HomeMy WebLinkAbout2961 OrdinanceORDINANCE NO. &C\QI\ AN ORDINANCE concerning water and sewer lines, connections and testmg, increasing the water system development charge, the water line extension fee, and the sewer line extension fee, and, amending §§ 13 16100, 13 24 030, 13 28 060, 13 22 010, 13 22 020, 13 36 010, 13 36 020, 13 36 030, 13 36 040, 13 36 050 13 44 010 13 44 011, 13 52 140, and 13 54 060 of the Pasco Municipal Code WHEREAS, the City Council, after Public Hearing and upon recommendation of its consultant, Economic and Engineering Services, Inc , and city staff, has determmed that increases m the system development fees for water and sewer utilities are appropnate, Now, Therefore, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DOES ORDAIN AS FOLLOWS: §1. Section 13 16 100 of the Pasco Municipal Code is hereby amended by the deletions shown by interlineation and the additions shown by underlining to read as follows 13 16 100 CHANGE OF OCCUPANCY AND FRACTIONAL MONTHS Each customer about to vacate any premises, or who desires water service discontinued for any other reason, shall give wntten notice of his desire, specifying the date service is to be discontinued, the meter will be read and a bill rendered which is payable immediately Where property is occupied fifteen days or less and not more than : - - dollar shall be made - hundred cubic feet of water has been used, a charge of forty cents per Where five hundred cubic feet or more has been used, the regular rate will apply In any case, he will be responsible for the payment ef—a41—water supplied to such premises until the water department shall have notice of such discontinuance Sewer charges will be §2. Section 13 24 030 of the Pasco Municipal Code is hereby amended as shown by the deletions by interlineation and the additions by underlining to read as follows 13 24 030 TESTING All meters will be tested before installation, and no meter will be placed in service or allowed to iemain in service which is known to have an error in registration in excess of two percent under conditions of normal operation Where the amount of water consumed, or the billing is questioned by the water user, the water meter will be immediately reread and billing rechecked and if no error is apparent the billing will stand When the accuracy of a meter is questioned and the meter test demanded by the water user or the property owner, it shall be the duty of the water department to test such meter with a portable test meter in the presence of the water user or the property owner, or his agent if they so desire The city treasurer may require an advance deposit of three sixty dollars ($60 00) to cover the cost of the test If the test does not disclose an error in excess of three percent against the customer, the customer shall stand the cost of making such tests If the test shall disclose an error of more than three percent against the consumer, the water department shall assume the entire cost of making the test and the deposit shall be returned Where tests disclose a meter to be mecharucally defective, affecting the account over a period of one or more months, the water superintendent shall make such adjustments as seem fair and proper §3. Section 13 28 060 of the Pasco Murucipal Code is hereby amended as shown below by the deletions by interlineation and the additions by underlimng to read as follows 13 28 060 CHARGES All fire lines shall be metered and an eight dollar ($8 00) per month charge shall be assessed to cover checking the meter and billing and administration the following standby 3 inch meters $ 300 /1 inch meters -(40 6 inch meters -6-00 8 inch meters 10 00 §4. Section 13 22 010 of the Pasco Municipal Code is hereby amended by the new fees underlined below and the deletion of the existmg fees shown below by interlineation, as follows 13 22 010 WATER SYSTEM CAPITAL EXPANSION/ REPLACEMENT CHARGES At the time of application for the installation of a customer service account within the city limits, the following fees shall be paid to the city in all cases where the installation of a service line is required for the initiation of service or where the customer line to be served has not been billed at least the mimmum applicable water service charge for each of the preceding twenty-four consecutive months 3/4 inch meter $400-00- $28000 - 2 - 1 inch meter $450-00- $468 00 11/2 inch meter S-340-00 $93300 2 inch meter $55000 $1.493 00 3 inch meter $4 70-50-00- $2.800 00 4 inch meter $4 76-50-00- $4,668 00 6 inch meter $3,350 00 $9,333 00 8 inch meter $3,350 00 $14,933 00 10 inch meter $21,468 00 §5. Section 13 22 020 of the Pasco Municipal Code is hereby amended as shown by the deletions by mterlmeation and