AN ORDINANCE relating to zoning and changing the classification of certain real
property within the City of Pasco from C-1-D (Designated
Shopping Center) to C-1, BP & RT (Retail Business/ Business
Park/ Residential Transition) and RT (Residential Transition) to C-1,
BP & C-3 (Retail Business/ Business Park/ General Business) with
a concomitant agreement
THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS
FOLLOWS:
Section 1. That the zone classification of the following described real property
situated in Pasco, Franklin County, Washington to-wit
A portion of the southwest quarter of Section 8, Township 9 North, Range 29 East, W M,
situated in the City of Pasco, Franklin County, Washington, being further described as
follows
Beginning at the southwest corner of said Section 8, thence along the south line of said

CONCOMITANT ZONING AGREEMENT
WHEREAS, the City of Pasco, Washington, a non-chartei code city,
uncle' the laws of the State of Washington (Chaptci 35A 63 R.0 W. and
Ai ticle 11, Section 11 of the Washington State Constitution) has
autholity to enact laws and entei into agieements to pionlOte the
health, safety and welfaie of its citizens, and theteby control the use
and development of plopet ty within its jurisdiction, and

WHEREAS, the Ownei(s) of certain propel ty have applied for a
rezone of such pioperty desciibed below within the City's jui isdiction,

WHEREAS, the City pursuant to R C W 43.12(c), the State
Environmental l'olicy Act, should mitigate any advei se impacts which
might icsult because of the proposed rezone; and
WHEREAS, the City of Pasco and the Owner(s) ale both interested
in compliance with the Pasco Municipal Code provisions ielating to the
use and development of propel ty situated in the City of Pasco,
descilbed as follows,

WHEREAS, the Ownei(s) have indicated willingness to cooperate
with the City of Pasco, its Planning Commission and Planning

WHEREAS, the City, in addition to civil and criminal sanctions
available by law, desnes to enfoice the rights and inteiests of the public

of Pasco to C-3 (General Business) and in consideration of that event
should it occur, and subject to the tel ms and conditions helemaftei
stated, the applicant does hereby covenant and agree as follows

that, it would be appropriate to amend the Comprehensive Plan and it would be
appropriate to recommend a change in zoning for this particular property, provided it
was conditioned by a Concomitant Agreement

extending 1 mile to the east around the freeway and to the southern edge of the sand
dunes

2 ACCESS The site has access from Rd 100 and Broadmoor road Interstate 182
bisects the property and the interchange of Rd 100/ Interstate 182 is located on the
western boundary
3 UTILITIES Municipal water will have to be extended from the Rd 68 standpipe
The City also plans to extend a pressurized sewer system to handle the initial
demands of development at Rd 68 and Rd 100 in early to mid-1994
4 LAND USE AND ZONING The property is currently zoned C-1-D
(Designated Shopping Center) and RT (Residential Transition) and is either vacant
or in agricultural production Land use of the surrounding properties is as follows

