HomeMy WebLinkAbout2840 OrdinanceORDINANCE NO a34/0 AN ORDINANCE concerning the licensing of a massage business, and creating new Chapter 5 70 PMC, amending Chapter 5 68 PMC, and, repealing Chapter 5 72 PMC WHEREAS, the Washington State Department of Licensing, through the authority granted to it by RCW 18 108, regulates the licensing of massage practitioners in the State of Washington, negating the need for comprehensive local regulation of the massage business, and WHEREAS, current Chapter 5 72 of the Pasco Municipal Code conflicts with the new legislative requirements of Chapter 182, Laws 1991, enacted by the Washington State Legislature and effective July 28, 1991, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN AS FOLLOWS: §1. New Chapter 5 70 to the Pasco Municipal Code is hereby enacted, which chapter shall read as follows CHAPTER 570 MASSAGE BUSINESS Sections 5 70 010 5 70 020 5 70 025 5 70 030 5 70 040 5 70 050 Defimtions License Required State Licensed Massage Practitioners Exceptions Transfer of License Violation and Penalty 5 70 010 DEFINITIONS For the purposes of this chapter, the following words and phrases shall have the mearungs respectively ascribed to them by this section (1) "Massage" and "massage therapy" means a health care service involving the external manipulation or pressure of soft tissue for therapeutic purposes Massage therapy includes massage techniques such as methods of effieurage, petrissage, tapotement, tapping, compressions, vibration, friction, nerve strokes, and Swedish gymnastics or movements either by manual means, as they relate to massage, with or without the aids of superficial heat, cold, water, lubricants, or salts Massage therapy does not include diagnosis or attempts to adjust or - 1 - manipulate any articulations of the body or spine or mobilization of these articulations by the use of a thrusting force (2) "Massage practitioner" means an individual licensed under this chapter (3) "Massage business" means the operation of a busmess where massages are given 5 70 020 LICENSE REQUIRED (1) No person shall engage m or carry out the business of massage or massage therapy or engage in or operate a massage business without first applying for and receiving from the city a busmess license under this chapter (2) No person may represent himself or herself as a massage practitioner without first applying for and receiving from the city a business license under this chapter or be employed by a massage busmess licensed under this chapter A person represents himself or herself as a massage practitioner when the person adopts or uses any title or any description of services that incorporates one or more of the followmg terms or designations massage, massage practitioner, massage therapist, massage therapy, therapeutic massage, massage technician, massage technology, massages, masseur, masseuse, myotherapist or myotherapy, touch therapist, reflexologist, acupunctunst, body therapy or body therapist, or any denvation of those terms that implies a massage tecluuque or method (3) All applications for a massage business license under this chapter shall be accompanied by a legible photocopy of the applicant's State Massage License as provided for m RCW 18 108 030 (4) No license may be issued under this chapter without the prepayment of the general business license fee set forth m Chapter 5 04 of this title 5 70 025 STATE LICENSED MASSAGE PRACTITIONERS It is unlawful for any person(s) or busmess licensee to employ or contract with anyone not licensed under RCW 18 08 030 to perform massage or massage therapy 5 70 030 EXEMPTIONS This chapter does not apply to (1) An individual givmg massage to members of his or her immediate family, (2) The practice of a profession by individuals who are licensed, certified, or registered under the laws of this state and who are performing services within their authorized scope of practice, (3) Massage practice at the athletic department of any institution maintained by the public funds of the state, or any of its political subdivisions, - 2 - (4) Massage practice of the athletic department of any school or college approved by the Washington State Department of Licensing by rule used and recognized national professional standards 5 70 040 TRANSFER OF LICENSE No license or permit shall be transferable 5 70 050 VIOLATION AND PENALTY Every person, except those persons who are specifically exempted by this chapter, whether acting as an individual owner, employee of the owner, operator or employee of the operator, or whether acting as a mere agent or independent contractor for the owner, or acting as a participant or worker in any way directly or indirectly who gives massages or operates a massage business, or any of the services defined in this chapter, without first obtaining a license or permit and paying a fee to do so as required by this chapter, or violates any provisions of this chapter, shall be guilty of a gross misdemeanor and upon conviction, such person shall be punished by a fine not to exceed $5,000 or impnsonment for a period not to exceed one year, or by both such fine and imprisonment §2. Chapter 5.72 of the Pasco Municipal Code is hereby repealed m its entirety §3. Chapter 5 68 of the Pasco Municipal Code is hereby amended to read as follows (deletions shown by interlmeation and additions shown by underlining) 5 68 030 EXCEPTIONS This chapter shall not apply to any of the following individuals while engaged in the personal performance of the duties of their respective professions (a) Physicians, surgeons, chiropractors, osteopaths, massage practitioners, eperat-efs 7 nurses, or physical therapists licensed to practice their respective profession in the State of Washington §4. Licensing (2) Private detective means a person who is no quired to be licensed by the Washington State Depart ment of Licensing for em- ployment by a private detective agency for the purpose of Investigation escort or body guard serv ices or property loss pre vention activities (3) Private detective agen- cy means a person or en- tity required to be licensed by the Washington State Department of Licensing to be engaged in the business of detecting discovering or revealing one or more of the following (a) Crime criminals or re lated information (b) The identity habits con duct bu%ness