HomeMy WebLinkAbout3031 Ordinance - Amending PMC Titles 21 & 22ORDINANCE NO 3 03 1 AN ORDINANCE relating to zoning and subdivision regulations amending PMC Titles 21 and 22 dealing with street widths THE CITY COUNCIL OF THE CITY OF PASCO DOES ORDAIN AS FOLLOWS Section 1. That Section 21 16 160 of the Pasco Municipal Code is hereby amended to read as follows 21.16.160 RIGHT-OF-WAY WIDTHS. F,or all streets, arterials and alleys hereinafter dedicated and accepted, the minimum right-of-way widths shall not be less than the minimum dimensions for each classification of public way as follows Arterial, primary, dual roadway - 120 feet Arterial, primary, single roadway - 80 feet Arterial, secondary - 80 feet Access streets - 60— 50 feet Cu-de-sac - 60 feet with 100 turn around Alleys - 20 feet Pedestrian ways - 10 feet Section 2. That subsection 22 24 040 (a), 22 25 080 (a), 22 26 090 (a), 22 28 090 (a), 22 30 090 (a), 22 32 090 (a), and 22 34 090 (a), of the Pasco Municipal Code are hereby amended to read as follows YARD REQUIREMENTS. (a) Front Yard The front yard, as defined in Section 22 12 850, shall have a depth of not less than twenty-feet which shall be measured from the front property line Lots that front on local access streets with 50-foot rights-of-way shall have a twenty-five foot front yard At least fifty percent of the required front yard area excluding driveways, shall be treated with landscape, as the term is defined in Chapter 22 82 Section 3. move to approve Ordinance No amending PMC Titles 21 and 22 reducing the right-of-way width for local access streets and increasing setbacks on those streets III FISCAL IMPACT NONE IV HISTORY AND FACTS BRIEF A Pasco's current street standards were established approximately forty years ago Because of changes in lifestyles and the cost of construction and long term maintenance, many communities have been reassessing right-of-way widths and improvement standards for local access streets B The Planning Commission held a public hearing at a special meeting on June 9th and as a result is recommending the attached ordinance be adopted downsizing the right-of-way way requirements for local access streets from 60 feet to 50 feet C With the reduced right-of-way there would be a corresponding reduction in the width of improvements Presently, with a 60 foot right-of-way the width of improvement from curb face to curb face is 38 feet With the 50 foot right-of-way that improvement width would be reduced to 32 feet In addition to the reduction in street width, the Planning Commission also recommended that there would be a corresponding increase in front yard setbacks to insure houses are Development Director SUBJECT Code Amendment for Right-of-Way Widths For many years now, the City's standard for local access street right- of-way widths has been 60-feet Street improvements have occupied approximately 40-feet of that right-of-way Pavement widths have been 38-feet, with the remainder of the improvements being curb and gutter The remainder of the right-of-way is used for utilities and/or sidewalk needs Many communities have been reassessing right-of-way widths requirements for local street access With the ever escalating costs of street construction and cost of petroleum products it is becoming costly to construct and maintain city streets Once a street is constructed and dedicated to the city, the city is responsible foi maintenance in perpetuity Public Works Department has investigated this issue and is recommending that street right-of way widths for local access streets be reduced from 60-feet to 50-feet and likewise reduce the width of improved surface (see the attached memo) The attached code amendment reflects the change in street widths for local streets and also includes provisions for increasing front yards setbacks on narrow streets so the location of homes remains constant RECOMMENDATION I move the City Council amend the municipal code to reduce the width of local access streets to 50-feet and create larger front yard setbacks in Director/City Planner FROM Jim Ajax, Director of Public Works SUBJECT Local Access Streets Improvement Standards- Right-of-Way City of Pasco's standards for right-of-way and street widths go back to, at least, the 1950's Since that time there have been a number of changes, those changes include the cost of street improvements which have gone up more than proportionate to inflation New houses typically have two or more car attached-garages with driveway in front as opposed to garages on an alley In driving through the Tri-Cities, you'll note, in the newer subdivisions it is rare that a car is parked on the street or certainly a string of cars parked on the street Our current street improvement standards, as practiced, require a 38-foot roadway, face of 'curb to face of curb It would be my recommendation that width drop to 32-feet, face of curb By way of example, in an area where there is heavy on-street parking, one could look