AN ORDINANCE relating to zoning and changing the classification of certain real
property within the City of Pasco from C-1 (Retail Business) to
R-1 (Low Density Residential)
THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS
FOLLOWS:
Section 1. That the zone classification of the following described real property
situated in Pasco, Franklin County, Washington to-wit
Lots 17 and 18, Block 11, Helm's Second Addition
as depicted in the map attached hereto and identified as Exhibit "l ", be and the same is
hereby changed from C-1 (Retail Business) to R-1 (Low Density Residential)
Section 2. That any and all zoning maps be and are hereby amended to conform to
the aforesaid zone change
Section 3. This ordinance shall be in full force and effect after passage and
publication as required by law

II. ACTION REQUESTED OF COUNCIL/STAFF RECOMMENDATIONS:
MOTION: I move to adopt Ordinance No , granting a rezone from C-1 to R-
1, as recommended by the Planning Commission

A On June 9, 1994, the Planning Commission conducted a public hearing to
determine whether or not to recommend a rezone for the property described in the
attached report
B. Following conduct of a public hearing, the Planning Commission reasoned
that it would be appropriate to recommend a change in zoning for this particular

BACKGROUND
REQUEST Rezone from C-1 (Retail Business) to R-1 (Low Density Residential)
1 PROPERTY DESCRIPTION
Legal Lots 17 and 18, Blocks 11, Helm's Second Addition
General Location Southeast corner of 18th Avenue and Bonneville Street
Property Size 50'x115' 5,750 sq ft
2 ACCESS The site has access from 18th Avenue, Bonneville Street and the alley
in Block 11, Helm's Second Addition
3 UTILITIES All municipal utilities are available to the site
4 LAND USE AND ZONING The property is currently zoned C-1 and is
vacant The properties to the north and east are zoned R-1 and the property to the
south is zoned R-3 The properties to the west and northwest are zoned C-1
Land use of the surrounding properties is as follows
North- Residential -Single family homes
South- Medical Office
East- Residences -Single family homes
West- Restaurant/Lounge and an office -,
5 COMPREHENSIVE PLAN The Comprehensive Plan designates this area as the
Medium Density Residential District Policy 1 1 of the residential plan stresses the
importance of protecting and enhancing the character of residential districts ,
6 ENVIRONMENTAL DETERMINATION This proposal has been issued a
determination of nonsignificance in accordance with review under the State
Environmental Policy Act (SEPA), Chapter 43 21(c) RCW
CONCLUSION
The site is located one and a half blocks north of Lewis Street and one half of a block north
of Clark Street and is bordered on two sides by single family residential development
The site has very limited visibility from Lewis Street or Clark Street and considering the
availability of vacant land fronting on Lewis Street and Clark Street in the area,
development of this site as currently zoned is unlikely The applicant is proposing to rezone
the site to R-1 (Low Density Residential) and develop a single family home on site The R-
1 zone allows single family unit provided there is 7,200 sq ft or more per unit Although
the site is smaller than the lot size required in the R -1 zone there is a provision (PMC
22 26 060) which allows lots existing before the regulations to be developed as zoned even
though the lot size is not met Rezoning the ploperty to R-1 would allow development of
the site with a single family house as intended by the applicant, is consistent with the
comprehensive plan and would eliminate a potential incompatible zoning designation
FINDINGS OF FACT
The Planning Commission must make findings of fact relating to consistency with the
comprehensive plan, effect on surrounding properties, merits to the community, the need
for conditions to addiess adverse impacts and whether or not a concomitant agreement
should be required
The proposal is consistent with the Comprehensive Plan This proposal should not have a
negative impact on the surrounding properties since it would allow development similar to
the existing uses The proposal has merit in that it would allow for the development of a
housing unit and eliminates a non viable zoning designation The proposal will not have
negative impacts on the surrounding properties therefore a concomitant agreement is not
needed
Considering this proposal
• Is consistent with the Comprehensive Plan,
• Replaces a non-viable zoning designation with a viable and realistic designation,
• Would not create any land use compatibility pioblems,
• Would allow for the development of affordable housing units,
• Staff recommends the property be rezoned from C-1 to R-1
RECOMMENDATION
MOTION I move based on the findings of fact as stated, the Planing Commission
recommend the City Council rezone Lots 17 and 18, Blocks 11, Helm's
Second Addition from C-1 (Retail Business) to R-1 (Low Density Residential)