additional language by underlining, as follows 13 202 020 WATER SYSTEM CAPITAL EXPANSION/ REPLACEMENT CHARGES OUTSIDE THE CITY LIMITS The fees ! outside the city limits with the addition of a fifty percent filifehafge- The water system capital expansion/replacement charges for water service outside the city limits shall be as follows 3/4 inch meter $420 00 1 mch meter $702 00 1-1/2 inch meter $1,399 00 2 mch meter $2,239 00 3 mch meter $4,200 00 4 inch meter $7,002 00 6 inch meter $13,999 00 8 inch meter $22,399 00 10 inch meter $32.202 00 §6. Section 13 36 010 of the Pasco Murncipal Code is hereby amended as shown below by deletions by mterlineation and additions by underlining to read as follows 13 36 010 NEW SERVICE LINES INSIDE CITY For each water connection there shall be a charge for the service and water meter in an amount equal to the actual cost to the city of the service connection and installation mcludmg the water meter covenng both parts and labor of two hundred twenty dollars for each For each water connection there shall be a charge of two hundred For meters larger than one inch, the actual cost of labor, Charges for three quarter and one inch services shall be paid in advance A deposit sufficient to cover actual cost for meters tarter dian-ene-ineh shall be made in advance That portion of the deposit, if any, in excess of actual cost shall - 3 - be refunded upon completion of the installation In addition to the above charges, when it becomes necessary to open a paved street and replace pavement a fee shall be charged in the amount determined as follows $10000 plus $25 00 per square yard In those cases where it is not possible to determine asphalt patch quantities in advance, they will be computed from field measurements after completion of the work and will be billed to the applicant or deducted from the deposit Section 13 36 020 of the Pasco Municipal Code is hereby amended shown by deletions by interlineation and new language by underluung, as follows 13 36 020 CONNECTION TO EXISTING LINES When it is desired by a property owner and in any case requisite to having a city water service installed to serve a parcel(s) of land, a fee shall be paid to the city treasurer in the amount as determined as follows Residential Charges WOG $14 31 per front footage of the parcel(s) of property served, plus $0 0277 per square foot of the parcel(s) of property served Commercial Charges $19 59 per front footage of the parcel(s) of property served, plus $00333 per square foot of the parcel(s) of property served The city engineer shall have on file with the city clerk diagrams and documents outlining the assignment of square footage and front footage charges §8. Section 13 36 030 of the Pasco Municipal Code is hereby amended as shown by deletions by interlineation and new language by underlining, to read as follows 13 36 030 EXTENSION OF LINES—CITY INSTALLATION When an extension of the city system is required and such is requested of and agreed to by the city and it is further requested and agreed that the city will make the extension, in addition to those fees associated : : accordance with Section 13 36020, a fee shall be paid to the city Ten dollars per foot of line required for the extension less a deduction in the amount of front footage and square footage charges paid by the parcel(s) of property being served by the extension and shall be a charge of twenty five dollars plus nine dollars per square - 4 - yafd-ef-pateh-requiFed- The city engineer shall have OR file with the city clerk diagrams : - : - footage charges Before any nonbudgeted city water main is extended, by the city at the request of a property owner or developer there shall be deposited with the city treasurer an amount sufficient to cover the actual cost of such extension and appurtenances and appropriate area charges Said amount shall be determined by the city engineer and/or director of public works The same may be paid by one or more property owners, on or along such main extension Should actual costs upon completion be less than the amount deposited. the difference shall be refunded Proration shall be on a front-foota e basis Substandard extensions may to be made only when in the judgment of the city council, the population and salutary conditions warrant such extensions It shall be necessary to have the council approval and terms set forth by wntten agreement before any extensions when less than one hundred percent subscription in front footage is paid, for substandard lines. when it is necessary to have extensions for the good of the city or when unusual conditions prevail Water main extensions may also be accomplished through local improvement districts §9. Section 13 36 040 of the