ORDINANCE NO.30 ari
AN ORDINANCE relating to zoning and changing the classification of certain real
property within the City of Pasco from C-1 (Retail Business) to
R-2 (Medium Density Residential)
THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS
FOLLOWS:
Section 1. That the zone classification of the following described real property
situated in Pasco, Franklin County, Washington to-wit
Lots 4-12 Block 6, Pettitt's Second Addition
as depicted in the map attached hereto and identified as Exhibit "1", be and the same is
hereby changed from C-1 (Retail Business) to R-2 (Medium Density Residential)
Section 2. That any and all zoning maps be and are hereby amended to conform to
the aforesaid zone change
Section 3. This ordinance shall be in full force and effect after passage and
publication as required by law

II. ACTION REQUESTED OF COUNCIL/STAFF RECOMMENDATIONS:
MOTION: I move to adopt Ordinance No , granting a rezone from C-1 to R-
2, as recommended by the Planning Commission
III. FISCAL IMPACT: NONE
IV HISTORY AND FACTS BRIEF:
A. On May 19, 1994, the Planning Commission conducted a public hearing to
determine whether or not to recommend a rezone for the property described in the
attached report
B. Following conduct of a public hearing, the Planning Commission reasoned
that it would be appropriate to recommend a change in zoning for this particular
property
C No written appeal of the Planning Commission's recommendation has been
received

BACKGROUND
REQUEST Rezone from C-1 (Retail Business) to R-2 (Medium Density Residential)
1 PROPERTY DESCRIPTION
Legal Lots 4-12, Blocks 6, Pettit's Second Addition
General Location Southwest corner of 12th Avenue and Bonnivelle Street
Property Size 225'x115' 25,875 sq ft 6 acre
2 ACCESS The site has access from 12th Avenue, Bonneville Street and the alley
in Block 6, Pettit's Second Addition
3 UTILITIES All municipal utilities are available to the site
4 LAND USE AND ZONING The property is currently zoned C-1 and is
vacant The properties to the south, east and west are zoned C-1 and the property
to the north is zoned R-2
Land use of the surrounding properties is as follows
North- Residential -Duplexes and single family homes
South- Armored Car Dispatch building
East- Residences -Duplexes and single family homes
West- Vacant and Franklin County P U D officies
5 COMPREHENSIVE PLAN The Comprehensive Plan designates this area as a
transiton between the Redevelopment District and a Commercial District The
Redevelopment District encourages developments which will benefit the
surrounding properties and the downtown business district The policies of the
commercial district are geared towards locating commercial uses at appropnate sites
with sufficent on-site improvements This plan was created over 13 years ago and
the land uses designations are a carry over from the 1960's plan to develop Clark
Street as commercial
6 ENVIRONMENTAL DETERMINATION This proposal has been issued a
determination of nonsignificance in accordance with review under the State
Environmental Policy Act (SEPA), Chapter 43 21(c) RCW
CONCLUSION
The site is located one half of a block north of Clark Street and surrounded on two sides
by residential development at densities permitted in the R-2 district The site has very
limited visibility from Clark Street and considenng the availability of vacant land fronting
on Lewis Street and Clark Street in the area, development of this site as currently zoned is
unlikely The applicant is proposing to rezone the site to R-2 (Medium Density Residential)
and develop single family homes on 6,500-7,000 sq ft lots The R-2 zone allows single
family units, duplexes and apartments provided there is 5,000 sq ft or more per unit
Although the applicant is expressing interest in developing the sites for single family
homes, considering the surrounding uses this site would also be an appropnate location for
multi family residential uses provided the densities are consistant with the established uses
FINDINGS OF FACT
The Planning Commission must make findings of fact relating to consistency with the
comprehensive plan, effect on surrounding properties, merits to the community, the need
for conditions to address adverse impacts and whether or not a concomitant agreement
should be required
The proposal is consistant with the goal of the Redevelopment District to benefit the
downtown area because this will potentially eliminate a vacant site at the western edge of
the downtown area This proposal should not have a negative impact on the surrounding
properties since it would allow development similar to the existing uses The proposal has
merit in that it would allow for the development of adition housing units and eliminates a
non viable zoning designation with has severly limited the development potential of the site
the proposq wil not have negative impacts on the surrounding properties therefore a
concomitant agreement is not neded
Considering this proposal
• Replaces a non-viable zoning designation with a viable and realistic designation,
• Would not create any land use compatibility problems,
• Would allow for the development of affordable housing units,
• Staff recommends the property be rezoned from C-1 to R-2
RECOMMENDATION
MOTION I move based on the findings of fact as stated, the Planing Comission
recommend the City Council rezone Lots 4-12 Block 6, Pettit's Second
Addition from C-1 (Retail Business) to R-2 (Medium Density Residential)

PLANNING COMMISSION MINUTES
The May 19, 1994 meeting of the Planning Commission was called to
order at 7 00 p m, by Chairman Leonard Dietrich

APPROVAL OF MINUTES
Chairman Dietrich asked if there were any additions or
corrections to the minutes of April 21, 1994 9
Commissioner Williams moved seconded by Commissioner Hay
that the minutes be approved as written
The vote was unanimous
PUBLIC HEARINGS
A REZONE C-1 TO R-2 (Southwest Corner of 12th and
Bonneville) (MF #94-32-Z)
Staff stated notice of the meeting had been published in the
Tn-City Herald and properties within 300 feet of this site had been
notified of this hearing
Staff explained the zoning and the surrounding land uses for the
benefit of the Planning Commission and the fact that this area had been
designated as a commercial corridor in the 1960's Staff explained the
surrounding land use were residential in nature except those fronting
Clark Street were commercial in nature Staff explained the vision of
the 1960's had not evolved, therefore, it would be appropriate to
consider rezoning this property to a residential district similar to that of
the surrounding zones
Chairman Dietrich opened the public hearing by asking if there
was anyone who wished to speak in favor of this proposed rezone 9
Glen Stroud, stockholder in V I Investors, was present to speak in
favor of this proposal Mr Stroud stated he wished to develop four
single-family three bedroom homes on this site and was present to
answer any questions
Chairman Dietrich asked if there was anyone else present to speak
in favor of this rezone'?
None were present
Chairman Dietrich asked if there was anyone present to speak
against this rezone?
None were present
Chairman Dietrich closed this portion of the public hearing
Commissioner Chamberlin questioned Mr Stroud if he had any
units in the area'?
Mr Stroud stated he recently sold the units he had previously in
this general vicinity
Commissioner Mabry questioned the applicant as to whether or
not this properties would be for rental or for sale
Mr Stroud stated his intention was to sell the individual homes
Commissioner Hay reviewed the findings of fact as printed for the
benefit of the Planning Commission and the audience
Commissioner Williams moved seconded by Commissioner
Chamberlin that the Planning Commission recommend the City Council
rezone Lots 4-12, Block 6, Pettit's Second Addition from C-1 to R-2
The vote was unanimous
Staff stated the appeal process for all present
