AN ORDINANCE related to vehicles and traffic and amending PMC Section
10 52 030
WHEREAS, the City Council has determined that code provisions for
regulating the parking of trucks in residential districts need clarification to
provide for the stability and enhancement of residential neighborhoods, NOW,
THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON
DOES ORDAIN AS FOLLOWS
Section 1 That PMC Section 10 52 030 (4) is hereby amended to read as
follows
(4) No vehicle with a maximum gross weight of fourteen thousand pounds
or more shall park overnight on any anywhere on or off the street in a
residential zone of the city, except parking on residential streets may be
permitted in the course of making deliveries as provided in Section
10 64 020 "Maximum gross weight" means the scale weight of any
motor vehicle, truck, truck tractor, trailer or semitrailer to which shall
be added the maximum load to be carried thereon as set by the licensee
in his application for a license or as marked on the vehicle, whichever is
greater A street is in a residential zone for purposes of this chapter if
any property on either side of the street is in a residential zone, each
block of the street will be treated as a corporate unit for purposes or
determimng whether overrught parking will be permitted
Section 2 This ordinance shall be in full force and effect after passage
publication as required by law

IV HISTORY AND FACTS BRIEF
A There is a growing problem within the community related to the parking and
storing of large trucks in residential areas
B While the city has several code provisions that have been used to require trucks
to be removed from residential neighborhoods, these codes are not direct enough
for the courts
C The attached code amendment would provide the direct language that is needed
to assist in keeping trucks out of residential neighborhoods
