AN ORDINANCE vacating certain portions of Duluth Street
right-of-way.
WHEREAS, a petition signed by more than two-thirds (2/3)
of the owners of property abutting the street rights-of-way
herein below described has been submitted to the City Council of
the City of Pasco; and,
WHEREAS, all steps and procedures required by law to
vacate said rights-of-way have been duly taken and performed;
NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO
ORDAIN AS FOLLOWS:
Section 1. That the Duluth Street right-of-way between
the west right-of-way line of Oregon Avenue and the east
right-of-way of Main Avenue as depicted in Exhibit 1 be vacated
subject to the easement retained in Section 2 hereof.
Section 2. That the City shall retain an easement and
right to exercise or grant easements with respect to the northern
20 feet of Duluth Street between the east right-of-way line of
Main Avenue and the west right-of-way line of Oregon Avenue; and
a 20 foot strip parallel, adjacent and east of the easterly
right-of-way line of Main Avenue.
Section 3. That a certified copy of this ordinance be
recorded by the City Clerk of the City of Pasco in and with the
Office of the Auditor of Franklin County, Washington.
Section 4. This ordinance shall be in full force and
effect after its passage and publication as required by law.
