HomeMy WebLinkAbout3007 OrdinanceORDINANCE NO.300 71 AN ORDINANCE amending Ordinance No 2348 concerning bus zones, and amending §10 52 060 to the Pasco Municipal Code WHEREAS, the Pasco City Council having determined that where consent of adjacent property owners has been secured the City Engineer should proceed with the approval of bus stops where appropriate without city council hearing, now, therefore, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DOES ORDAIN AS FOLLOWS: §1. Ordinance No 2348 and §10 52 060 of the Pasco Municipal Code is hereby amended to read as follows (deletions shown by interdelineations and additions by underlining) 10 52 060 BUS ZONES - LOCATION The Benton-Franklin Public Transportation Benefit Authority (BFPTBA) may at its sole expense and liability, at the locations, designated by resolution duly passed by the Pasco City Council, or approved by the City Engineer under circumstances set forth below, erect and maintain a uniform sign or signs approved by the city Director of Public Works, giving notice of a bus stop and prohibiting parking In so doing, the BFPTBA agrees to indemnify and save the city harmless from any and all claims, objects, costs and expenses whatsoever arising out of BFPTBA activities and the acts of BFPTBA employees, including, but without limitation, reasonable attorney's fees and costs incurred by the city in defending itself against such claims or in establishing its rights to indemnity as provided herein The City Engineer may approve bus stop locations where he deems appropriate and where the adjacent property owner(s) provides written consent Without such consent, or where the City Engineer has denied the requested bus stop location, the BFPTBA may submit to the city council for its consideration the proposed bus stop location and the adjacent property owner(s) as well as the BFPTBA shall have the opportunity to state their respective positions The maximum length of a bus stop shall be sixty (60) feet • • a uniform traffic control devices, guidelines and requirements Ordinance No. 3 0 q Page 1 CATHERINE D SEAMAN Deputy City Clerk AT R TELLO torney §2. Proposed Ordinance. II ACTION REQUESTED OF COUNCIL / STAFF RECOMMENDATIONS MOTION: I move to adopt Ordinance No. concerning the approval process for bus stops. III FISCAL IMPACT None IV HISTORY AND FACTS BRIEF Recently, Council requested that the staff look into the feasibility and desirability of making the approval process for bus stops an administrative (staff) function as opposed to a legislative (Council) function Staff believes that such a change is generally feasible and desirable Back in 1982, when the bus routes and stops were first established, Council directed that bus stops be created by Council resolution as evidenced by the passage of Ordinance No 2348, (May 29, 1982), which set forth that requirement Further, as a matter of policy, Council stated that in any case where there is on-street parking and the adjacent property owner would not sign a written consent to the proposed creation of the bus stop and their associated loss of parking, that a hearing before City Council was to be held It is staffs view that this was and is a good policy Staff recommends bus stop locations be approved by the City Engineer, if the adjacent property owner provides written consent Without such consent, the proposed location would be submitted to the Council and the adjacent owner would have the opportunity to state his case to Council If Council finds this proposal acceptable/appropriate, the City Attorney will prepare an ordinance reflecting the changes proposed above cc Greg Rubstello, City Attorney Dennis Wright, City Engineer ORDINANCE NO. 2348 AN ORDINANCE allowing for and creating bus zones where parking is prohibited THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN AS FOLLOWS: Section One. Chapter 10 52 of the Pasco Municipal Code is hereby amended by the addition of Section 10.52 050 which shall read as follows 10.52.050 BUS STOPS. When a sign or signs are erected giving notice of a bus stop, no uerson shall park a vehicle within the area designated on the sign or signs. Section Two Chanter 10.52 of the Pasco Municipal Code is ‘ hereby amended by the addition of Section 10.52.060 which shall read as follows. 10 52 060 BUS ZONES-LOCATION. The Benton- Franklin Public Transportation Benefit Authority (BFPTBA) may at its sole expense and liability, at the locations designated by resolution duly passed by the Pasco City Council, erect and maintain a uniform sign or signs, approved by the City Director of Public Works, giving notice of a bus stop and prohibiting parking. In so doing the BFPTBA agrees to indemnify and save the city harmless from any and all claims, objects, costs and expenses whatsoever arising out of BFPTBA activities and the acts of BFPTBA employees, including, but without limitation, reasonable attorney's fees and costs incurred by the city in defending itself against such claims or in establishing its rights to indemnity as pro- vided herein. The maximum length of a bus stop shall be sixty (60) feet. Placement and content of signs shall conform to the Manual on Uniform Traffic Control Devices guidelines and requirements. Section Three.