5 COMPREHENSIVE PLAN The area within 1/3-1/2 mile of the Rd 100/1-182
interchange is designated as Commercial while the remainder of the property is
designated Mixed Residential The plan encourages neighborhood shopping
facilities, specialty centers, service and office uses in the Commercial designations
and single family, townhouses and apartments at a density of 5-15 units per acre in
the Mixed Residential designated areas Policy 1 3 of the Commerce element
stresses the importance of recognizing the potential for and promoting the
establishment of a regional shopping facility within the community Policy 1 5 of
the Commerce element encourages the concentration of commercial uses which are
functionally and economically beneficial to each other Policy 1 2 of the Residential
element states the importance of providing a variety of residential densities through
the community
6 ENVIRONMENTAL DETERMINATION This proposal has been issued a
determination of nonsignificance in accordance with review under the State
Environmental Policy Act (SEPA), Chapter 43 21(c) RCW
CONCLUSION
Comprehensive Plan
The proposal to rezone the southeast quarter and a portion of the northwest quarter of
Section 8-9-29 to various commercial and office designations conflicts with the land use
designations of the Comprehensive Plan The remaining part of the proposal is consistent
with the land use designations and the policies of the Comprehensive Plan The updated
Comprehensive plan for the 1-182 corridor was developed in 1992 with the understanding
the area reviewed was quite large and void of development, therefore making specific
determinations for a 7 square mile vacant area would not be practical Flexibility was built
into the plan to allow revisions when more specific development plans were formulated
Considering the City of Pasco's and the property owners intentions to utilize the Rd 100/
1-182 for the highest and best use and the potential for regional commercial activities in the
area redesignating a portion of the property to a commercial designation seems appropriate
Initially staff had considered designating a larger area as commercial but this was scaled
back due to doubts the area would be developed solely for commercial uses
If the Planning Commission feels amendment of the Comprehensive Plan to a replace the
Mixed Residential designation with a Commercial designation is appropriate, then
redesignating the southeast quarter and a portion of the northwest quarter of Section 8-9-29
should follow
Zoning
The property owner, Metropolitan Mortgage and Securities Co Inc Developed plans to
establish a campus type office park on the properties lying south of Interstate 182 and a
Factory Outlet Mall, hotel/motel, neighborhood shopping facility, cultural/civic center and
mixed residential development north of the freeway The applicant has not formulated a
specific plan for the east half of the southeast quarter of Section 8-9-29 but has developed a
list of potential land uses which appear realistic and compatibly considering the proposed
surrounding uses
, The rezone requests the C-1 -D (Designated Shopping Center) district be changed to C-1
(Retail Business), BP (Business Park) & RT (Residential Transition) The major
differences between the C-1-D and C-1 zoning district are the C-1-D district requires a 2
acre minimum lot size and the site plans must be reviewed by the Planning Commission
This part of the proposal will have a minor affect on the permitted uses on the property and
many of the improvements potentially required by the Planning commission are now
required by the municipal code Considering the recent updates to the landscaping, parking
and screening codes to address land use compatibility and aesthetics it would be appropriate
to rezone the properties from C-1-D to C-1
The applicant is requesting a portion of the C-1-D property be rezoned to RT which is a
"down-zoning" from a commercial district to a residential district The applicant intends to
build/ construct/ develop the site with mixed residential uses as designated by the
Comprehensive Plan Until final plans are formulated the applicant does not want a specific
residential zoning designation placed on the property but the indication from the City of
Pasco that when appropriate infrastructure is in place the property may be developed for
residential uses Rezoning the property to RT would give the applicant this assurance and
would preclude development until the area was ready
The applicant has requested the RT (Residential Transition) zoned property be changed to
C-1 (Retail Business), BP (Business Park) and C-3 (General Business-with conditions
prohibiting certain land uses deemed as incompatible) An Factory Outlet Mall is planned
on the western portion of the RT zoned properties lying north of the freeway while a
portion of the proposed business park is located on the RT zoned property lying south of
the freeway The proposal also includes a request to rezone the eastern portion of the RT
zoned property lying north of the freeway to C-3 with conditions prohibiting uses deemed
as incompatible
The request for C-1 zoning for the Factory Outlet Mall would fit with the proposed uses in
the area and utilizes the prime access the Rd 100/1-182 interchange provides BP zoning
on a portion of the property zoned RT lying south of the freeway would be a logical
extension of the proposed business park The request to rezone the east half of the RT
zoned property lying north of the freeway to C-3 with conditions appears appropriate
provided certain land uses are prohibited This would allow the applicant to pursue a tenant
such as a home supply/ improvement store, gardening/ landscaping store etc without
concerns about storage of materials outside If rezoned to C-3 the landscaping and
screening provisions of the municipal code would remain as requirements, so the materials
would be stored in an "appropriate" manner, but a limitation on the amount of outdoor
storage would not apply The applicant has requested the C-3 designation so the property
can be marketed for the home improvement type uses without regulations clouding the
permitted uses of the property The applicant has requested several of the land uses listed as
permitted in the C-3 be prohibited as assurance the development on the site will not have a
detrimental effect on the surrounding properties
FINDINGS OF FACT
The Planning Commission must make findings of fact relating to consistency with the
comprehensive plan, effect on surrounding properties, merits to the community, the need
for conditions to address adverse impacts and whether or not a concomitant agreement
should be required
The proposal is consistent with the general policies of the plan but, some of the land
requestO for commercial zoning conflicts with the Comprehensive Plan land use map
Amendment of the plan, as recommended by staff to increase the amount of land designated
for commercial activities would bring the proposal into consistency with the
Comprehensive Plan
This proposal has a positive effect on the surrounding properties because it will allow the
area to be developed and utilize a freeway interchange as envisioned when constructed The
Rd 100 interchange was constructed to provide traffic access from the freeway to support
large volumes of traffic generated by major commercial and residential developments m the
area
The Rd 100 interchange is geographically centered in the Tri-Cities and is ideally suited to
serve regional commercial facilities The proposal should act as a catalyst for development
in the Rd 100/1-182 area This proposal has the potential to bnng development to the City
of Pasco on a scale not previously expenenced
The proposal appears compatible with surrounding and potential uses except for the land
requested for C-3 zoning There is a need for conditions to address some of the potential
adverse impacts the penrutted land uses in the C-3 zoning distnct may create
A Concomitant Agreement should be required to prohibit the potentially adverse land uses
permitted in the C-3 zone The following uses should be prohibited, Laundry, Express
Office, Heavy Machinery (sale & service), Warehouses (EXCEPT- Mini-storage),
Automobile Sale and Service and Mobile Home Sale and Service
Considering this proposal
• Allows the development of a regional commercial/ office facility in an appropnate
location,
• Is located adjacent to a 6-lane freeway and a interchange,
• Would act as a catalyst for development in the Rd 100/1-182 comdor,

