AN ORDINANCE creating the Trade, Recreation and Agncultural Center
Development and Operating Fund, and creating new Chapter 3 126 of the
Pasco Municipal Code
WHEREAS, the city intends to jointly develop and operate with Franklin
County a project known as the Trade, Recreation and Agncultural Center or simply
TRAC, a multi-purpose arena and exhibit facility with adjacent recreational
facilities, contiguous parking and other appurtenant improvements, and
WHEREAS, the city needs to create a fund to account for city
expenditures with respect to the design, development and operation of TRAC, Now,

THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DOES
ORDAIN AS FOLLOWS:
§1. New Chapter 3 126 is hereby added to the Pasco Municipal Code,
which chapter shall read as follows

TRAC DEVELOPMENT AND OPERATING FUND

3 126 010 Created
3 126 020 Use
3 126 010 CREATED There is hereby created a special fund to be
known as the "Trade, Recreation and Agncultural Center Development
and Operating Fund" ("TRAC Fund"), for the purpose of accounting for
funds received, disbursed and expended for the design, development and
operation of the TRAC facility, adjacent recreational and sporting
fields, and its appurtenances
3 126 020 USE The fund shall be used for the proper receipting
and disbursement of funds utilized, borrowed, received and expended in
connection with the TRAC facility, adjacent recreational and sporting
fields and facilities and their appurtenances, and to account for
payment received by the city from any income from the TRAC facilities
in connection with the city's operations thereof
§2. This ordinance shall take effect five (5) days after passage and
publication

special excise tax of two per
cent (2%) on the sale of or
charge made for the furnish
ing of lodging by a hotel
roominghouse tourist court
motel trailer camp and the
granting of a similar license to
use real property as distin-
guished from renting or leas
irig of real property For the
purposes of this tax it is pre
sumed that the occupancy of
real property for a continuous I
period of one (1) month or I
more constitutes a rental or '
lease of real property and not
a mere license to use or enjoy
the property The tax im
posed under this section is in
addition to the lodging tax im
posed and levied under
Chapter 3 94 PMC
3 95 020 ADMINISTRATION
AND COLLECTION A sell-
er as defined in RCW
82 08 010 shall collect the
tax required under this chap
ter and shall pay the tax to the
city as provided in PMC
3 94 030 along with the lodg-
ing tax provided in Chapter
3 94 PMC The deduction
from state taxes under RCW
67 28 190 does not apply to
taxes imposed under this
section
3 95 030 TRAC FUND The
tax levied and collected under
this chapter shall be credited
to a special fund of the city
commonly known as the
TRAC Fund provided for in
Chapter 3 126 PMC
3 95 040 EFFECTIVE DATE
The effective date of the tax
imposed in this chapter shall
be October 1 1993 and such
tax shall be due and payable
to the city on such date and all
days following to be collected
as theretofore provided

III. HISTORY AND FACTS BRIEF:
The city will soon be spending funds for the initial phases of the
TR AC project and will need a fund to account for the expenditures
associated with the development of the project and the operations of
the facility. The fund will also be used to receipt in the 2% local
hotel/motel tax associated with the project
