AN ORDINANCE concerning vacation accrual by City employees, and
amending Sections 242 180, 2 42 210 and 242 240 of the Pasco Municipal Code
WHEREAS, the City Council has determined that it is appropriate and
fair to increase the annual rate of vacation accrual for City employees to a
level that more fairly compares to like employees employed by other public
employers, now, therefore,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO
ORDAIN AS FOLLOWS:
§1. Section 242 180 of the Pasco Municipal Code is hereby amended
with new language underlined and deleted language shown by
interdelmeation, to read as follows
242 180 VACATION CREDIT All employees except
employees covered by collective bargaining agreements,
department heads, supervisors, division heads, and the city
manager, shall receive vacation credit subsequent to permanent
appointment at the rate of one work day for each month of
continuous service starting from the date of their probationary
employment After entering their sixth year of continuous
service each employee shall earn vacation credit at the rate of
one and one-fourth work days per month After entering their
tenth year of continuous service each employee shall earn
vacation credit at the rate of one and one fourth one-half work
days per month After entering their fifteenth year of continuous
service, each employee shall earn vacation credit at the rate of
one and one-half one and seven-tenths work days per month
Each employee after entering their tenth year of continuous
service may convert up to five (5) days accrued vacation to cash
in December of each year, provided the employee has
maintained satisfactory work performance as shown on their last
performance evaluation and has used at least ten vacation days
during the calendar year in which the cash-out is taken
§2. Section 2 42 210 of the Pasco Municipal Code is hereby amended
with new language underlined and deleted language shown by
interdelmeation, to read as follows

2 42 210 ACCUMULATION OF VACATION Normally,
employees will be required to take annual vacation No accrued
vacation will be allowed in excess of two full one and one half
years earned vacation or vacation/holiday time Time not taken
which causes accrual beyond two full one and one half years
will be lost to the employee Normally, employees will not take
more than one and one-half years accumulation in any one year,
however, the city manager may authorize longer leave in special
cases
§3. Section 2 42 240 of the Pasco Municipal Code is hereby amended
with new language underlined and deleted language shown by
interdehneation, to read as follows
2 42 240 CITY MANAGER, DEPARTMENT HEADS AND
SUPERVISORS DIVISION HEADS VACATION -
ACCUMULATION Effective January 1, 1986
(a) The city manager and department heads shall
accumulate vacation leave at the maximum allowable rate of
one and one half rate of two work days per month
(b) Supervisors Division Heads shall accumulate vacation
leave at the rate of one and one quarter three-quarter days per
month unless entitled to one and one half days per month
under Section 2 42 180 The word "supervisors" as used herein
means employees occupying supervisory positions and who are
not members of a collective bargaining unit having an
agreement with the City
(c) The City Manager, department heads and -supervisors
division heads in their discretion may convert up to five (5) days
accrued vacation to cash in December of each year, provided any
such employee requesting conversion has maintained
satisfactory work performance and has taken at least ten (10) days
vacation leave during the calendar year
§4. This Ordinance shall take effect on January 1, 1995

III HISTORY AND FACTS BRIEF
A) The provision of vacation benefit to employee groups throughout the
City organization have been relatively fixed for about 20 years The
most recent contract agreement with the Operating Engineers Union
resulted in the recognition that Pasco's vacation accrual rate lagged most
other cities of similar size and circumstance, new contract increased the
rate of accrual (employees will earn more days of vacation per year
sooner than they would have under the old schedule)
B) In addition to the change in the accrual rate, an offsetting provision
included in both agreements of both agreements reduces the maximum
accrual to the equivalent of what an individual would earn in 1 1/2 years
time, the prior maximum was fixed at two years accrual The intent of
this provision is to assure that additional vacation time is being used and
not simply built up for cash out purposes
C) The change for the Operating Engineers was also included in the non-
uniform police contract (police clerks) Both contract changes are
effective January 1, 1995
D) The non-represented employees group includes both management and
non-management segments The management segment has historically
been provided a differential increment of accrual higher than the other
non-represented group as well as the bargaining units, in view of their
"exempt" status with regard to overtime (both division and department
heads are responsible to attend meetings and perform other
management responsibilities beyond the normal 40 hour work week)
IV DISCUSSION
A) The Personnel Officer has outlined a recommended revision to the
vacation accrual provided to the non-represented employee group For
the non-management segment, it mirrors the provision established in
the two collective bargain agreements approved earlier this year,
reflecting an increased rate of accrual and a reduction in the maximum
accrual to 1 5 years The recommendation of 21 days per year for
division heads and 24 days per year for department heads maintains the
incremental distinction which has been characteristic of the Pasco
system for many years, but will increase the benefit to a level between
that already established in Kennewick and Richland for their
management employees
B) In addition to the increased annual accrual, both segments of non-
represented employees would be restricted to 1 5 years worth of accrual
The result will keep the cash out exposure within the limits established
under the old system and assure the additional vacation time is used
C) Staff recommends approval of the proposed vacation
benefit changes for the non-represented employee group.

*Managers/Division Managers receive 32 hours added on to regular accrual at
the end of the year
Also, the current maximum accumulation of vacation time is two full years
worth Therefore, along with the above proposal, I am recommending that the
maximum accumulation of vacation time be reduced to one and one-half years
worth
