ORDINANCE NO.30eD
AN ORDINANCE vacating a portion of "B" Street abutting Lot 10, Block 4,
Riverside Addition
WHEREAS, a petition signed by more than two-thirds of the owners of the
property abutting the street right-of-way herein below descnbed has been submitted to
the City Council of the City of Pasco, and,
WHEREAS, all steps and procedures required by law to vacate said right-of-
way have been duly taken and performed, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON,
DOES ORDAIN AS FOLLOWS:
Section 1. That north 10 feet of "B" Street abutting Lot 10, Block 4, Riverside
Addition, as depicted in Exhibit "1" be and the same is hereby vacated subject to the
easement retained in Section 2 hereof
Section 2. That the city shall retain an easement and the right to exercise or
grant easements with respect to the north 10 feet of "B" Street abutting Lot 10, Block 4,
Riverside Addition
Section 3 That a certified copy of this ordinance be recorded by the City Clerk
of the City of Pasco in and with the office of the Auditor of Franklin County,
Washington
Section 4. This ordinance shall be in full force and effect after passage and
publication as required by law
PASSED by the City Council of the City of Pasco, at its regular meeting, June 6,
1994

II. ACTION REQUESTED OF COUNCIL/STAFF RECOMMENDATIONS:
CONDUCT OF PUBLIC HEARING
MOTION- I move to adopt Ordinance No , vacating the north 10 feet
of "B" Street abutting Lot 10, Block 4, Riverside Addition
III. FISCAL IMPACT:
NONE
IV. HISTORY AND FACTS BRIEF:
A Property owners representing 100% of the abutting privately held ownership of
the area in question have requested said right-of-way be vacated
B A recent survey of the property for FHA financing indicated the structure on the
southwest corner of the property encroached nine feet (9') into the "B" Street right-
of-way To clear up the situation for FHA financing, the owner has requested the
north 10 feet of "B" Street be vacated
V. DISCUSSION:
A The Public Works Director and the City Engineer have stated their approval for
the proposed vacation and have not requested an easement be retained
B The Franklin County P U D has requested an easement be retain on the area
proposed for vacation Staff recommends this proposed vacation provided an
easement is retained as requested The attached ordinance would vacate the rights-of-
way and retain the easements as requested
