ORDINANCE NO.3054
AN ORDINANCE vacating a portion of the north/south alley in Block 137
Pasco Land Company's First Addition
WHEREAS, all steps and procedures required to vacate said right-of-way have
been duly taken and preformed, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON,
DOES ORDAIN AS FOLLOWS:
Section 1. That the north/south alley abutting Lots 9-16, Block 137, Pasco
Land Company's First Addition, as depicted in Exhibit "1" be and the same is hereby
vacated
Section 2 That a certified copy of this ordinance be recorded by the City Clerk
of the City of Pasco in and with the office of the Auditor of Franklin County,
Washington
Section 3. This ordinance shall be in full force and effect after passage and
publication as required by law
PASSED by the City Council of the City of Pasco, at its regular meeting, October
3, 1994

II. ACTION REQUESTED OF COUNCIL/STAFF RECOMMENDATIONS:
MOTION I move to adopt Ordinance No , vacating a portion of the
north/south alley abutting Lots 9-16, Block 137, Pasco Land
Company's 1st Addition
III. FISCAL IMPACT
NONE
IV. HISTORY AND FACTS BRIEF:
A Bobby Gilbert and Nancy McGregor, property owners representing 66% of the
abutting private property of the alley in Block 137 have submitted a petition
requesting the vacation of this alley
B State law requires that more than 2/3 of the abutting property owners sign the
vacation petition to make it valid Because the vacation request for the alley in Block
137, does not the not meet the statutory requirement the applicants requested the city
initiate the street vacation process for this alley
C On September 6, 1994, the City council initiated the vacation process for this
alley Unlike most vacation efforts, the resolution setting the public hearing was not
based upon a petition by the property owners
V. DISCUSSION
A The City Council held a public hearing on this matter on August 1, 1994 Due to
concerns over access to the rear of the Fasteners Inc building, the alley in block 137
was not vacated Staff has spoken with Mr Gilbert and the owners of the Fasteners
building about vacating the portion of the alley that would not impact Fasteners
access All parties are in agreement with the vacation of the alley in the southern half
of the block
B The alley in question has never been opened or maintained by the city This alley
is landlocked and not accessible to the public and serves no public purpose or use
