HomeMy WebLinkAbout2970 Ordinance_ i 22,-.37,0`36 S °Jo kr bd vi I ORDINANCE NO. 2q7() AN ORDINANCE relating to land use amending Title 22 by enacting new provisions in Chapter 22.37 dealing with manufactured homes. WHEREAS, cities have a responsibility to regulate and control the physical development within their borders and insure the public, health, ,,safety and welfare are maintained; and, WHEREAS, the City of Pasco has zoning regulations that encourage orderly growth and development of the city, increase the security of home life and preserve and create a more favorable environment for citizens within the city; and WHEREAS, the city has adopted a comprehensive policy plan to guide the decision making process relative to land use; and, WHEREAS, the city's comprehensive policy plan encourages a full range of residential environments catering to all lifestyles and income ranges; and WHEREAS, the City Council has reviewed the RMH-1 zoning district regulations in light of the comprehensive policy plan; and, WHEREAS, the City Council has determined that to further the purposes of the comprehensive plan and further the maintenance of a favorable environment that protects the welfare of the community has found it necessary to amend PMC Chapter 22.37, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That PMC Chapter 22.37 is hereby amended to read as follows: CHAPTER 22.37 RMH-1 RESIDENTIAL MeBILE MANUFACTURED HOME ZONE DISTRICT Sections: 22.37.010 Description and intent. 22.37.020 Permitted uses. 22.37.030 Permitted accessory uses. 22.37.040 Permitted conditional uses. 22.37.050 Building heights. 22.37.060 Lot area. 22.37.070 Lot coverage. 22.37.080 Minimum floor area. 22.37.090 Yard requirements. 22.37.010 DESCRIPTION AND INTENT. The res±dental mob±Ie manufactured home district, RMH-1 is established to provide for residential areas which would be compatible for the development of a mela±le home res±dent±aI use manufactured homes and to prohibit the development of incompatible uses that are detrimental to the residential environmental. It is to provide a zoning didstrict for mete manufactured homes on platted mobile home subdivisien lots. eertain essential and eempatible pubIte serviee fae±Itties and institutiens are permitted in this distriet. Certain public facilities and institutions may also be permitted provided their nature and location are not detrimental to the intended residential environment. 22.37.020 PERMITTED USES. The following uses shall be permitted in the RMH-1 residential mebile manufactured home none district: (1) Meis±ie Manufactured homes; (2) Publie and private elementary seheeIs, high seheels7 eo3leges7 -universities,--publie—parks- and—playgrounds Modular homes* {9} Fire department station houses one family dwellings (site built); {4} ehurehes where eff-street park±ng is provided as set Earth in Seetien BR7047ele{B}7 {5} (3) Nothing contained in this section shall be deemed to prohibit the use of vacant property for gardening or fruit raising (Ord. 1843 Sec. 7 (part), 1977.) 22.37.030 PERMITTED ACCESSORY USES. The following uses set forth under R-1 surburban eerie regulations shall be permttted in the RMH-1 mebile home tenet (1) All aeeessery uses set forth under R-I Suburban low density residential regulations sha/I be permitted in the RMH-1 mebt+e manufaetured home Benet (2) All aeeessery buildings shall be eenstrueted in eenformanee with the eity building eede and p+aeed upon the +et in aeeerdanee with the required yard setbaeks ef this tene7 {erd7 10437 See {part 7} 19} shall be permitted as accessory to a permitted use in the RMH-1 District; (1) Residential garages, as defined in Section 22.12.370, provided they do not exceed fifteen feet in height; (2) Home occupations, as defined in Section 22.12.390; (3) Storage buildings not exceeding two hundred square feet of gross floor area and fifteen feet in height; provided no container storage, as defined in Section 22.23.750, shall be permitted; (4) The renting of rooms for lodging purposes only; provided, however, such accommodations shall not exceed two persons in a single-family dwelling. One off-street parking space, per roomer, must be provided in addition to the requirement set forth under Section 22.84.010(1); (5) The keeping of dogs and cats, provided such number of animals does not exceed three dogs and three cats; (6) Family day care homes in conformance with WAC 388-73 as now existing and as amended and PMC Chapter 22.35. 22.37.040 PERMITTEB CONDITIONAL USES. The building height restrictions are the same as those set forth under the R-1 suburban gene district (Ord. 1843.Sec. 7 (part), 1977.) 22.37.060 LOT AREA. In the RMH-1 restdenttai mebt+e manufactured home zone-district, the minimum lot area ±s shall not be less than seven thousand two hundred square feet for each dwelling unit. thereen7-eenstrueted7 (Ord. 1843 Sec 7 1977.) 22.37.070 LOT COVERAGE. All struetures, ±neIud±ng a mebtIe heme dwelling units, accessory buildings, covered breezeways, and covered parking er +eadng spaees, shall not cover more than th±y-pereent-ef-an-tnter±er-let-ner-mere-than forty percent of the a-earner-1ot area. (Ord. 1843 Sec. 7(part), 1977.) 22.37.080 MINIMUM FLOOR AREA. The minimum floor area of the primary living unit shall be seven hundred twenty 1 000 square feet. (Ord. 1843 Sec. 7(part), 1977.) 22.37.090 YARD REQUIREMENTS. (1) Front yards. The front yard for mebt+e-hemes dwelling units shall have a depth of not less than twenty feet which shall be measured from the right-of-way line. (2)Side Yard. The minimum side yard for mei:4+e hemes manufactured homes constructed after August of 1987 shall be five feet. All other side yards for manufactured meb±+e-homes shall be ten feet. Side yards shall be measured from the side property line. (3) Rear Yard. The minimum rear yard shall be the height of the dwelling unit, but in no case shall it be less than ten feet which shall be measured from the rear lot line. (4) Minimum distance between structures. There shall be an kUbstello, City Attorney open space between any two buildings on a lot not less than ten feet in width. (5) Reduce side and rear yards. An accessory building not used for human habitation may be constructed to within five feet of a side or rear lot line, provided said building is not closer than fifty feet to the front property line (Ord. 2902 Sec 1, 1992; Ord. 1843 Sec. 7 (part), 1977.) (6) Improvement Value. The value of site built or modular dwellings must not be less than 80% of the average assessed value, as determined by the records of the County Assessor, of improvements on other properties in the same or adjoining block fronts. That a new PMC Section 22.12.553 is hereby enacted to read as follows: 22.12.553 MANUFACTURED HOME. Manufactured home means a factory built structure constructed after June 15, 1976 in accordance with the U.S. Department of Housing and Urban Development requirements and bearing the appropriate Department of Labor and Industries ensignia indicating such compliance. That PMC Section 12.557 is hereby amended to read as follows: 22.12.557 MOBILE HOME. "Mobile Home" means a single-family dwelling, thirty-two body feet or more in length and eight body feet or more in width, designed for transportation, after fabrication, on streets and highways on its own wheels or flatbed or other trailers, and designed to be used as a dwelling with or without a permanent foundation when connected to required utilities, having an ensignia issued by the Department of Labor and Industries, and constructed before June 15, 1976. follows: Section 2. This ordinance shall take effect five days after passage and publication as required by law. Section 1. Amends PMC Chapter 22.37 by renaming the chapter from the mobile home zone to the manufactured home district. Further, the amendments will permit a mixture of manufactured homes, modular homes and conventional dwelling units within one zoning district. Amendments were also made to the permitted use and conditional use sections to bring those sections in line with other residential zoning districts. Finally, the amendments add a definition for manufactured homes and modify the definition of a mobile home. Section 2.
