ORDINANCE NO. caSla AN ORDINANCE creating new Chapter 908 to the Pasco Murucipal Code, and adopting the cnmes of Harassment and Stalking WHEREAS, the City Council has determined that the City should mclude within its cnnunal code the gross misdemeanor cnmes of harassment and stalking set forth m RCW 9A 46 020 and 9A 46 110, Now, Therefor, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DOES ORDAIN AS FOLLOWS: New Chapter 908 is hereby added to the Pasco Municipal Code, which chapter shall read as follows CHAPTER 908 PERSONAL HARASSMENT Sections 9 08 010 9 08 020 9 08 030 9 08 040 908 050 908 060 908 070 908 080 908 090 Cnme of Harassment — Penalties Place where committed Court — ordered requirements upon person charged with crime — Violation Arraignment — no contact order Cnmes included in harassment Order restricting contact — Violation Nonliability of peace officer "Convicted," time when Stalking — Penalties 9 080 010 CRIME OF HARASSMENT — PENALTIES (1) A person is guilty of harassment if (a) Without lawful authonty, the person knowmgly threatens (i) To cause bodily injury in the future to the person threatened or to any other person, or (u) To cause physical damage to the property of a person other than the actor, or (m) To subject the person threatened or any other person to physical confinement or restraint, or (iv) Maliciously to do any other act which is mtended to substantially harm the person threatened or another with respect to his or her physical or mental health or safety, and (b) The person by words or conduct places the person threatened m reasonable fear that the threat will be carned out, and (c) The person is not guilty of a felony as defined in subsection (2) below (2) A person who harasses another is guilty of a gross misdemeanor pinushable under chapter 9A 20 RCW, except that the person is guilty of a class C felony if either of the following applies (a) The person has previously been convicted m this or any other state of any crime of harassment, as defined m PMC 908 050, of the same victim or members of the victim's family or household or any person specifically named m a no-contact or no-harassment order, or (b) the person harasses another person under subsection (1)(a)(i) of this section by threatemng to kill the person threatened or any other person (3) The penalties provided in this section for harassment do not preclude the victim from seeking any other remedy otherwise available under law 9 08 020 PLACE WHERE COMMITTED Any harassment offense committed as set forth in PMC 908 010 or PMC 908 090 may be deemed to have been committed where the conduct occurred or at the place from which the threat or threats were made or at the place where the threats were received 9 08 030 COURT — ORDERED REQUIREMENTS UPON PERSON CHARGED WITH CRIME — VIOLATION (1) Because of the likelihood of repeated harassment directed at those who have been victims of harassment m the past, when any defendant charged with a cnme mvolving harassment is released from custody before trial on bail or personal recogiuzance, the court authorizing the release may require that the defendant (a) Stay away from the home, school, business, or place of employment of the victim or victims of the alleged offense or other location, as shall be specifically named by the court in the order, (b) Refrain from contacting, intimidating, threatening, or otherwise interfenng with the victim or victims of the alleged offense and such other persons, including but not limited to members of the family or household of the victim, as shall be specifically named by the court in the order (2) An intentional violation of a court order issued under this section is a misdemeanor The written order releasmg the defendant shall contain the court's directives and shall bear the legend Violation of this order is a cnininal offense under chapter 9 08 PMC A certified copy of the order shall be provided to the victim by the clerk of the court 908 040 ARRAIGNMENT — NO-CONTACT ORDER A defendant who is charged by citation, complaint, or information with an offense involving harassment and not arrested shall appear m court for arraignment m person as soon as practicable, but in no event later than fourteen days after the next day on which court is in session following the issuance of the citation or the filing of the complaint - 2 - or mformation At that appearance, the court shall determine the necessity of imposing a no-contact or no-harassment order or other conditions of pretnal release accordmg to the procedures established by court rule for preliminary appearance or an arraignment 9 08 050 CRIMES INCLUDED IN HARASSMENT As used m this chapter, "harassment" may include but is not limited to any of the followmg cnmes (1) Harassment (PMC 908 010 or RCW 9A 46020), (2) Malicious harassment (PMC 904 040 or RCW 9A 36080), (3) Telephone harassment (RCW 9 61 230), (4) Assault m the first degree (RCW 9A 36011), (5) Assault of a child in the first degree (RCW 9A 36 120), (6) Assault m the second degree (RCW 9A 36021), (7) Assault of a child in the second degree (RCW 9A 36 130), (8) Assault m the fourth degree (RCW 9A 36041), (9) Usmg Force Against Another (PMC 9 040 030), (10) Reckless endangerment in the second degree (PMC 9 04 050 or RCW 9A 36 050), (11) Extortion in the first degree (RCW 9A 56 120), (12) Extortion in the second degree (RCW 9A 56 130), (13) Coercion (PMC 9 64 150 or RCW 9A 36070), (14) Burglary m the first degree (RCW 9A 52020), (15) Burglary m the second degree (RCW 9A 52030), (16) Cnmmal trespass in the first degree (PMC 9 52 020(a) or RCW 9A 52070), (17) Cnmmal trespass in the second degree (PMC 9 52020(b) or RCW 9A 52 080), (18) Malicious mischief in the first degree (RCW 9A 48 070), (19) Malicious mischief in the second degree (RCW 9A 48 080), (20) Malicious mischief in the third degree (PMC 9 64 010 or RCW 9A 48 090), (21) Kidnappmg m the first degree (RCW 9A 40020), (22) Kidnappmg m the second degree (RCW 9A 40030), (23) Unlawful impnsonment (RCW 9A 40040), (24) Rape in the first degree (RCW 9A 44040), (25) Rape in the second degree (RCW 9A 44 050), (26) Rape