HomeMy WebLinkAbout3056 Ordinance - Recordedv0l..0 3 5 7 PG0 8 6 5 - 515458 ORDINANCE NO. 3 05"G AN ORDINANCE vacating the east 15' of Railroad Avenue from 1-182 to the Foster Wells Rd WHEREAS, all steps and procedures required to vacate said right-of-way have been duly taken and performed, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DOES ORDAIN AS FOLLOWS: Section 1. That the east 15' of Railroad Avenue lying northerly of 1-182 to the southerly right-of-way line of Foster Wells Road, as depicted in Exhibit "1" be and the same is hereby vacated subject to the easement retained in Section 2 hereof Section 2. That the city shall retain an easement and the right to exercise or grant easements with respect to the east 15' of Railroad Avenue lying northerly of 1-182 to the southerly right-of-way line of Foster Wells Road Section 3 That a certified copy of this ordinance be recorded by the City Clerk of the City of Pasco in and with the office of the Auditor of Franklin County, Washington Section 4. REFERENCE(S): A Vicinity Map B Proposed Ordinance II. ACTION REQUESTED OF COUNCIL/STAFF RECOMMENDATIONS: MOTION: I move to adopt Ordinance No , vacating a portion of Railroad Avenue from 1-182 to Foster Wells Rd III FISCAL IMPACT: NONE IV. HISTORY AND FACTS BRIEF: A The Franklin County P U D has requested the City of Pasco vacate the eastern 15 feet of Railroad Avenue for the location of a transmission line to serve the Pasco Processing Center The P U D has concerns about locating a line of this magnitude in the right-of-way due to the potential for the city to request various improvements be moved at owner expense B The right-of-way for this portion of Railroad Avenue is 100 feet in width Major arterials within the community are typically only 80 feet in width which has proved adequate C The P U D is requesting an easement be retained on the portion of right-of-way vacated so the transmission line can be located without obtaining easement from each property owner V. DISCUSSION: A The Acting Public Works Director has no objection to this vacation proposal B The Franklin County P U D is the agency which requested the vacation and are in favor of the request provided an 15 foot easements is retained C Cascade Natural Gas Corporation has stated this does not affect existing or future utility provision to the area VI.
