ORDINANCE NO. -361
AN ORDINANCE vacating portions of Chestnut Avenue and "B" Street rights-
of-way in Block 1, Owens Addition
WHEREAS, a petition signed by more than two-thirds of the owners of the
property abutting the alley right-of-way herein below described has been submitted to
the City Council of the City of Pasco, and,
WHEREAS, all steps and procedures required by law to vacate said right-of-
way have been duly taken and performed, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON,
DOES ORDAIN AS FOLLOWS:
Section 1. That the east 10' of Chestnut Avenue, abutting Lots 17- 32, Block
1, Owens Addition and the north 10' of "B" Street abutting Lots 16 and 17, Block 1,
Owens Addition, as depicted in Exhibit "1" be and the same is hereby vacated
Section 2 That a certified copy of this ordinance be recorded by the City Clerk
of the City of Pasco in and with the office of the Auditor of Franklin County,
Washington
Section 3. This ordinance shall be in full force and effect after passage and
publication as required by law
PASSED by the City Council of the City of Pasco, at its regular meeting, April

AN ORDINANCE vacating the street right-of-way in Block 1, Owens
Addition
WHEREAS, a petition signed by more than two-thirds of the owners of the
property abutting the street right-of-way herein below described has been submitted to
the City Council of the City of Pasco, and,
WHEREAS, all steps and procedures required by law to vacate said right-of-
way have been duly taken and performed, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON,
DOES ORDAIN AS FOLLOWS:
Section 1. That the north/south alley right-of-way located in Block 1,
Owen's Addition, as depicted in Exhibit "1" be and the same is hereby vacated subject
to the easement retained in Section 2 hereof
Section 2. That the city shall retain an easement and the right to exercise or
grant easements with respect to the north/south alley located in Block 1, Owen's
Addition
Section 3 That a certified copy of this ordinance be recorded by the City Clerk
of the City of Pasco in and with the office of the Auditor of Franklin County,
Washington
Section 4. This ordinance shall be in full force and effect after passage and
publication as required by law

II. ACTION REQUESTED OF COUNCIL/STAFF RECOMMENDATIONS:
CONDUCT OF PUBLIC HEARING
MOTION. I move to adopt Ordinance No , vacating the nghts-of-way
abutting Block 1, Owens Addition
III. FISCAL IMPACT.
NONE
IV. HISTORY AND FACTS BRIEF:
A Property owners representing 78% of the abutting privately held ownership of the
area in question have requested said right-of-way be vacated
B A recent land survey indicated the building at the northeast corner of Chestnut
Street and "B" Street was actually located on a portion of the right-of-way requested
for vacation
V. DISCUSSION:
A The City Engineer, Franklin County P U D and other involved utilities have
stated there is not a need for retaining this portion of the Chestnut Street and "B"
Street rights-of-way for existing or future utilities
B Since the structure is already located on a portion of the right-of-way requested
for vacation, the involved utilities do not need this portion of the right-of-way and the
fact the area was platted with 80' rights-of-way (60' is standard except for arterials)
which are unnecessarily large, staff recommends the right-of-way in question be
vacated
