ORDINANCE NO.acAL5
AN ORDINANCE relating to management of critical lands as
required by the Growth Management of the state and
found in R.C.W. 36.70A.
WHEREAS, the State of Washington has established the State
Environmental Policy Act to protect and enhance the overall
welfare and environment of the citizens of the state including
the City of Pasco; and,
WHEREAS, the State of Washington has established a
Shoreline Management Act to protect and manage the state's
shorelines and tidelands; and,
WHEREAS, the State of Washington has established a Growth
Management Act which has identified the types of lands within the
state which are termed critical lands and has required that local
governments take steps to protect and preserve these lands; and,
WHEREAS, the City of Pasco in conjunction with Franklin
County commissioned a study to identify critical lands in the
city and county; and,
WHEREAS, this initial broad brush study indicated there
may be wetlands, critical lands, historically sensitive habitat
areas and agricultural lands within Pasco and its proposed urban
growth area; and,
WHEREAS, the study indicated that further identification
and investigation was necessary to confirm the critical nature of
lands identified; and,
WHEREAS, observation indicates there has been very little
or no defamation of basalt surfaces in the Pasco area indicating
a low earthquake hazard risk; and,
WHEREAS, surface geologic hazards are confined primarily
in the steep bluffs along the Columbia River and the Ringold
Coulee north of Pasco; and,
WHEREAS, studies have found Franklin County unattractive
for subsurface mineral development because no high unit value
mineral resources are known to occur within the county; and,
WHEREAS, the Franklin Conservation District indicates
primary natural aquifer recharge areas are located out of the
urbanizing area in and around Pasco; and,
WHEREAS, the highest concentration of wetlands occur in
the northwest portion of Franklin County, nevertheless, a small
portion of the city in Section 12, Township 9 North Range 29
East between the Columbia River and Court Street maybe a wetland
area; and,

WHEREAS, certain lands within Pasco and its urbanizing
area have been utilized for agricultural production, but due to
proximity to population areas, the existence of infrastructure,
the planned street network and the possibility of more intensive
land uses, these agricultural lands do not have long term
commercial significance; and,
WHEREAS, endangered, threatened and sensitive species
identified in Franklin County frequent the north central portion
of the county, Indian Island, the Juniper Dunes Wilderness and
the Esquatzel and Washtucna Coulees which are all located out of
the city and its proposed urban growth boundary; and
WHEREAS, there are no known natural salmon spawning beds
in Franklin County; and,
WHEREAS, Franklin county contains a number of species and
habitats of local importance. These habitat areas and species
are found primarily along breaks of the Columbia and Snake
Rivers, the Juniper Dunes wilderness area and in native steppe
and shrubsteppe areas of County; and,
WHEREAS, certain areas within Pasco and its proposed urban
growth boundary have been identified by the Washington Department
of Wildlife as possible priority habitat and/or historically
sensitive habitat areas; and,
WHEREAS, those habitat areas and historically sensitive
areas are identified in locations that have experienced
significant changes in land use over the years such that their
utility as habitat areas are minimal or non existent; and,
WHEREAS, the critical lands inventory study commissioned
by the city and county recommends that all proposed land use
actions should be evaluated at the time of permit application for
potential impacts to critical fish and wildlife species and
habitat; and,
WHEREAS, the existence of resource and/or critical lands
within Pasco and its proposed urban growth area are limited or
non existent and rather than identify questionable lands on a
map, it is more appropriate to evaluate environmental concerns
on a case by case basis during the permitting process; NOW,
THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO
ORDAIN AS FOLLOWS:
Section 1. That there is hereby added a new chapter to
PMC Title 23 to read as follows:

CRITICAL LANDS PROTECTION
23.11.010 General provision.
23.11.020 Application.
23.11.010 GENERAL PROVISIONS. The provisions of the
State Environmental Policy Act and Shoreline Management Act and
their attendant rules are recognized as the regulatory vehicle
through which the city meets its obligations to protect critical
lands as required by RCW 36.78.030 and .060.
23.11.020 APPLICATION. All proposed land development
projects shall be reviewed for critical lands protection
utilizing the regulations and processes of the State
Environmental policy act, the Shoreline Management Act and
attendant rules.
Section 2. That this ordinance shall be in full force
and effect after its passage and publication or publication of a
summary and will remain in effect until the city adopts a more
specific critical lands ordinance following completion of a
comprehensive plan.

ORDINANCE NO.r:n c-Z13 is an ordinance relating to the
environment and amending PMC Title 23 by adding a new Chapter
23.11 providing a process for protecting critical lands within
the city.
Section 1. The city will follow the provisions of the
State Environmental Policy Act and the Shoreline Management Act
as the regulatory vehicle to insure critical lands are protected
as required by the Growth Management Act of the State
Section 2. The ordinance will be in effect upon publication and
will remain in effect until such time as the city adopts more
specific regulations following the completion of a comprehensive
plan.

