HomeMy WebLinkAbout2880 OrdinanceORDINANCE NO. 2880 AN ORDINANCE regulating "Going out of Business" Sales, and creatmg new Chapter 5 05 to the Pasco Municipal Code WHEREAS, the Pasco City Council believes that the advertising of "close-out sales", "going out of business sales", or the like have the potential for misleading the public as to the value of the goods being sold as to the reason for the sale, and the City Council further believes that the advertising of such sales in the City of Pasco has been abused by certain merchants and that the public safety and welfare would be benefited by local regulation of such sales, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DOES ORDAIN AS FOLLOWS: §1. New Chapter 5 05 to the Pasco Murucipal Code is hereby created, which Chapter shall read as follows Chapter 5 05 "GOING OUT OF BUSINESS" SALES Sections 5 05 010 License Required 5 05 020 Person Defined 5 05 030 License Application Requirements 5 05 040 License Fee 5 05 050 Filing of Applications 5 05 060 False Applications 5 05 070 Violation 5 05 080 Exemption 5 50 090 Penalty for Violation 5 05 100 Severability 5 05 010 LICENSE REQUIRED It is unlawful for any person licensed under this title to advertise or conduct any sale of goods, wares or merchandise at retail, which, by representation or advertisement would lead a reasonable person viewing, reading or hearing the advertisement or representation to believe that the person conducting said sale is quitting business at the conclusion of the sale, or that the licensed business will be closed permanently or cease doing business at the end of the sale, without first obtaining from the City Finance Director a license to do so, to be known as a "Quitting Busmess Sale License" Such license shall be issued by the City Finance Director upon payment of the proper license fees heremafter provided for The actual wording of the advertisement or representation is immaterial except for the message conveyed to a reasonable person that would view, read or hear the advertisement or representation 5 05 020 PERSON DEFINED "Person", as used in this chapter, includes any person, firm, or corporation in the city The manager of any firm or corporation shall be deemed responsible for the obtaining of such license as well as such person, firm or corporation 5 05 030 LICENSE APPLICATION REQUIREMENTS Any person desiring to secure a license to advertise or to conduct any sale referred to in §5 05 010 of this chapter shall make application for a license therefor to the City Finance Director The application shall state the name and address of the person, firm or corporation applymg for the same and shall specify the period of time during which the sale shall continue, which shall not exceed ninety (90) days, and shall contain an explanation of the reason for the sale, i e, "lost building lease and business will be moving at the conclusion of the sale", or "going out of business at conclusion of sale", — — and that the comments contained in said application are true and correct and known by him or such agent under penalty or perjury to be true and correct 5 05 040 LICENSE FEE The license fee for of $30 00, for a period not exceeding ninety (90) days 5 05 050 FILING OF APPLICATIONS The file such applications and shall endorse on each license is granted or refused such sale shall be the sum City Finance Director shall application the date the 505 060 FALSE APPLICATIONS It is unlawful to make a false statement in any such application 5 05 070 VIOLATIONS It shall be unlawful for any person to continue business after the term of the license expires Any current business license permitting the operation of such business in the City of Pasco shall also expire without refund with the expiration of the license issued under this chapter Such busmess at the location of its prior license shall not be eligible for relicensing at such location during the 365 days following the expiration of the special license required by this chapter and the expiration of the underlying business license, unless the applicant can show to the satisfaction of the City Council that changed circumstances unanticipated by the applicant at the time of the going out of business sale now justify reopening the business 5 05 080 EXEMPTION This chapter shall not apply to public or court officers or any person acting under the direction of state or federal courts in the course of their official duties 5 05 090 PENALTY FOR VIOLATION Any person violating any of the provisions of tins chapter and being convicted thereof, shall be punished by a fine not to exceed $5,000 and/or imprisonment of not more than one year, or both such fine and imprisonment - 2 - FELICE !IP AJAI RUBSTELL: torney CATHERINE D S :-MAN Deputy City Clerk 5 05 100 SEVERABILITY If any section, subsection, sentence, clause, or phrase of this chapter is for any reason held to be invalid or unconstitutional, such a decision shall not affect the validity of the remaining portions of this chapter §2.
