AN ORDINANCE requiring the placement of solid waste containers
behind the front yard set back in residential zoning districts, and amending
Chapter 6 04 of the Pasco Municipal Code by adding new Section 6 04 093
WHEREAS, City Council has determined that containers required for
the storage and collection of solid waste materials by property owners in
residential districts should be required to be placed, except for purposes of
collection, to the rear of the front yard set back line of properties in order to
avoid nuisance problems, protect the public health, and advance __...._ neighborhood aesthetics, now, therefore,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON
DOES ORDAIN AS FOLLOWS
§1. Chapter 604 of the Pasco Mumapal Code is hereby amended by the
addition of new Section 6 04 093, which section shall read as follows
6 04 093 CONTAINER PLACEMENT REQUIREMENTS -
RESIDENTIAL DISTRICTS The storage can or container
required by Section 6 04 090, 6 04 095 or any permitted
supplemental containers shall be placed only, except as
authorized herein, to the rear of the front yard set back line of
any lot, parcel or tract of land in any residential zoning
district of the City Provided, for purposes of collection by the
City's contracted collector, solid waste containers may be
placed at the curb collection site ahead of the front yard set
back line, but only during the twenty-four hour period which
starts at 7 00 p m the day prior to collection and ends at 6 59
p m on the day of collection by the City's contracted solid
waste collector Further, Provided, however, containers
utilized in conjunction with a permitted building
construction project may be placed in the front yard area
during the authorized period of the building permit
§2. This Ordinance shall take effect five (5) days after passage and
publication

Section 1 Permits garbage containers in residential districts to be
placed in front yard areas for only a 24-hour period beginning at 7 00
p m on the day prior to collection and ending at 6 59 p m on the day of
collection
Section 2 Requires the ordinance or the summary herein to be
published before the ordinance is in effect

A At the regular Council meeting of December 20th, the City
Council reviewed and discussed recommendations of the
Residential Property Maintenance Task Force Some of those
recommendations needed further refinement by the City Attorney
prior to Council action
B The attached proposed ordinance dealing with the storage of
garbage containers in residential front yards has been rewritten
by the City Attorney and is ready for Council consideration
V DISCUSSION
The attached ordinance creates a new section under the city's
sanitation code that would preclude storage of garbage containers
within front yard setback areas of residential zones Under the
proposal garbage containers would only be permitted in front
yard areas for a 24-hour period during collection days However,
containers utilized in conjunction with construction projects could
be placed in front yards during permitted construction periods
