ORDINANCE NO. 2901
AN ORDINANCE relating to zoning and platting and establishing
planned density development designations for
properties to be included within Desert Plateau
Division #2.
WHEREAS, the City of Pasco has established zoning and
subdivision regulations to protect and enhance the overall
welfare of all residents of the city; and,
WHEREAS, the comprehensive plan encourages a full range
of residential environments catering to a variety of life styles
and income ranges; and,
WHEREAS, the comprehensive plan encourages the use of
innovative techniques in the design of residential environments;
and,
WHEREAS, the City Planning Commission conducted a public
hearing and through the hearing process, recommended the City
Council approve a preliminary plat for Desert Plateau Division #2
with planned density development designations; and,
WHEREAS, previous planning has caused the necessary
infrastructure capacities to be developed to serve all quarter
sections in Section 14, T9N 29E; except the southwest quarter;
and
WHEREAS, Desert Plateau Division #2 is located in the
northwest quarter of Section 14, Township 9, North Range 29 East;
and,
WHEREAS, the proposed lot layout of Desert Plateau
Division #2 provides for development at less than the overall
permitted density thereby lessening impacts to infrastructure and
surrounding development; and,
WHEREAS, the City Council of the City of Pasco held a
public hearing to review the proposed preliminary plat for Desert
Plateau Division #2 and after considering existing
infrastructure, past planning, the comprehensive plan and the
recommendation of the Planning Commission, has concluded that in
keeping with RCW 58.17.170 the proposed plat will:
1) Prevent the overcrowding of land;
2) Provide for the effective use of land;
3) Provide for safe travel within the community;
4) Be adequately served by previously planned municipal
services;
5) Provide housing for present and future residents of the

PERSE (1) a person is fi ullty of failure to disperse
(a) He or she congregates
with a group of three or
more other persons and
there are acts of conduct
within that group which cre
ate a substantial risk of
causing injury to any per
son or substantial harm to
property and
(b) He or she refuses or
fails to disperse when or
dared to do so by a police
officer or other public ser
vant engaged in enforcing
or executing the law
(2) Every person found to
have committed a violation
of failure to disperse shall
be subject to the penalties
provided in RCW
9A 20 021(3) as amended
