AN ORDINANCE concerning aliens and firearms, and repealing Ordinance No 2989 and Section 9 24 080 of the Pasco Municipal Code WHEREAS, by State Legislation effective June 9, 1994, the City of Pasco has been pre-empted from enforcement of Section 9 24 080 of the Pasco Municipal Code, now, therefore, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO ORDAIN AS FOLLOWS: §1. Ordinance No 2989 and Section 9 24 080 of the Pasco Municipal Code titled "ALIENS LICENSED TO CARRY FIREARMS-EXCEPTION" are both hereby repealed §2. REFERENCE(S) Attached Ordinance II. ACTION REQUESTED OF COUNCIL MOTION: I move to adopt Ordinance No , repealing Ordinance No 2989 and PMC Section 9 24 080 concerning aliens and firearms III. FISCAL IMPACT None IV. HISTORY AND FACTS BRIEF Earlier this year, the City Council adopted Ordinance No 2989 creating Section 9 24 080 of the Pasco Municipal Code This code section made it unlawful for non-citizens to have in their possession or to carry a firearm without a special license from the Director of the Department of Licensing Violation of the code section was a misdemeanor This last Legislative Session the Legislature passed legislation making this offense a Class "C” Felony, which is beyond the Jurisdiction of the Pasco Municipal Code and our Municipal Court The Legislature also spelled out the procedure for anyone desiring to secure such a license V. DISCUSSION Staff recommends that the Ordinance be adopted since the City is now precluded from enforcement of PMC 9 24 080 VI OTHER COMMENTS VII. ADMINISTRATIVE ROUTING