occupation honesty Integrity credibil ity knowledge trustworthi ness efficiency loyalty activity movement where abouts affiliations asso ciations transactions acts reputation or character of any person or thing (c) The location disposi tion or recovery of lost or stolen property (d) The cause or responsibi lay for fires liables losses accidents or damage or in jury to persons or to prop erty (e)Evidence to be used be fore a court board officer or investigative committee (f) Detecting the presence of electronic eavesdrop ping devices or (g) The truth or falsity of a statement or representa- tion (4) Armed private security guard means a private se- curity guard who has a cur- rent firearms certificate issued by the Washington State Criminal Justice Training Commission and is required to be licensed as an armed private secu rity guard by the Washing ton State Department of Licensing (5) Private security corn pany means a person or entity required to be ft censed by the Washington State Department of Li censing to be engaged in the business of providing the services of private se- curity guards on a contrac tal basis (6) Private security guard means an individual who is required to be licensed by the Washington State De partment of Licensing in order to be principally em ployed as or typically re- ferred to as one of the following (a) Security officer or guard (b) Patrol or merchant pa trol service officer or guard (c) Armed escort or body guard (d) Armed vehicle guard (e) Burglar alarm response runner or (ft Crowd control officer or guard 5 46 020 LICENSE RE OUIRED (1) No private de tective agency or private security company shall do business in the City without first obtaining a license under the provisions of this chapter No armed private detective private detective armed private security guard or private security guard shall do business or engage in their occupation without first being licensed under the provisions of this chapter as a private detec tive agency or private secu rity company as appropriate or being em ployed by a private detec nye agency or private security company licensed under the provisions of this chapter 5 46 030 LICENSE FEE The license fee for a private detective agency or a pri vete security company shall be equal to the general business licensing fee under Chapter 5 04 of this title 5 46 040 PROOF OF STATE LICENSE RE QUIRED The business Ii cense application for any private detective agency or private security company shall be accompanied by a legible photocopy of the„ap plicant s state license is sued under-the control of the city unless the Chief of Police has granted a permit for such parade pro cession or formation 10 96 030 PERMIT RE (WIRED It shall be unlaw ful for any person to initiate promote or participate in any parade within the City until a permit therefore has first been secured 10 96 040 APPLICATION FOR PERMIT Parade per mits may be obtained from the Chief of Police upon ap plication made in writing at least seventy two (72) hours before the date on which the parade is to be held upon application forms furnished by the Chief of Police The application form shall include the following infor motion (a) The date and starting 40A LEGALS (b) The name address and telephone number of the applicant and the name of the organization involved (c) The formation or assem bly area and time therefor (d) The route of the parade or motorcade and what por- tions of the streets tra versed may be occupied by such parade or motorcade (e) The approximate num ber of people and vehicles In the parade or motorcade (f) The purpose of the pa rade or motorcade 10 96 050 CONDITIONS OF ISSUANCE Upon the filing of a timely completed application the Chief of Po lice shall within forty-eight (48) hours (excluding any holiday Saturday or Sun day) issue such permit in all cases except where the time place and manner are not in conformity with the rules set forth below and except where the permit would conflict as to time or place with a permit previ- ously issued No fee shall be charged for any such permit No permit shall be issued authorizing a parade pro- cession or formation under the following conditions (a) When the sole purpose is advertising any product goods wares merchandise or event and is designed to be held for private profit (b) When the time route and size will disrupt the use of any street or public place or material portion thereof which is ordinarily subject to substantial con gestion or traffic and is chiefly of a business or mercantile character ex cept upon those holidays or Sundays when places of business along the route proposed are close (c) When it is of a size or na- ture that requires the diver sion of so great a number of police officers of the city to properly police the line of movement and the areas contiguous thereto that al lowing the parade or motor cade would deny reasonable police protec tion to the city The Chief of Police shall have the authority to modify the route time and place of a parade to facilitate crowd control in the interest of no lieving congestion and pro moting public safety provided that the appli cant s right of free speech is not denied thereby 10 96 060 DENIAL PUB LIC HEARING (a) In the event an application for a parade permit is denied by the Chief of Police the ap plicant may apply to the City Council for a hearing concerning the same (b) At such hearing the ap plicant shall have the bur den of proof of showing that the proposed parade will not be contrary to any of the conditions for denial as set forth in the preceding sec tion The Chief of Police shall be heard in rebuttal to the granting of the applica eon (c) If after heanng the ap- plicant and the Chief of Po lice the City Council shall find as a fact that the pro posed parade will not be contrary to any of the condi eons for denial set forth in th preceding section the application shall be granted by the City Council other wise the action of the Chief of Police in denying the ap plication shall stand (d) The decision of the City Council shall be final un less appeal is perfected with a court of proper juns diction within ten (10) days of the City Council s deter mination 10 96 070 COMPLIANCE WITH PROVISIONS All pa rade permits shall be is sued subject to the parade being held in conformance with all applicable proivi
