-part monthly fee The first and largest
component will be what is termed the "fixed charge", it reflects the capitalized
expenses to construct the wastewater system The second component will be
the "variable charge", it reflects the estimated costs of operating the system
The Ordinance further provides that, at the end of each calendar year, the
actual operating costs will be balanced against what was actually received
through the variable charge during the year, any difference will be reconciled
between the city and the users of the system
B) The Ordinance further provides for an overage charge, to be assessed in those
instances when a user exceeds its permitted maximum flow to the system This
element of the Ordinance reflects the need to manage not only the amount of
wastewater coming into the system, but also its characteristics, this is important
because of the land application component of the system
