AN ORDINANCE vacating Hayes Street and Main Avenue north of "A" Street
and west of Oregon Avenue
WHEREAS, a petition signed by more than two-thirds of the owners of the
property abutting the street right-of-way herein below described has been submitted to
the City Council of the City of Pasco, and,
WHEREAS, all steps and procedures required by law to vacate said right-of-
way have been duly taken and performed, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON,
DOES ORDAIN AS FOLLOWS:
Section 1. That Hayes Street from the west right-of-way line of Oregon
Avenue to the east right-of-way line of Main Avenue and Main Avenue from the north
right-of-way line of "A" Street to the north right-of-way line of Hayes Street, as depicted
in Exhibit "1" be and the same is hereby vacated subject to the easement retained in
Section 2 hereof
Section 2. That the city shall retain an easement and the right to exercise or
grant easements with respect to Hayes Street from the west right-of-way line of Oregon
Avenue to the east right-of-way line of Main Avenue and Main Avenue from the north
right-of-way line of "A" Street to the north right-of-way line of Hayes Street
Section 3 That a certified copy of this ordinance be recorded by the City Clerk
of the City of Pasco in and with the office of the Auditor of Franklin County,
Washington
Section 4. This ordinance shall be in full force and effect after passage and
publication as required by law

driveway standards before putting up gates to close
off the vacated streets.
By putting up gates on these streets, we
increase security for Northwest Pipe, Oxarc and
reduce expenses to the City of Pasco

II. ACTION REQUESTED OF COUNCIL/STAFF RECOMMENDATIONS-
MOTION. I move to adopt Ordinance No , vacating portions Hayes
Street and Main Avenue located in Pasco Land Company's 1st
Addition
III. FISCAL IMPACT:
NONE
IV. HISTORY AND FACTS BRIEF -
A Property owners representing 100% of the abutting privately held ownership of
the area in question have requested said right-of-way be vacated
B The property owners are requesting the vacation to control access onto these two
streets separating Oxarc and Northwest Pipeline This will address an existing
security concern and will allow Oxarc to transport materials to and from the existing
site to the recently acquired building to the west without crossing a public street
V. DISCUSSION
A The Acting Public Works Director has no objection to this vacation provided an
easement is retained on the entire right-of-way proposed for vacation
B The Franklin county P U D has requested easements be retained on various
portions of the right-of-way proposed for vacation The city engineer's request to
retain the entire right-of-way as an easement would cover the P U D concerns
C Cascade Natural Gas Corporation has requested easements be retained on various
portions of the right-of-way proposed for vacation The city' engineer's request to
retain the entire right-of-way as an easement would cover the concerns of Cascade
Natural Gas Corporation No other utility providers responded to the public notices
