3005 Ordinance
ORDINANCE NO, 1 OC:15-- AN ORDINANCE relatin g to land use and vehicle parkin g amendin g both Title 22 and Title 10 enactin g new provisions for recreational vehicle parkin g within the community WHEREAS, the City Council appointed a Residential Propert y Maintenance Standards Task Force that was char ged with the responsibilit y of studyin g conditions within residential environments that tend to detract from and impact the welfare of residential nei ghborhoods, and, WHEREAS, the Task Force determined that recreational e q uipment stora ge on public streets creates parkin g con gestion and creates visibilit y hazards that j eopardize the safet y of both motorists and pedestrians, and, WHEREAS, recreational e quipment stored on residential streets creates conflicts between nei ghborhoods are attractive nuisances, and add to visual clutter in residential areas, and, WHEREAS, the Plannin g Commission reviewed the Task Force recommendations throu gh the public hearin g process and determined that the parkin g of recreational e quipment in public wa y s for len gthy periods of time is tantamount to the unlimited stora ge of vehicles therein, and the utilization or defacto reservation of space for stora ge purposes to the exclusion of other persons desirin g to use such space for the purpose of stoppin g , standin g or parkin g of vehicles, and, WHEREAS, R C W 46 61 570(4), states it is unlawful for an y person to reserve or attempt to reserve an y portion of a hi ghway for the purpose of stoppin g , standin g , or parkin g to the exclusion of an y other like person, nor should an y person be granted such a ri ght, and, WHEREAS, the Cit y Council has reviewed the recommendations of the Plannin g Commission and finds that said recommendations will further the g eneral health, safet y and welfare of the communit y NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO ORDAIN AS FOLLOWS Section 1 That PMC Chapter 22 12 is hereb y amended to include a new subsection 22 12 107, 22 12 563, 22 12 195, 22 12 197, 22 12 713, 22 12 815, to read as follows 22 12 107 BOAT Shall mean an y ty pe of water craft, whether re gistered or unre gistered, licensed or unlicensed The term boat shall include an y wheeled trailer or other device on which such boat is or ma y be kept, stored, or transported, whether re gistered or unre gistered, licensed or unlicensed 22 12 563 MOTOR HOME Shall mean a vehicular t y pe of unit or device, whether licensed or unlicensed, primaril y desi gned as a temporar y livin g q uarters for recreation, campin g , or travel use, which contains its own motive power 22 12 195 CAMP TRAILER/TRAVEL TRAILER/FIFTH WHEEL Shall mean a structure desi gned to provide temporar y livin g q uarters for recreational campin g or travel use, constructed with inte gral wheels to make it mobile and/or towable b y motor vehicle 22 12 197 CAMPER (Pickup) Shall mean a structure desi gned to be mounted on a pickup or truck chassis and with sufficient e q uipment to render it suitable for use as a temporar y dwellin g for recreational use, campin g or vacation use 4, Page 1 22 12 713 SNOWMOBILE Shall mean a vehicle with a continuous tread and runner type steering device used pnmanly for over-snow travel 22 12 815 UTILITY TRAILER Shall mean a vehicular structure or device with or without its own mode of power, licensed or unlicensed, designed and/or used for the transportation of goods, equipment, other vehicles or devices, and materials Section 2 That PMC chapter 10 52 is hereby amended to include a new subsection 10 52 030 (6) to read as follows Section 10 50 030 (6) No boat, motor home, camp trailer, travel trailer, fifth wheel, pickup camper, snowmobile, or utility trailer as defined in Title 22 shall be stored or maintained on any public street, right-of-way or other public area, except such items may be parked in public right-of-way in front of an owner's property for a period of 72 hours in any given 2-week period for loading and unloading purposes Guests of the owner may temporarily park in public right-of-way in front of the owner's property for a period of 72 hours in any given 2-week period only if the motor home of the guest cannot be accommodated, due to size, on the owner's driveway Section 3 That PMC chapter 22 84 is hereby amended to include a new subsection 22 84 027 to read as follows Section 22 84 027 RECREATIONAL EQUIPMENT PARKING Boats, motor homes, camp trailers, travel trailer, fifth wheels, pickup campers, utility trailers, and snowmobiles as defined herein may be stored in all yard areas within the R-1, R-2, R-3, R-4 and R-5 districts, and only within the side and rear yards in the R-S-20, R-S-12 and R-1-S districts All storage areas shall be surfaced with all-weather materials such as asphalt, brick, stone, concrete or gravel Additionally, the storage and parking of said items in residential districts shall, at all times, comply with the parking conditions in Sections 22 84 023 and 22 84 025 Bonified guests of the occupants of the premises may temporarily park on driveways for periods not to exceed 10 days in any 60 day period Section 4 This