in the third degree (RCW 9A 44060), (27) Indecent liberties (RCW 9A 44 100), (28) Rape of a child m the first degree (RCW 9A 44073), (29) Rape of a child m the second degree (RCW 9A 44076), (30) Rape of a child m the third degree (RCW 9A 44079), (31) Child molestation in the first degree (RCW 9A 44 083), (32) Child molestation in the second degree (RCW 9A 44 086), (33) Child molestation in the third degree (RCW 9A 44 089), (34) Stalking (PMC 908 090 or RCW 9A 46 110) - 3 - 908 060 ORDER RESTRICTING CONTACT — VIOLATION The victim shall be informed by local law enforcement agencies or the prosecuting attorney of the final disposition of the case m which the victim is involved If a defendant is found guilty of a crime of harassment and a condition of the sentence restncts the defendant's ability to have contact with the victim or witnesses, the condition shall be recorded and a wntten certified copy of that order shall be provided to the victim or witnesses by the clerk of the court Willful violation of a court order issued under this section is a misdemeanor The wntten order shall contain the court's directives and shall bear the legend Violation of this order is a criminal offense under chapter 9A 46 RCW and will subject a violator to arrest 9 08 070 NONLIABILITY OF PEACE OFFICER A peace officer shall not be held liable m any civil action for an arrest based on probable cause, enforcement in good faith of a court order, or any other action or omission m good faith under this chapter arising from an alleged incident of harassment brought by any party to the incident 9 08 080 "CONVICTED," TIME WHEN As used in PMC 9 08 010 and 090, a person has been "convicted" at such time as a plea of guilty has been accepted or a verdict of guilty has been filed, notwithstanding the pendency of any future proceedings including but not limited to sentencing, post tnal motions, and appeals 9 08 090 STALKING — PENALTIES (1) A person commits the crune of stalking if, without lawful authonty and under circumstances not amounting to a felony attempt of another crime (a) He or she intentionally and repeatedly follows another person to that person's home, school, place of employment, busmess, or any other location, or follows the person while the person is m transit between locations, and (b) The person being followed is intimidated, harassed, or placed in fear that the stalker intends to injure the person or property of the person being followed or of another person The feeling of fear, intimidation, or harassment must be one that a reasonable person m the same situation would experience under all the circumstances, and (c) The stalker either (i) Intends to frighten, intimidate, or harass the person being followed, or (n) Knows or reasonably should know that the person being followed is afraid, intimidated, or harassed even if the stalker did not mtend to place the person m fear or intimidate or harass the person, and (d) The person is not guilty of a felony as defined in subsection (5) below (2)(a) It is not a defense to the crime of stalking under - 4 - subsection (1)(c)(i) of this section that the stalker was not given actual notice that the person bemg followed did not want the stalker to contact or follow the person, and (b) It is not a defense to the crime of stalking under subsection (1)(c)(n) of this section that the stalker did not mtend to frighten, intimidate, or harass the person being followed (3) It shall be a defense to the cnme of stalking that the defendant is a licensed pnvate detective acting within the capacity of his or her license as provided by chapter 18 165 RCW (4) Attempts to contact or follow the person after being given actual notice that the person does not want to be contacted or followed constitutes pnma facie evidence that the stalker intends to intimidate or harass the person (5) A person who stalks another person is guilty of a gross misdemeanor except that the person is guilty of a class C felony if any of the following applies (a) The stalker has previously been convicted in this state or any other state of any crime of harassment, as defined in PMC 9 08 050, of the same victim or members of the victim's family or household or any person specifically named m a no contact order or no-harassment order, (b) the person violates a court order issued pursuant to PMC 908 030 or RCW 9A 46 040 protecting the person being stalked, or (c) the stalker has previously been convicted of a gross misdemeanor or felony stalking offense under this section for stalking another person §2. And, as many people notice, a little bit of a rush follows, a bnefsharpemngofthe senses That head-clearing effect, according to Ronald Baenninger, one of the few scientists in the world to study yawning, is the best guess as to why we yawn It is a way of in- creasing mental alertness when it matters He notes, for example, that yawning is most commonjust after people wake up and late at rught when they're tying to stay awake Once people "give themselves permission to fall asleep at night" he said, yawning ceases "As everybody knows, people also yawn a lot when they're bored," said Baenninger, who teaches psychology at Philadelphia's Temple University "Classrooms and lecture halls are the absolute best places to observe yawning" Baenninger sees these all as instances in which subconscious mechanisms in people's brains are trying to get them awake and alert or to keep them that way Nobody knows ex- actly what the mechanism might be Some suggest the mechanics of yawning improve drainage of blood from the brain, allowing a brief surge of fresh, oxygenated blood to en- ter Others suspect the act may somehow trig- ger the brain's production ofstunulatoryneu- rotransmitters, substances that relay signals from one bratn cell to another "It's not just people, either," he said "All kinds of ammals yawn Birds yawn Even fish yawn For a behavior to be that widespread, it has to have a real purpose" Baennmger said many animals yavvn at the same times that people do Lions in the wild yawn in the early evening as they are gettmg up from their daytime napping to prepare to hunt.
