HomeMy WebLinkAbout2929 OrdinanceORDINANCE NO. c;c1 AN ORDINANCE concerning the correction or adjustment of voluntary payments to the city, and creating new Chapter 117 to the Pasco Municipal Code WHEREAS, Upon recommendation from city staff, the city council has determined that a one-year penod of time is a reasonable time penod for the discovery of an error in any payment made to the city, and that no adjustments, corrections, or refunds, due to all or any portion of such payments should be made thereafter, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN AS FOLLOWS: §1. New Chapter 117 to the Pasco Municipal Code is hereby created, which chapter shall read as follows CHAPTER 117 TIME LIMITATION ON CORRECTIONS, ADJUSTMENTS, AND REFUNDS Sections 1 17 010 Definitions 117 020 Time limitation 117 010 DEFINITIONS The following words and phrases, as used m this chapter, shall be construed as defined in this section (1) "Voluntary payment" means a payment made to the City of Pasco without wntten protest setting forth the reasons the payment is made m protest 117 020 TIME PERIOD Except as provided for herein, in all cases of the voluntary payment of any utility bill, fee, tax, or other consideration for a service provided by the city or any of its employees, resulting m either an overpayment or underpayment of the true amount due, whether or not the result of mistake of law, mistake of fact, inadvertence or error, such payments may be adjusted or corrected only within one year (365 days) of payment The correction, adjustment or refund of all or any portion of such payment is barred one year (365 days) following payment to the city Provided, in cases where the underbilling is the result of false or inaccurate mformation provided or procurred by the customer or taxpayer, this limitation shall not apply ... - 1 - CATHERINE D SEAMAN Deputy City Clerk §2.