Commissioner Mabry questioned staff whether or not this would clean up
similar situations around town?
Staff stated this would only eliminate the non-conforming use situation on
the property in question
Commissioner Chamberlin stated it was time to bring this land use into
conformity with the zorung
Commissioner Hay moved seconded by Commissioner Malachi based upon
the findings of fact, the Planning Commission recommend the City Council rezone
Lot 11, Buck's Second Addition from R-3 to C-1
The vote was unanimous
Staff stated the appeal process for all present

Staff stated that notice had been published in the Tri-City Herald and
property owners within 300 feet of this site had been notified of this public
hearing Staff did receive one telephone call from Daryl Peterson, property owner
in the area with questions on the proposal Staff explained the existing zmung
and comprehensive plan designations and the process involved with developing
the comprehensive plan Staff explained the differences between the C-1-D and
C-1 zoning districts and the affect the newly adopted parking, landscaping and
screen regulations would have upon the proposal Staff also reviewed the proposed
zoning designations and amendment of the comprehensive plan. Staff explained
the existing freeway interchange location and utilities being extended to the area
and the potential for commercial development at this interchange. Staff did
recommend that the property be rezoned as requested and the comprehensive
plan be amended so the zoning would be in conformity with that plan
Chairman Dietnch opened the public hearing by asking if there was anyone
present who wished to speak in favor of this proposal?

Mike Briggs, Metropolitan Mortgage, 2211 West Court Street, was present
to speak in favor of this proposal Mr Briggs stated he was in agreement with the
city's recommendation and with the limitations placed upon the C-3 zoning distnct
to prohibit certain non-compatible uses Mr Bnggs stated he was in agreement
with the amendment of the comprehensive plan and Metropolitan Mortgage desire
to move the residential uses away from the freeway and utilize that for
commercial activities He also thanked the City of Pasco and staff for assistance
and help they had provided up to this point
Wayne Wilson, property owner in the area was present to speak in favor of
this proposal Mr Wilson stated he respected the expertise of Metropolitan
Mortgage and was in complete support of this rezone Mr Wilson urged the City
of Pasco to grant this rezone request to allow development in the 182 area
Mike Martin, neighboring property owner to the east was present to speak
in favor of this proposal He had a question regarding the jog indicated in
Broadmoor Road and whether or not this would line up with the existing
Broadmoor Road and how this would affect his property'?
Staff stated the alignment of the road was not an issue at this point,
however, the applicant's intent was to extend the road from the existing right-of-
way to Road 100 There may be a jog in Broadmoor
Mr Martin stated he had no objections to this proposal and was in favor
and supported it
Chairman Dietrich asked if there was anyone else present to speak in
favor of the proposal?
None were present
Chairman Dietrich asked if there was anyone present who wished to speak
against the proposal?
None were present
Chairman Dietrich closed the pubhc hearing
Commissioner Mabry questioned staff as to the policy for transition of uses
and whether or not this would do that?
Staff explained that the proposed designations would be a transition of uses
graduating from commercial uses around the freeway to mixed residential and
then single-family residential working to the north. To the south the city's
circulation plan would require major arterial on the southern boundary therefore
that would act as a buffer to help transition between uses

Commissioner Chamberlin read the findings of fact into the record
Commissioner Chamberlin moved, seconded by Commissioner Mabry that the
Planning Commission amend the comprehensive plan as depicted in Exhibit #1
The vote was unanimous
Commissioner Hay moved seconded by Commissioner Chamberlin based
upon the findings of fact as stated, the Planning Commission recommend the City
Council rezone the C-1-D property to C-1, B-P and R-T and the R-T propety to
C-1, RT and C-3 with conditions placed on the C-3 property prohibiting laundries,
express offices, heavy machinery, sales and serve, warehouse (except mini
storage), auto sales and service, and mobile home sales and service as depicted in
Exhibit #2
The vote was unanimous
Staff stated the appeal process for all present
There being no further business coming before the Planning Commission at
this time, Commissioner Smurthwaite moved seconded by Commissioner Malachi
that the meeting be adjourned The vote was unanimous The meeting was
adjourned at 9 03 p m

ORDINANCE NO.
AN ORDINANCE relating to comprehensive land use planning and amending the
Community Development Policy Plan
WHEREAS, the Pasco City Council did on March 17, 1980 adopt by Ordinance
No 2143 a Community Development Policy Plan for the city, and,
WHEREAS, the Community Development Policy Plan was intended to be a
flexible guide for development and should be periodically reviewed and amended
depending on conditions in community, and,
WHEREAS, the Planning Commission conducted a public hearing on February
24, 1994 and following discussion, unanimously recommended that the land use element
of the Community Development Policy Plan be amended, and,
WHEREAS, the responsible official for the State Environmental Policy Act has
determined the recommend policy plan amendment will not have a probable significant
adverse impact on the quality of the environment, and,
WHEREAS, the City Council finds the Planning Commission's recommendation
will aid the city in anticipating orderly and coordinated development within the city, NOW,
THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS
FOLLOWS:
Section 1. Ordinance No 2143 is hereby amended to show changes in the land
use map of the Community Development Policy Plan as indicated in Exhibit "1" attached
hereto
Section 2. This ordinance shall be in full force and effect after passage and
publication as required by law