APUNYA COMMUNITY, Aus-
tralia —The vitality of Papun-
ya made it the focus of a
fledgling Abornal art movement 20
years ago Today the tiny commiuuty
is a sad symbol of neglect, like the
Abongmes who live there
Twisted playground equipment
lies rustmg m an overgrown field No
one has cleaned up the glass knocked
out of the lone phone booth. Hulks of
broken-down cars sit on bare rims A
windmill lies where it collapsed
Garbage litters the wind-blown
fields A few skinny dogs roam the
streets m the noon heat.
"One new teacher came m at night,
got her first look around in the day-
light, bawled her eyes out and left,"
says Alison Anderson, a painter and
the community's spokeswoman
Only 35 of the 390 residents have
jobs, the rest are dependent on gov-
ernment handouts A handful of
shops sits vacant, except for a bat-
tered gas station
Papunya is typical of the Aboriginal
commiuuties that dot the unforgiving
landscape of Australia's Red Center,
evidence that the country's indige-
nous people have not joined main-
stream society
With a long history of culture clash-
es, prejudice and genocide, they're
not sure they want to, either
Their problems echo those ofNorth
America's Indians poor health and
housing, alcoholism, alienation, high
unemployment, short life expectan-
cy, loss of languages and tradition
from decades of forced assimilation,
domestic violence
At least 300,090 Aborigines lived
across Australia when European
colonists arrived in 1788 Over the
next 150 years, warfare, massacres
and new diseases wiped out three-
quarters of them Today, the number
has rebounded to about 300,000— in-
cluding those of mixed race — less
than 2 percent of the 18 million pop-
ulation
Most white Australians have little
contact with Aborigines, largely be-
cause few of the natives live in cities
They comPrise 22 percent of the
Northern Territory
Before a referendum on May 27,
1967, granted them citizenship, Abo-
rigines could not vote, were not
counted in the census and had no
guarantees ofwages equal to those of
whites In some states, they could not
get married without written consent
or swim in the same pools as whites
"What has happened m the 25 years
to this day?" the Sydney Morning
Herald asked in an editorial marking
the vote's anniversary "In many
ways, the answer is not much
The nomadic Aborigines once were
viewed as "noble savages," with their
complex rites and mythology based
on closeness Nvith the land and the su-
pernatural beings who created it
Now Aboriginal art and music are
growing in popularity Scientists in-
creasingly follow Aboriginal advice
in ecology Police use Aboriginal
trackers in the Outback
Aboriginal communities are re-
claiming their traditional lands
through the courts But there also is
fraud and exploitation, prejudice
and misunderstanding.
In frontier-like Alice Springs, at
24,000 people the largest town for at
least 745 miles in any direction, there
are signs of the longstanding black-
white divisions
Nearly a third ofAlice's 4,000 Abo-
rigines live in 18 permanent town
camps, with a combined 170 houses,
scattered on the outskirts Hundreds
of others use trees and tarpaulins for
shelter in the normally dry bed of the
Todd River near tourist shops
Dick Kunber, a historian and writer
who moved to Alice 23 years ago and
has formed strong ties with the Abo-
ngines, says mutual understanding
has improved, but "others are almost
unresolvable They require very sen-
sitive people on both sides You can't
hope for dramatic conversions"
For example, Papunya was created
m 1960 in the desert foothills of West
MacDonnells range, a 150-mile drive
from Alice Springs, half the way on a
washboard-rough dirt road
It was a case of forced assimilation
and apartheid Members of rival
tribes lived uneasily side-by-side in
overcrowded one-room brick houses
Schools taught only in English from a
European perspective At night, the
white center was off-limits to blacks
Perhaps cruelest, the government
had the power to forcibly take Abo-
riginal children, mostly those of
mixed race, and place them in foster
homes to be raised in "white ways"
"Whatever the intentions of people
involved in the establishing and run-
ning of this settlement May have
been, the effect over timel4as been to
give us a feeling of poWerlessness
over our own lives," says Anderson,
the Papunya spokeswoman.
Anderson is trying to recapture
Papunya's former energy through a
stubborn battle for self-government
"Politicians sit in Darwin and Can-
berra and don't even know what
places like Papunya look like," she
says "Aboriginal people need the
power to determine what they think
is important in life It's really hard
when you have to keep fighting with
the government for money, proper
housing, day-to-day maintenance"
Last winter, Papunya went without
power for four months in a dispute
with the government over being
forced to start paying for electricity
for the first time
With few jobs and higher prices for
food and fuel than in Alice Springs,
residents argued they couldn't afford
to pay So they cooked on open fires
that provided warmth at night
"It was cold and freezing, but that
was the decision we made," Ander-
son says "We wanted to demonstrate
that it wasn't about electncity, it was
about power We had to suffer, but it
was worth it We got national public-
ity and a lot of support "