Pasco Mumcipal Code is hereby amended as shown by the deletions by interlmeation and additions by underlining, to read as follows 13 36 040 EXTENSION OF LINES—INSTALLATION BY REQUESTING PARTY When an extension of the city system is required and such is requested of and agreed to by the city and it is further agreed that the requesting party will extend the line(s); The requesting party shall install the line extension at their sole cost and expense, subject to the remaining provisions of this section -113- : Section 13 36 030, a fee shall be paid to the city treasurer in the : $002 per square foot of the parcel(s) being served by the The city engineer shall have on file with the city clerk diagrams : • footage charges (a) The front footage charge of $14 31 under §13 36 020 shall be waived for connection to the newly installed line by the party to the - 5 - parcel(s) of property owned by the installing party (b) The Installing party when connecting his or her parcel(s) of property to the extension shall pay $0 0277 per square foot of the parcel(s) of the property served as provided under §13 36 020, except that, if the extension passes by one or more parcels of property under other ownership already connected to an existing line, there shall be a deduction m the amount of front footage and square footage charges previously paid for such parcel(s) of property at the time of their connection In some cases the deduction may be sufficient to result in a cash payment from the city to the party making the extension (c) The city may contract with the party making the extension for a "pay back" to the party malung the extension by property owners who do not contribute to the ongmal cost of the line extension and who subsequently tap onto or use the same under the provisions of a contract as provided for in §13 36 0050 §10. Section 13 36 050 of the Pasco Mumcipal Code is hereby amended as shown by the deletions by mterlineation and additions by underlmmg, to read as follows 13 36 050 INSTALLATION COSTS REFUND- REIMBURSEMENT OF COSTS BY SUBSEQUENT USERS The city may contract with owners of real estate for the construction of storm, sanitary, or combination sewers, pumping stations, and disposal plants, water mams, hydrants, reservoirs, or appurtenances, hereinafter called "water or sewer facilities," within its boundaries or within ten (10) miles from its corporate limits connecting with the city's water or sewerage system to serve the area m which the real estate of such owners is located, and to provide for a penod of not to exceed fifteen (15) years for the reimbursement of such owners and their assigns by any owner of real estate who did not contnbute to the original costs of such water or sewer facilities and who subsequently tap onto or use the same of a fair pro rata share of the cost of the construction of said water or sewer facilities, including not only those directly connected thereto, but also users connected to laterals or branches connecting thereto, subject to the approval of the city council To the extent it may require in the performance of such contract, the city may install said water or sewer facilities m and along the county streets in the area to be served as heremabove provided, subject to such reasonable requirements as to the manner of occupancy of such streets as the county may by resolution provide The provisions of such contract shall not be effective as to any owner of real estate not a party thereto unless such contract has been recorded in the office of the county auditor of Franklin County pnor to the time such owner taps into or connects to said water or sewer facilities At the end of the payback penod, for such time as it may be pursuant to contract, any property owner connecting to the - 6 - extension shall a to the cit the re lar connection fees re uired by §13 36 020 If within an eight year penod after the completion of a line installed pursuant to Sec-tions 13 36 030 or 13 36 010 and other : - - . ' parcel(s) of land served by said line(s) installed pursuant to Sections 13 36 030 or 13 36010, that portion of those fees assigned to pay for said lines shall be refunded to the party who onginally patd-er-ifistalled-the4ine(s)- However, in no case shall a party(s) who onginally paid or installed lines be eligible for a refund on land served by the line if : refund apply in the case of individual or small groups who install . .," The city engineer shall have on file with the city clerk diagrams : ".." -• charges a/. Section 13 44 010 of the Pasco Municipal Code is hereby amended as shown by deletions by interlineation and new language by underlining, to read as follows 13 44 010 CHARGES FOR SEWER MAIN EXTENSIONS Before any nonbudgeted