HomeMy WebLinkAbout3019 Ordinance - RecordedATHERINE D SEAM4N %. 4 OFri c ,4 0 ••I .7; Deputy City Clerk VO L O3I18 P G08 7 0 ORDINANCE NO.30 I C\ AN ORDINANCE vacating Duluth Street from Oregon Avenue to California Avenue WHEREAS, a petition signed by more than two-thirds of the owners of the property abutting the street right-of-way herein below described has been submitted to the City Council of the City of Pasco, and, WHEREAS, all steps and procedures required by law to vacate said right-of- way have been duly taken and performed, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DOES ORDAIN AS FOLLOWS: Section 1. That Duluth Street from the east right-of-way line of Oregon Avenue to the west right-of-way line of California Avenue, as depicted in Exhibit "1" be and the same is hereby vacated subject to the easement retained in Section 2 hereof Section 2. That the city shall retain an easement and the right to exercise or grant easements with respect to the north 10 feet of Duluth Street from the east right-of- way line of Oregon Avenue to the west right-of-way line of California Avenue Section 3 That a certified copy of this ordinance be recorded by the City Clerk of the City of Pasco in and with the office of the Auditor of Franklin County, Washington Section 4. REFERENCE(S): A Street Vacation Plan adopted May 18, 1992 B Proposed Ordinance C Vicinity Map II. ACTION REQUESTED OF COUNCIL/STAFF RECOMMENDATIONS: CONDUCT OF PUBLIC HEARING MOTION: I move to adopt Ordinance No , vacating Duluth Street from Oregon Avenue to California Avenue located in Frey's Addition III. FISCAL IMPACT: NONE IV. HISTORY AND FACTS BRIEF: A Property owners representing 100% of the abutting privately held ownership of the area in question have requested said right-of-way be vacated B Because of the excessive undeveloped rights-of-way in this area, a street vacation plan was developed to insure that future utility provision and the transportation system would not be negatively affected by piece by piece street vacations This plan was adopted by the City Council on May 18, 1992 V. DISCUSSION: A These right-of-ways are not indicated as "keeper" streets on the Oregon Avenue Corridor Street Vacation Plan The Public Works Director and the City Engineer have stated their approval for the proposed vacation and have not requested an easement be retained B The Franklin County P U D has requested an easement be retain on the northern 10' of Duluth Street between Oregon Avenue and California Avenue Staff recommends this proposed vacation provided an easement is retained as requested The attached ordinance would vacate the right-of-way and retain the easement as requested VI.