at the neighborhood immediately west of City Hall, there are a number of streets 30-feet wide with alot of parking on both sides and yet they seem to work without complaint from the neighborhood and in fact, the narrower street didn't slow down traffic Another example of a narrower street would be in the new Canyon Lakes Subdivision One coulid go over to Canyon Lakes and look at the improvements on the 3.g-i-slope, there you'll notice the actual local access streets are 28-foot in width The City's intent was to have no parking, although their signs have not gone up My view is, if there were an occasional parked car, it would not cause a problem If the City were to allow street improvements to reduce to 32-feet in width, which would be 42-feet to back of sidewalk, it would be very practical to reduce right-of-way width from 60 -feet to 50 -feet In doing so, it would be my recommendation the City consider increasing setbacks, or require setbacks be from the centerline of right-of-way It strikes me that the front of house to front of house - C dimension in a subdivision should not change That again, is just my view My overall intent here is to make a recommendation that will allow Pasco to be more competitive in the new house market with our sister cities It is very important that we at least be on an even plain, in terms of cost to a developer and if at all possible have lower costs If such can occur, Pasco will certainly driveways, shall be treated with landscape, as that term is defined in Chapter 22 82 realistic designation, would not create compatibility problems and would allow for the development of affordable housing, staff recommended the rezone Chairman Dietrich opened the public hearing by asking if there was anyone present who wished to speak in favor of the proposed rezone 9 Wes Self, was present and stated that he had owned the land since 1979 and indicated the property no longer appeared to be practical for office development Mr Self explained he would like to develop the property and felt that a residential zoning classification would be more appropriate given the location of the property Chairman Dietrich asked if there was anyone else present who wished to speak in favor of this rezone 9 None were present Chairman Dietrich asked if there was anyone present who wished to speak against the rezone'? None were present Chairman Dietrich closed the public hearing Commissioner Hay moved seconded by Commissioner Malachi that based upon the findings of fact stated, the Planning Commission recommend the City Council rezone Lots 17 and 18, Block 11, Helm's Second Addition from C-1 to R-1 The motion was approved with one dissenting vote from Commissioner Crawford B CODE AMENDMENT Right-of-Way Width Reduction of New Plats (MF #94-41-CA) Staff explained notice had been published in the Tr-City Herald notifying the public of this code amendment hearing Staff explained that Pasco's right-of-way standards for many years has been sixty feet (60) with approximately forty feet (40) of that right-of-way being occupied by improvements such as paving, and curb and gutter Staff further explained that with the ever increasing costs of construction PAGE 2 and materials used in building and maintaining roads, may communities are looking at down-sizing right-of-way and improvement requirements It was pointed out that the City of Kennewick currently allows streets to be improved only to thirty-two feet (32) in width as opposed to Pasco's thirty-eight (38) feet Staff also referred the Planning Commission to the Public Works Directors memo that recommends the city consider reducing the size of public rights-of-way for local access streets Staff further pointed out that if the right-of- way was reduced from sixty (60) feet to Fifty (50) feet that the building setback line should be increased five (5) feet so the distance between homes would remain the same Chairman Dietrich opened the public hearing by asking if there was anyone present to speak in favor of this proposed code amendment'? None were present, Chairman Dietrich asked if there was anyone present who wished to speak against the proposal'? None were present There being no one present to speak for or against the proposal, Chairman Dietrich closed that portion of the public hearing He asked staff if this proposal would affect arterial or collector streets 9 Staff stated the proposal specifically addressed local access streets and would not affect right-of-way width of arterials or collectors Commissioner Williams stated that perhaps staff may want to look at the right-of-way width for collector and arterials later in the year Following additional discussion, Commissioner Williams moved seconded by Commissioner Dunn that the City Council amend the municipal code to reduce the width of local access streets to fifty (50) feet and create larger front yard setbacks in conjunction with the narrower street widths The motion was unanimously approved PAGE 3
