HomeMy WebLinkAbout3018 Ordinance - Recorded/ CATHERINE D SEAMAN Deputy City Clerk V O LO 3 6 P60 1 97 , 503553 ORDINANCE NO.30/ S AN ORDINANCE vacating Main Avenue from Superior Street to Pueblo Street and Superior Street from Oregon Avenue to the western edge of Frey's Addition WHEREAS, a petition signed by more than two-thirds of the owners of the property abutting the street right-of-way herein below described has been submitted to the City Council of the City of Pasco, and, WHEREAS, all steps and procedures required by law to vacate said right-of- way have been duly taken and performed, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DOES ORDAIN AS FOLLOWS: Section 1. That Main Avenue from the north right-of-way line of Superior Street to the north right-of-way line of Pueblo Street and Superior Street from the western right-of-way line of Oregon Avenue to the western edge of Frey's Addition all located in the Frey's Addition, as depicted in Exhibit "1" be and the same is hereby vacated subject to the easement retained in Section 2 hereof Section 2. That the city shall retain an easement and the right to exercise or grant easements with respect to the Main Avenue right-of-way from the north right-of- way line of Superior Street to the north right-of-way line of Pueblo Street and the north 10' of Superior Street from the western right-of-way line of Oregon Avenue to the western edge of Frey's Addition , Section 3 That a certified copy of this ordinance be recorded by the City Clerk of the City of Pasco in and with the office of the Auditor of Franklin County, Washington Section 4. HISTORY AND FACTS BRIEF: A Property owners representing 100% of the abutting privately held ownership of the area in question have requested said nght-of-way be vacated B Because of the excessive undeveloped rights-of-way in this area, a street vacation plan was developed to insure that future utility provision and the transportation system would not be negatively affected by piece by piece street vacations This plan was adopted by the City Council on May 18, 1992 V. DISCUSSION• A These right-of-ways are not indicated as "keeper" streets on the Oregon Avenue Corridor Street Vacation Plan The Public Works Director and the City Engineer have stated their approval for the proposed vacation provided a full width easement is retained on Main Avenue to protect an existing sewer line The City Engineer stated the development of Main Avenue as platted would create traffic circulation problems due to the angle the Main Street right-of-way intersects the Oregon Avenue right-of- way B The Franklin County P U D has requested an easement be retain on the eastern 10' of Main Avenue abutting Oregon Avenue and along the north 10' of Superior Street between Oregon Avenue and the western edge of Frey's Addition U S West has requested a 10' easement adjacent to and extending northerly along the eastern boundary of Block 29 Frey's Addition Staff recommends this proposed vacation provided easements are retain as requested The attached ordinance would vacate the rights-of-way and retain the easements as requested VI.
