WHEREAS, on November 4, 1993, the Planning Commission of the City of Pasco conducted a public hearing to develop a recommendation for the assignment of zoning to certain properties; in the event those properties were incorporated with the city; and WHEREAS, on November 15, 1993, Ordinance No.\ , effectively annexed certain real property to the City of Pasco; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1. That the following described area, situated in Pasco, Franklin County, Washington to-wit: That part of Township 9 North Range 29 East Willamette Meridian described as follows: Beginning at a point on the south right-of-way West Court Street said point being the northwest corner of Lot 4, Block 1 Arbee's Addition located in Section 26, Township 9, Range 29 E.W.M.; Thence easterly along the south R/W line of Court Street to its intersection with the east R/W line of Road 40; Thence south along said R/W line a distance of 302 feet, more or less; Thence easterly on a line parallel to the north line of Section 26, T. 9 N., R. 29 E., W.M. a distance of 1000 feet; Thence southerly on a line parallel to the east line of said section a distance of 330 feet, more or less, to the north line of Sparta's First Addition and a point 295 feet west of the east line of said section; Thence east along said north line of Sparta's First Addition 255 feet, more or less, to the westerly R/W line of Road 36;/Thence south along said R/W line to the south line of Lot 6 Matheson's First Addition; Thence east along the south line projected 10 feet more or less to the west R/W line of Road 36; Thence south along the said west R/W line of Rd. 36 to its intersection with the south R/W line of Henry Street; Thence west / along said south R/W line of Henry Street to its intersection with the east R/W line of Road 37; Thence southerly along said east R/W line of Road 37, to the intersection of the easterly projection of the southerly lot line of Lot 18, Block 8 of the Corrected plat of Riverview Terrace; Thence west along said southerly projection to the south east corner of Lot 18, Block 8 of the Corrected plat of Riverview Terrace; Thence west along the south lines of lots 18, 17, 16, 15, 14, 13, 12, 11, and 10 to the east R/W line of Road 40; Thence west along the extended south lot line of said Lot 10, to the west R/W line of Road 40; Thence north along the west R/W line of Road 40 to its intersection with • -1- e elice, Mayor ul if 11 A NI1f..n Rubstel o, City Attorney APPR 'VED the south line of Henry Street; Thence west along the south R/W line of Henry Street to its intersection with the east line of the northwest quarter of the southwest quarter of the northeast quarter of said Section 26; Thence north along the east line of the northwest quarter of the southwest quarter of the northeast quarter and the east line of the southwest quarter of the northwest quarter of the northeast quarter and the east line of the northwest quarter of the northwest quarter of the northeast quarter of said Section 26 to the intersection with the easterly projection of the south line of of the plat of Arbee's Addition; Thence west along the said projection of the south line of Arbee's Addition to the southeast corner thereof; Thence continuing west along the south line said Arbee's Addition to the southwest corner thereof; Thence north along the west line of said Arbee's Addition to the northwest corner thereof, said point being the northwest corner of Lot 4, Block 1 of Arbee's Addition and the Point of Beginning. Plats, rights-of-way, and/or easements referenced herein are records of Franklin County, Washington, as recorded with the Franklin County Auditor. as depicted in the map attached hereto and labeled Exhibit 1 be and the same is hereby assigned the R-S-12 (Suburban Residential) district classification. Section 2. That any and all zoning maps be and the same are hereby amended to conform to the aforesaid assignment of zoning. Section 3. service and se connection amending Section 13 22 015 WHEREAS in co r oration of a large numb • undevel oped lots and other property in the area of Pasco east of Oregon Avenue south of Highway 395 and west of Highway 12 the depressed property values in that section of the city and the overall benefit to the city and the util ay that would be denved from the development of such lots and the connection to the city water and sewer systems NOW THEREFORE THE CITY COUNCIL OF THE CITY OF PASCO WASHINGTON DOES OR DAIN AS FOLLOWS Section 1 New section 13 22 015 is hereby added to the Pasco Municipal Code which section read as follows 13 22 015 EXEMPTIONS TO INCREASED CHARGES Those amend ments to Section 13 22 010 PMC 13 36 010 PMC and 13 44 011 PMC set forth in Ordinance No 2961 passed August 16 1993 increasing the charges for 'water system capital expansion/ replace ment charges and new ser vice lines and increasing the charges for hook-up to exist ing sewer mains shall not be effective against real property in the City of Pasco located in the area east of Oregon Fourth Avenue south of Highway 395 west of High way 12 and south of A Street east of 14th Avenue extended The charges set forth in such code sections pnor to said amendment shall remain in effect against such picoperty The city council shall review these exceptions for their effect upon encour aging development in the af fected areas and its actual benefit to the city utility at least annually beginning in 1994 Section 2 This ordinance shall take effect five (5) days after passage and publica-