city sewer main is extended, by the city at the request of a property owner or developer there shall be deposited with the city treasurer an amount sufficient to cover the actual cost of such extension and appurtenances and apropnate area charges Said amount shall be determined by the city engineer and/or director of public works The same may be paid by one or more property owners, on or along such main extension Should actual costs upon completion be less than the amount deposited, the difference shall be refunded Proration shall be on a front-footage basis In the event that one or more property owners subscnbe to the entire amount necessary to construct such sewer extensions and the • " • " t' • t' • the property owned by such subscnber or subscribers, the amount of such over subscnption shall be refunded as footage prorated charges are collected for the other properties, provided the same are paid within a period of eight years from date of extension, but no refund shall be made on charges paid after a period of eight years The refund time limit shall be effective at the passing of this chapter and is not retroactive The above refund shall not apply in case of Substandard extensions may referred to above, to be made only when in the judgment of the city council, the population and sanitary conditions warrant such extensions It shall be necessary to have the council approval and terms set 7- forth by wntten agreement before any extensions when less than one hundred percent subscription in front footage is paid, for substandard lines, when it is necessary to have extensions for the good of the city or when unusual conditions prevail Sewer main extensions may also be accomplished through local improvement districts §12. Section 13 44 011 of the Pasco Municipal Code is hereby amended as shown by the deletions by interlineation and additions by underlining, to read as follows 13 44 011 CHARGES AND REFUNDS ON PRE-EXISTING EXTENSIONS For those main extensions constructed and installed prior to the passage of this chapter, hook-up charges and refunds shall be calculated at the rate of four dollars $14 15 per front-foot and an area charge of $0 0261 per square foot of the parcel(s) of property served (that having been the applied rate for construction : §13. Section 13 52 140 of the Pasco Municipal Code is hereby amended as shown below by the deletions by mterlineation and additions by underlining, to read as follows 13 52 140 CLASSIFICATION OF PERMIT—FEES There shall be two classes of building sewer permits (1) For residential and commercial service, and (2) For service to establishments producing industnal wastes In either case, the owner or his agent shall make application on a special form funushed by the city The permit and inspection fee of five fifty dollars ($50 00) for a residential or biiiklifig—sewer—peRyiit shall be paid to the city treasurer at the time the application is filed An additional charge of two dollars and fifty cents per square yard shall be made for cutting into paved streets or alleys for replacing existing pavement Any street cuts required to be pursuant to permit provided in §1224 070 §14. Section 13 54 060 of the Pasco Municipal Code is hereby amended as shown below by the deletions by interlineation and additions by underlining, to read as follows 13 54 060 BILLING PROCEDURE (a) Rate septic tank waste discharged into the wastewater treatment plant will be charged on the basis of a full truck tank load at eight twenty-four cents (240) per gallon times the capacity of the truck's tank in gallons Provided, however, any firm discharging septic tank pumpuigs at the wastewater treatment plant during the months of September through February shall be charged on the basis of a full truck tank load at feft-y-etght—eents one dollar forty-four cents ($1 44) per gallon times - 8 - ATTEST APPR VED AS TO FO CATHERINE D EAMAN Deputy City Clerk the capacity of the truck's tank m gallons when the gallons discharged exceed the average volume discharged by the firm at the treatment plant dunng the months of March through August (b) Frequency Billings will be made on a calendar month basis with the billings sent out not later than the first full week following the end of the preceding month Bills must be paid, as evidenced by receipt of the same by the city's finance department, prior to the last calendar day of the month the bill is mailed by the city Failure to pay any billing witlun the time frame set forth herein shall be sufficient grounds for the city to terminate dumping privileges at the wastewater treatment plant Bills paid after the end of the month shall incur interest on the unpaid balance at the rate of twelve percent (12%) per annum §15.
